Does this report by the Al-Hajj Newspaper not constitute contempt of court since it appears not to be quoting from any of the written submissions to the SC but their own submission with a definite conclusion? Or are the various sections from either the lead Counsel for the First Respondent or the Third Respondents? It's a very interesting and persuasive argument supported by good authorities in Constitutional Law. However, I believe this will come against similar good and persuasive argument supported by equally strong authorities in Constitutional Law from the Petitioners. I hope after tomorrow's hearing, the written submissions by all parties would be made available on the web.

So I do not see the greatness in the article. We all saw how evidence was tendered in court through Kojo Afari Gyan as to how these irregularities (pink sheets with same serial numbers, same polling stations names, but different results for example) went into the declaration of mahama as president.
So where is the condition that "the error did not affect the results" in the case before the supreme court?
To be wishful is human but to see a piece of shit as great is definitely stupidity.
If you wish that the case is thrown out, that is pardonable but to see this useless piece as the right conduit for such a decision......

Thats is what Nana Addo and NPP has been saying and asking John Mahama to leave office because he didnt win the election.

- Or is it the blanks, zeros or minor errors entered at the wrong places

- Or is it the wrong definition of over voting

The Petitioners are only claiming the results have been affected because they have decided in their own court to cancel all valid votes at a polling station even where a minor error of 1 or 2 votes are detected.

I can assure you that in the cited case if the number of the rejected votes concerned was less than 20, the court will never have vitiated the polls.

Elections are governed by rules and regulations; someone has to qualify to vote, otherwise any foreigner can walk into a registration centre and vote, others can just wheel in their toddlers and get them to vote becauase they are also citizens.

Multiple registration and multiple voting as well as ballot dumping obviously occurred in the 2012 election. That is why Ghana with a population with 45% under 18 years of age registered more than 50% votes. There was fraud in election 2012. That is what the petition seeks too unravel!

courts all over the world depend on precedents from other countries unless the basis of the law is different. eg all the precedents cited by Mahama are from the commonwealth of nations, whose basis is the English common law. that is why a Ghanaian judge can serve in Canada, Kenya or Nigeria...or any carribean country. infact we trained the judges of these other countries. unless the basis of the law is different say Chinese law vrs English laws. but then again unless the law is based on cultural issues. in this case the Chinese can use the English because the issue at stake is not a cultural one but an administrative one based on the fact that we are all human and fallible. what the petitioners have not proved is the fact that NPP did not bribe the presiding officers to make mistakes so that he can have a basis for going to SC. it cut both ways and I fear that the petitioners have not tried to persuade the SC since the burden of proof is on them

THE OTHER LEGAL ISSUES RAISED IN THE INSTANT MATTER ARE AS FOLLOWS:
(i) WHETHER OR NOT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN BE SUED OR TO BE JOINED TO A LAWSUIT AS DEFENDANT?

THAT ARTICLE 57 CLAUSES 4,5,6 OF THE CONSTITUTION IN MY HUMBLE SUBMISSION CLEARLY SERVED AS AN OUSTER CLAUSE TO ARTICLE 64 UNDER WHICH THE PETITIONERS RESORTED TO THIS INSTANT CASE.
THAT THE LEGAL SETTLED PRECEDENT IN THE CASE OF "NPP VRS.PRESIDENT RAWLINGS & ATTORNEY GENERAL" IN THE CASE WHERE NPP CHALLENGED THE FORMER PRESIDENT WHEN HE WAS THE SUBSTANTIVE PRESIDENT OF GHANA AND APPOINTED THE DISTRICT CHIEF EXECUTIVES AND THAT NPP CHALLENGED THE PRESIDENT CONSTITUTIONAL AUTHORITY OF MAKING SUCH APPOINTMENTS.
THAT THE SUPREME COURT HELD UNANIMOUSLY THAT THE FORMER PRESIDENT ACTED PROPERLY UNDER THE CONSTITUTIONAL POWERS VESTED IN THE PRESIDENT IN ACCORDANCE WITH ARTICLE 57 CLAUSE 4 OF THE GHANA 1992 CONSTITUTION.
THAT IT WAS DURING THE ADJUDICATION OF THIS MATTER THAT A PANEL MEMBER OF THE SUPREME COURT ITSELF RAISED THE PRELIMINARY QUESTION WHETHER OR NOT A SITTING PRESIDENT OF GHANA CAN BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT?
THAT THE SUPREME COURT OF GHANA IN A MAJORITY 3-2 HELD THAT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CANNOT BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT BECAUSE OF THE SANCTITY OF THE PRESIDENCY.
THAT THE COURT CITED THE FOLLOWING CASES AS ITS LEGAL PRECEDENT AUTHORITY:
(a) AMOAKO TUFFOUR VRS. ATTORNEY GENERA
(b) SALLAH VRS ATTORNEY GENERAL
JUST TO CITE ONLY THESE TWO (2) CASES.

