The whole episode is turning into a concert. Details of Amidu's review request were not mentioned, but l think if there was an element of miscarriage of justice, the defence team of Isofoton and Woyome should appeal why should it take the same Amidu to apply for review that will be a slap in the face of the Justices who ruled in this matter.

“to refund to the Republic of Ghana all sums of money paid to it in connection with the two inoperative Agreements dated 26th April 2006 and the work done on the stadia.”
The Court, amongst other things, declared the two Agreements null, void and without effect whatsoever, and quashed all proceedings that had taken place in the High Court in relation to them.
In the first case there appears to be "an inoperative contract" and some work done. In the second instance the Supreme Court declared two agreements null and void.
Which parties suffered the miscarriage of justice? What are the "exceptional" circumstances that Mr. Amidu refers to? Dear Mr Amidu kindly enlighten the public on the specific grounds of your application for review.

(1) An appeal shall lie from a judgement of the Court of Appeal to the Supreme Court-

(3) The Supreme Court shall have appellate jurisdiction, to the exclusion of the Court of Appeal, to determine matters relating to the conviction or otherwise of a person for high treason or treason by the High Court.
(4) An appeal from a decision of the Judicial Committee of the National House of Chiefs shall lie to the Supreme Court with the leave of that Judicial Committee or the Supreme Court.
THAT THE SUPREME COURT IN THE PERFORMANCE OF ITS APPELLATE JURISDICTION AND AUTHORITY VESTED IN THE COURT BY GHANA 1992 CONSTITUTION CAN AND COULD MAKE ANY ORDERS AND GIVE JUDGEMENTS AS THE COURT DEEM IT FITTING AND PROPER.
THAT THIS APPELLATE JURISDICTION AUTHORITY OF THE COURT IS CLEARLY DISTINCT AND DIFFERENT FROM THE COURT CONSTITUTIONAL AUTHORITY VESTED IN A DECLARATORY JUDGEMENT AUTHORITY OF THE COURT.

So the only basis on which he could have initiated his court action was by invoking some constitutional right and in that sense the Supreme Court sat as a Constitutional Court and not as an Appellate Court to hear proceedings from a lower ranked court involving the parties to the dispute..
Am I right in thinking that as an Appellant Court the Supreme Court's decisions can be reviewed but as a Constitutional court its decisions are final?

You haven't shown any proof why Mr Amidu has failed for review cos he felt some aspects of the cases constitute miscarriage of justice. He did present his full grounds for reaching such a conclusion even though he mentioned that the AG was left off the hook in one of the cases, i.e., even though a defendant, the SC was silent on any verdict against the AG as an integral party to to the fraud committed against the good people of Ghana, with a key officer from the AG office known to have got a cut! Clearly, that's a miscarriage of justice!
Btw, your level of writing and argumentation won't make me hand over a case of fowl theft to you not to mention international legal case! What has that moribund National House of Chiefs got to do with this case?

The definition of what constitutes a miscarriage of justice under Ghana's laws is highlighted at the bottom of this post. Given the circumstances surrounding the Waterville/Isofoton cases it appears that Mr. Amidu has a very strong case that indeed against the interest of the State there was a miscarriage of justice in allowing these awards.
It will be interesting to see whether the defendants will be listed in his suit as individuals and/or institutions and whether at the highest level all those involved in causing such catastrophic loss to the State due to illegally facilitating and awarding judgement debts will be held to account.
Miscarriage of Justice under Ghana's laws include:-
• Giving judgment in favour of persons after taking money from
them
• Hiding vital information from a law court to ensure a particular
result
• Lying to a court to ensure that an innocent person is convicted or
a guilty person is freed
• Using state security personnel against personal enemies or
political opponents
• Providing police protection for a criminal for private benefit
• Allowing crime suspects to escape from lawful custody

Though the Court ordered the parties to pay some of the money back to the State the issue now is investigating the processes that led to the justice system making the award in the first place.
For instance the process of the State not investigating or rigorously defending the State's case in order to prevent the award being made is crucial in any such review. Even looking into the fact that Waterville Ltd Ghana did not even have a parent company abroad and the State failed to carry out due diligence checks on the existence of Waterville's parent company (an online company search through the company registry may have sufficed or even a more detailed company review given the
amount of money involved in the judgement debt claim). Further questions such as who was involved and why they failed to act in the State's interest?
These are the sort of questions the court may ask themselves before coming to a decision that a miscarriage of justice did in fact take place.

We know the court ordered Waterville and Isofoton to pay back the money.In case of Forson, the court declared no case. With regards to woyome, the sc wanted the high court to complete it's case which is still in court. But with regards to the AG, the SC did not make any ruling at all. This is what Amidu probably considers as miscarriage of justice. He is now probably seeking the court to now make a specific ruling on the AG. He made an application in June to that effect without going public but Amidu was forced to go public when part of the woyome case was held in secret last week.He probably feels the AG's office is trying to cover up something. My guess is the names of the gov't ministers who helped in the robbery are being disclosed.
