TO RESCUE THE SITUATION, THE POOR IS NOW BEING FORCED TO PAY. THIS IS INJUSTICE. THIS IS NOT THE GHANA KUFFOUR HANDED OVER TO NDC, HE EVEN ADDED FRESH CRUDE OIL WELLS. NPP TRANFORMED GHANA TO A MIDDLE INCOME ECONOMY WITH LIMITED RESOURCES BUT GOOD POLICIES. NDC IS WOEFULLY REVERSING THESE NPP ACHIEVEMENTS. GHANA'S CURRENT SITUATION IS VERY DISTURBING. WHEN THE HISTORY IS TOLD, IT WILL BE SAID THAT GHANAIANS WERE OFFERED FREE SECONDARY EDUCATION, IMPROVED UNIVERSAL HEALTH CARE, SOCIAL HOUSING FOR THE POOR AND AN EGALITARIAN SOCIETY BUT 50% SAID NO THANK YOU. THEY PREFERRED ECONOMIC "WOYOMISATION" & "AKONFEMISATION" , PHANTOM DEVELOPMENT PROJECTS, PHILANDERERS FOR LEADERS, MACHIAVELLIAN DISRESPECTFUL CORRUPT LOUTS AND A VISIONLESS EVIL GOVERNMENT. Some legal luminaries indeed! Ahhba! What does these so called legal luminaries mean by Bad Faith? I am not a lawyer, but I think that if someone sue you about something and you think that the person has shelved some information that would help your side of the case, the proper thing for you to do is COUNTER SUE and bring out the shelved information as your counter EVIDENCE. The problem with the respondents was that if they did, it will have given more ammunition to the petitioners, and proved the petitioners case. They could not do that because, they looked carefully and did not find much in the NPP strong holds. The main evidence that the petitioners are relying on, I believe is the same and duplicated serial numbers, duplicated pooling station codes. This is where the respondents could not find in NPP strong holds. How on earth could there be same pooling station code, pooling station name and same information of records on the pink sheet, and claim one was for special voting? Which one, Afari Djan could not tell! When proved to him the lies he was telling, you could see the grin and contorted face he showed. The respondents missed the opportunity to claim bad faith, and cannot go back to redo it. As to the constitutional provision that all citizens 18 and above can register to vote, is too simplistic. If that is wholly true, the why do we need an electoral commission, and to enact laws to govern the electoral process?? For me, the ruling must seek to uphold the Law, and to serve notice that, violations of our laws, regulations and rules comes with a high price tag. Anything short of that will mean we accept corruption period.

You said president Mahama did not win the elections only to turn back and say Ghanaians voted for him but voted foolishly. The bitterness in you about this fine gentle president will sink you all. what makes the pinksheet legally bound into acceptance are that the representatives of all the political parties do signed the pinksheet showing their understanding and acceptance of the results at those various polling stations.

it would be very dangerious to set such a precedence in our Democracy and also injustice to the voters .

if a Party Agent did not sign the pinksheet s/he must state the reasons

but there is no column which demand presiding officer to state reasons why s/he did not sign the pinksheet.

that alone tells you that if a presiding officer did not sign s/he simple forgot because of fatique or
presure to protect the already counted Ballots.

Dr Afari Gyan's woeful performance and credibility in court does not endear him as an authority on constitutional electoral law. If he was an authority, as you claim then he flagrantly abused that law; he did not practice what he preached to the Nigerians and other countries.

To base your case partly, on his credibility, will lead to doom in the courts. The 9 justices will not all follow what your 'learned luminaries' think or believe will be the outcome.