(ii) THE LEGAL ISSUE INVOLVING THE FAILURE OF SOME ELECTORAL OFFICIALS NOT SIGNING THE PINK SHEETS.
THAT IT IS MY RESPECTFUL SUBMISSION TO TAKE COGNIZANCE OF THE LAW INVOLVING "MENS REA" OR THE INTENT OF THE FAILURE TO SIGN THE PINK SHEET LOOKING UNDER THE CIRCUMSTANCES THAT THE OFFICIALS WORKED WHETHER OR NOT IT WAS "INTENTIONAL, DELIBERATE OR WILLFUL ACT" THAT THE ELECTORAL OFFICIALS INTENTIONALLY REFUSED TO SIGN THE PINK SHEETS WITH THE INTENTION TO CAUSE A WILLFUL INJURY TO A PARTICULAR CANDIDATE OR JUST "AN HONEST MISTAKE OR A MERE HUMAN ERROR" JUST TO BE CORRECTED?.
FURTHER, WHETHER OR NOT UNDER THAT CIRCUMSTANCE HAS THE ACT AFFECTED THE ACTUAL VOTES CAST? AND WHETHER THE COURT CAN CURE SUCH DEFECTS?

(iii) THE LEGAL ISSUE INVOLVING THE VOTERS REGISTER WHEN THE LEAD COUNSEL DULY TOLD THE COURT THAT THE EC BEFORE THE ELECTION WAS HELD GAVE NPP OR THE PETITIONERS COPY OF THE VOTERS REGISTER EVEN WITH THE SOFT WARE.
WHETHER OR NOT EC JUST GAVE THE PETITIONERS THE REGISTER WITH THE SOFT WARE FOR JUST GIVEN SAKE OR THE PETITIONERS WERE EXPECTED TO CHECK THROUGH THE REGISTER AND TO RAISE THEIR CONCERN,IF THERE WERE ANY?
IT IS THEREFORE MY HUMBLE SUBMISSION THAT THE LAW OF THE LEGAL THEORY OF "ACQUIESCENCE" PROVIDES FOR THE ANSWER THAT "YOU CANNOT CHOOSE OR PURPORT TO SLEEP OVER YOUR RIGHT AND AFTER THE ELECTIONS NOW WAKE UP FROM YOUR DEEP SLEEP TO PURPORT TO ASSERT THAT RIGHT. THAT THE PETITIONERS ARE ESTOPPED TO ASSERT SUCH RIGHT.

(iv) THAT THE LEGAL ISSUE INVOLVING THE PURPORTED MISTAKES MADE BEING THE ACCUSATION BY THE PETITIONERS ON THE PINK SHEETS THAT THE 2ND PETITIONER DR.BAWUMIA CLEARLY TOLD THE SUPREME COURT THAT "YOU AND I WERE NOT THERE BUT BASED ON THE FACE OF THE PINK SHEETS THAT THEY RAISED THOSE ERRORS". THAT IT MEANT THAT NO OFFICIAL REPORTS HAVE BEEN MADE TO THE PETITIONERS BY THEIR AGENTS OR THE SECURITY PERSONNEL THAT WORKED AT THE POLLING STATIONS WHERE THE ACTUAL ELECTIONS TOOK PLACE .
THAT THE 2ND PETITIONER CLEARLY INFORMED THE COURT THAT THEY THE PETITIONERS IN PREPARING THE PINK SHEETS ALSO MADE MISTAKES AND EVEN SAID THAT "AS HUMAN BEINGS WE ALL MAKE MISTAKES".
THEREFORE THE LEGAL ISSUES INVOLVED ARE AS FOLLOWS:
WHETHER OR NOT THE DOCTRINE OF EQUITY WHICH PROVIDES THAT "HE WHO SEEKS EQUITY MUST HIMSELF DO EQUITY AND THAT EQUITY AIDS THE VIGILANT AND HE WHO COMES TO EQUITY MUST COME WITH CLEAN HANDS".
THAT IN THE INSTANT CASE THE AGENTS OF THE PETITIONERS DID NOT MAKE ANY OFFICIAL REPORTS OF ANY ACTUAL IRREGULARITIES OR MALPRACTICES THAT ACTUALLY OCCURRED AT THE POLLING STATIONS WHERE THE ACTUAL VOTES WERE CAST AND THAT THE PETITIONERS THEMSELVES MADE THE SAME MISTAKES THAT THEY RESORTED ACCUSING ELECTORAL COMMISSION OF AND THAT THEY THEMSELVES "HANDS ARE SOILED AND DIRTY" CONTRARY TO THE DOCTRINES AND PRINCIPLES OF EQUITY AS SHOWN ABOVE.
FURTHER, WHETHER OR NOT THOSE MISTAKES WERE MADE INTENTIONALLY, WILLFULLY OR DELIBERATELY AND JUST HONEST HUMAN MISTAKES?
IT IS THEREFORE MY RESPECTFUL SUBMISSION THAT THE PURPORTED MISTAKES WERE "HONEST MISTAKES" AND MERE HUMAN ERRORS AND NOT INTENDED FOR ANY CONSEQUENCES.
FINALLY WHETHER THE PURPORTED ERRORS WOULD CHANGE THE FINAL RESULTS DULY DECLARED AND DULY GAZETTED WHERE THE ACTUAL BALLOT PAPERS CAST ARE STILL IN THE CUSTODY OF THE ELECTORAL COMMISSION WHICH HAS THE SOLE CONSTITUTION AUTHORITY TO PERFORM AND HAS DULY PERFORMED ITS CONSTITUTIONAL FUNCTIONS?

