I have been following the 2012 Election Petition since the first sitting of the Supreme Court and I have reached a stage where am compelled to make a few observation. So far both the Bench and the Bar have, in my view, performed creditably but since the jailing of the two gentlemen for the contemptuous comments they made against the Judges of the SC I now find the proceedings going off course. Certainly the two gentlemen should not have made such comments when the case of the petition is still in progress but at the same time, and I stand to be corrected, I wonder whether the Supreme Court has arresting power to bring anybody to court and the same SC Judges adjudicate in the matter since, to my mind, they played the roles of Judge and Jury in the case. The issue whether the comments were contemptuous should have been the responsibility of an Independent Regulatory Body before, if it is found that it was indeed contemptuous, to be sent to a lower court first. What has happened so far strikes me as dictatorial and arbitrary and sets a very bad precedent in our dear country.

Instead of seeing the election petition before the court as a process that solidifies democracy in our country, many high profile Ghanaian politicians and journalists, including the calibre of Mr. Kwadwo Owusu-Afriyie ("Sir John") wrongfully perceive the process as a circus.

It is unfortunate that as a lawyer and I suppose a member of the Bar Association, Mr. Kwadwo Owusu-Afriyie will stoop so low and make utterances that could potentially bring administration of justice into disrepute. His behaviour is a testament that some people will say and do anything for partisan political gain. Same unto you, so-call "Sir John".