The Stolen Verdict was the first electoral dispute between NDC and NPP.JJ Rawlings beat Prof.Adu Boahene in the 1992 presidential élections.Prof.Adu Boahene became so angry and emotional,he started making allegation that the election was rigged and fraud,wide spread of irregularities and malpratices exactly like what Akuffo Addo is doing today,20 years later.Adu Boahene,then the leader of Npp demanded his party to boycott the legislative in the subsequent élections.For that year,Npp didn't take part in the Parliamentary élections with the view of undermining the legitimacy of Executive and the Legislative.Prof.Adu Boahene knew that by participating in the legislative,he will have no basis to challenge any electoral results because you cannot be selective in justice.According to Prof.Adu Boahene the best protest was to boycott but that did not stop Rawlings from ruling.Nowadays,we go to General élections at the same to avoid Boahenism,selective participation.The stolen verdict is based on such a logic that if you feel the élections were not fair just boycott everything.This is NPP philosophy.We saw it in 2009 at Tain,and even in 2013 the 2 recent byelections,needless to note the Mps boycotts.So now,how do Npp explains the selective petition between Prez Mahama and Akuffo Addo and the acceptance of the 2012 parliamentary élections?Can Afari Gyan conduct free and fair élections for the legislative and rigged the presidential at the same time?Prof.Adu Boahene must be turning in his grave.Selective justice is not the option,we may have a new philosophy in Npp called Addoism,take some and leave some.Thank you.

A very interesting article. The writer must be a privileged journalist, to be informed about what the Respondents intend to do.

What does it mean to rely on 'bad faith' as a defence. Bad faith in law means 'intentional dishonest act, misleading another, or violating basic standards of honesty in dealing with others.

It may also mean 'double hearted' or in a layman's words 'double standards'. This meaning appears to be more applicable to the Respondents' approach(and suggested by the article).

The Petitioners are alleging that the presidential election is so marred by irregularities, fraud, and procedural defects, that Prez Mahama's election should be nullified. In trying to prove their case, they submitted 'evidence' that these acts happened in various polling stations. Most , or all of the polling stations selected were ones where Mahama had a majority of votes.

The Respondents, we understand are going to plead 'bad faith' as their defence. In other words, the Petitioners have been dishonest, and misleading in presenting polling stations which 'favoured' Mahama, and not the ones where the NPP might have benefitted from the acts, which they are complaining about.

Hence, the Petitioners are acting in 'bad faith' (applying double standards). If the presidential election is not reliable, then the argument goes, what about the parliamentary election which returned NPP candidates as MPs. You cannot have your cake and eat it, they shout. That is dishonest.

Well, this is my humble understanding of the article in view of the recent court case.

That is not all my good lady.Please draw your attention to the series of boycotts and their implications.The most significant one is the Inauguration ceremony,where the President Elect was sworn in by the Chief Justice.The Npp did everything possible to dissuade President Kuffour from attending the event.Reasons being that Kuffour's presence to honour Prez Mahama is betrayal to the party's position.It has also the potential to legitimise Prez Mahama and it could hurt their petition badly.Moreover,Npp Mps felt they should boycott any presidential address and any instruction coming directly from the president to manifest their solidarity with the petitioners.They quickly made a U-turn when they sensed that their putting themselves into trouble.Their credibilty were at stake including the élections they won.They met the bad face of reality,a choice to work effectively or resign massively.Npp carried the boycott into 2 different byelections,saying they have no trust in the electoral system.Another reason is that if they take part,it will give credence to Afari Gyan thus weakening the petition.On this note I will sing a song of praises for Prof.Adu Boahene for his bravery.You cannot be selective in demanding justice.Thank you.

I have always been a realist and not idealist.I have expressed my view,you can also do the same.I don't know where you are coming from with your "if".As a matter of fact,Prez Mahama has demonstrated "good faith" than Nana Addo in every aspect of the élections.He did not declare himself as winner as to what Sir John did for Nana Addo.He has allowed the smooth running of the petition,contrary to the provison in the Constitution where the president has immunity previledge.These are some essential qualities of "good faith".You can see that I am not carried away by this article so please try to be creative.Thank you.

Ridiculous that pleading bad faith as defense by respondents could win the case. Petitioners brought what they saw as irregular to the court. This was not easy for them in 21 days.