Right to Vote
Every citizen of Ghana of eighteen years of age or above and of sound mind has the right to vote and is entitled to be registered as a voter for the purposes of public elections and referenda.
Electoral Commission
43
(1) There shall be an Electoral Commission which shall consist of -
(a) a Chairman;
(b) two Deputy Chairmen; and
(c) four other members.
(2) The members of the Commission shall be appointed by the President under article 70 of this Constitution.

(1) A person is not qualified to be appointed a member of the Electoral Commission unless he is qualified to be elected as a member of Parliament.
(2) The Chairman of the Electoral Commission shall have the same terms and conditions of service as a Justice of the Court of Appeal.
(3) The two Deputy Chairman of the Commission shall have the same terms and conditions of service as are applicable to a Justice of the High Court.
(4) The Chairman and the two Deputy Chairmen of the commission shall not, while they hold office on the Commission, hold any other public office.
(5) The other four members of the Commission shall be paid such allowances as Parliament may determine.
(6) If a member is absent or dies, the Commission shall continue its work until the President, acting on the advice of the Council of State, appoints a qualified person to fill the vacancy.

The Electoral Commission shall have the following functions -
(a) to compile the register of voters and revise it at such periods as may be determined by law;
(b) to demarcate the electoral boundaries for both national and local government elections;
(c) to conduct and supervise all public elections and referenda;
(a) the guarantee of a fair and realistic remuneration for production and productivity in order to encourage continued production and higher productivity;
(d) to educate the people on the electoral process and its purpose;
(e) to undertake programmes for the expansion of the registration of voters; and
(f) to perform such other functions as may be prescribed by law.

Except as provided in this Constitution or in any other law not inconsistent with this Constitution, in the performance of its functions, the Electoral Commission, shall not be subject to the direction or control of any person or authority.

The author must go to sleep and start dreaming for there is no way Mahama will stay on as president cause the facts and the laws governing our elections has made it clear what constitute an irregularity and what happens if it is found reality.Mahama lost the elections and the facts are clear on the face of the pink sheets.I do not believe there where clerical errors because what was captured on the face of the pink sheets is what really took place.Our laws as written in the constituition only allows valid votes to be used to declare someone as president.ie why some votes are rejected during counting at the polling stations if a candidate on the face of the ballot is not selected properly.Prior to the elections,the EC gave laid down rules and this rules where used in training the presiding officers.ie why 4 polling stations results where annulled when irregularities where found.

NPP did not contest the results that made Mahama the president so which votes should the SC cancel?. Serial Numbers do not vote. The votes are counted and declared before all these administrative issues.

Fellow Ghanaians, if we allow the court to determine who won election in this country will serve a bad precedence, and will affect the trust we have in the electoral process. Ghana belongs to patriotic Ghanaians, not NPP.

Fellow Ghanaians, if we allow the court to determine who won election in this country will serve a bad precedence, and will affect the trust we have in the electoral process. Ghana belongs to patriotic Ghanaians, not NPP.

Why is it that Mahama won in 8 regions whiles Akufo Addo won in 2 but the difference between the two individuals is less than 3%? This is evidence that the voter population in each region is not the same. Ghanaians should stop making this error.

1 Now to Morgan v Simpson, the locus classicus:
A section in the English Electoral Act (Representation of the
People Act 1949, S. 37(1)) has been given extensive and comprehensive interpretation by the English Court of Appeal, Coram,Lord Denning MR, Stephenson and Lawton LJJ in the case of Morgan and Ors v. Simpson and Or ([1974] 3 All ER, Pg. 722).
Section 37(1) of the Representation of the People Act 1949, states as follows:

“No local government election shall be declared invalid by reason of any act or omission of the returning officer or any other person in breach of his official duty in connection with the election or otherwise of the local elections rules if it appears to the tribunal having cognizance of the question that the election was so conducted as to be substantially in accordance with the law as to elections or that the act or omission did not affect the result”.

2 Before interpreting the effect of this provision, Lord Denning thought that it was necessary that the negative mode in which it was expressed should be transferred into a positive one so as to show when an election is to be declared invalid. According to the positive mode of expressing the subsection:

“ a Local Government election shall be declared invalid (by reason of any act or omission of the returning officers or any other person in breach of his official duty in connection with the election or otherwise of local election rules) if it appears to the tribunal having cognizance of the question (i) that the election was not so conducted as to be substantially in accordance with the law as to elections (ii) or that the act or omission did affect the result”.

3 In Morgan v. Simpson, the facts where as follows: In a local government election, a total vote of 23,691 votes was cast. 82 ballot papers were validly rejected. Another 44 were also rejected because they had not been stamped with the official mark as required by the law. The polling clerks at the polling stations were at fault for this omission. If the 44 ballot papers had not been rejected, but had been counted, the petitioner, a candidate at the election would have won by a majority of seven votes over the respondent. In consequence of the rejection of the 44 ballot papers, the respondent had a majority of 11 and so was declared to be the successful candidate.
The petitioner sought an Order that the election be declared invalid because it had not been conducted substantially in accordance with the law as to elections; alternatively, that even if it had been so conducted, the omissions of the polling clerks had affected the result.

4 The High Court refused to make the Order, but an appeal to the Court of Appeal, the High Court judgment was reversed and the Order made, in the following terms as reported in the [1974] 3 All ER at p. 722.
“Held – (i) Under S. 37(1) an election court was required to declare an election invalid (a) if irregularities in the conduct of the election had been such that it could not be said that the election had been ‘so conducted as to be substantially in accordance with the law as to elections’, or (b) if the irregularities had affected the result. Accordingly, where breaches of the election rules, although trivial, had affected the result, that by itself was enough to compel the court to declare the election void even though it had been conducted substantially in accordance with the law as to elections.
Conversely, if the election had been conducted so badly that it was not substantially in accordance with the election law it was vitiated irrespective of whether or not the result of the election had been affected.
(ii) Although the election had been conducted substantially in accordance with the law as to local elections, the omission to stamp the 44 ballot papers had affected the result of the election which would therefore be declared invalid.
Decision of the Divisional Court of the Queen’s Bench Division
[1974] 1 All ER 241 reversed.”

5 Having done a comprehensive historical review of election cases involving the interpretation of a similar provision, Lord Denning came to the following conclusions:
“(1) If the election was conducted so badly that it was not substantially in accordance with the law as to elections, the election is vitiated, irrespective of whether the result was affected, or not.
(2) If the election was so conducted that it was substantially in accordance with the law as to elections, it is not vitiated by a breach of the rules or a mistake at the polls – provided that it did not affect the result of the election.
(3) But, even though the election was conducted substantially in accordance with the law as to elections, nevertheless if there was a breach of the rules or a mistake at the polls – and it did affect the result – then the election is vitiated.
Going back to Morgan v. Simpson, Lord Denning said:

“Applying these propositions, it is clear that in this case, although the election was conducted substantially in accordance with the law, nevertheless the mistake in not stamping 44 papers did affect the result. So the election is vitiated.

The petioners, by their own definition are seeking to cancel for example over 800 votes even where the so-called errors are less than 10, which is not the issue in the cited case.

I am very sure that if the number of the rejected votes in the cited case fell below 30 instaed of 44, the court will never have vitiated the results

The SC has done well to simplify the issues for the determination of the petition. First, were there statutory violations, omissions, malpractices and irregularities? Second, if these existed, did they have effect on the elections so as to overturn the results?
The Petitioners admitted that their votes were not reduced and neither were President Mahama's votes increased unduly by the EC. What they are saying is that, on the face of the electoral record sheets, there were overvoting on some, no signatures of Presiding Officers on some, some voters were not verified biometrically and some serial numbers were repeated on some. This is a lame argument.
If on a pink sheet it is recorded that that 100 persons voted but the total of the votes for individual candidates exceeded 100, this is clearly an error by the presiding officer - it is not possible to determine who benefited from this error.
The EC said all voters were biometrically verified except those who did have hands. Again the EC said the serial numbers on pink sheets had nothing to do about the identity of polling stations.
It is painful to lose an election in which you spent so much but Orga Akufo Addo can learn from the late President Mills' patient example. Mills lost 2000 and 2004 elections before the electorates showed him mercy to vote for him in 2008.
As someone once said, a right candidate is the one who even if fishes from the Atlantic Ocean come out to vote for him/her, they will endorse him/her. For now Akufo Addo is not the right choice of the people.
