Nana Addo wants to use the back door to the presidency just like his father because both could not win anything. Even winning the flag bearer primaries of his own party was tough for Nana Addo (thanks to Alan Kyeremanteng) for stepping down to allow him. How can he claim to have won the national elections when his party also lost the Parliamentary seats?

The Judiciary is one of the institutions left in Ghana with some respect and this will be a test case for them. I know they will not blow it by awarding the presidency to Nana Addo when he could not prove any of his allegations why he lost the elections.

Elections are won in the ballot box.

Will the Supreme Court take the right to universal suffrage from that number of people and tell the security services to enforce it? It means that any time people do not vote for a particular candidate he will call for votes to be annulled, were is therefore the guarantee that half of the population will have their votes annulled because of exercising their right to freedom of conscience and the right to vote for a person of their choice. Ghana has obligations to fulfill under the UN Convention on the citizen's right to Universal Adult Suffrage.
The Supreme Court should not offer the head of Ghana as a gift to to satisfy the wishful thinking of Nana Akuffo Addo.

No. Now the Bomb is that if NPP petition is given withheld then NO PRESIDENT IN GHANA can be declared winner of election by Vote Couonts but by unsigned pinksheet. What PPP or any political party should to win the next election is to get people to be party agents and Returning officer and tell them not to sign any pink sheet wherever they party does not win the votes. They then turn round and prevent the EC from declaring results and go to Supreme Court with petition that there are infractions on the pink sheets. Ghanaians must know that a President can not be declared on the face of pink sheets. We are treading on dangerous grounds. NPP should keep quiet and let it go for then to prepare for 2016. If they insist on winning this gone and dead election, and it comes to pass, that might be their last rule in Ghana because NDC can effectively and intentional cause problems on with pink sheets in future elections and run to the Supreme Court to rule in their favour.

Are the Actual votes at those affected polling stations more than registered voters over there? Is it the fault of voters that the presiding or returning officer should wrongly enter figures on pink sheets or failf to sign same? Is it the voters making that election officers should filled the collumn for non biometric verification which an indicmtent on the electoral officer and the innocent voter is made to pay for the sin of another?

The petitioners in the ongoing Presidential Election Petition have asked the Supreme Court to look critically at the votes obtained by President John Dramani Mahama and those attained by NDC parliamentary candidates put together during the December 2012 general election.

It emerged that the total votes declared for President Mahama by the Chairman of the Electoral Commission (EC) Dr. Kwadwo Afari-Gyan on Sunday, December 9, 2012, was far in excess of the total votes of all the NDC parliamentary candidates even though there was no ‘Skirt and Blouse’ phenomenon as it is referred to in local parlance.

President Mahama curiously garnered votes far in excess of 470,000 against the combined total votes of the 275 NDC parliamentary candidates even when the NDC had more of its candidate elected as MPs.

The petitioners, who are the New Patriotic Party (NPP) 2012 presidential candidate, Nana Addo Dankwa Akufo-Addo, Dr Mahamudu Bawumia, running mate to the NPP presidential candidate and Jake Otanka Obetsebi-Lamptey, NPP National Chairman, are challenging the declaration of John Dramani Mahama as President in the December 7 and 8, 2012 presidential election by Electoral Commission Chairman, Dr. Kwadwo Afari-Gyan.

Addressing the court on the final day of the landmark election petition which has travelled to its eighth month, Mr. Addison told the court that President Mahama as the first respondent had garnered 5,574,761 as against 5,127, 641, which is the total combined votes of all his parliamentary candidates, showing a difference of 447,120.

He also submitted that Nana Addo Dankwa Akufo-Addo, the first petitioner and presidential candidate of the New Patriotic Party (NPP) obtained 5,248,898 votes and his parliamentary candidates had 5,248,882 which showed a difference of only 16 votes.

The Majority in Parliament, according to Mr. Addison, secured 121,221 votes less than the Minority asking, “What accounted for this difference? It cannot be skirt and blouse phenomenon because the NDC are in the majority.”

Mr Addison said: “The 1st Petitioner obtained a total of 5,248,898 votes as against a total of 5,248,882 by all NPP Parliamentary candidates, showing a difference of 16. However the first Respondent (Mahama) obtained a total of 5,574,761 as against 5,127,641 by all NDC parliamentarians, showing a whopping difference of 447,120. This huge difference cannot be explained away by what is popularly called ‘skirt and blouse’ voting because the NDC had a majority in Parliament. This majority in Parliament is curious and undermines the one man one vote principle enshrined in the Constitution because a majority of Ghanaians voted for the NPP parliamentarians who now find themselves in the minority in Parliament. ‘‘The NPP candidates garnered 121,241 votes more than their NDC counterparts who now are in the majority in Parliament.”

Assuming 2 million votes in Ashanti would mean that the votes increased from 240,000 to 400,000. In fact the 121,241 votes to me shows that NPP did not get much support in their stronghold. Its time all the natives of of Kpedze and all its nearby villages and towns come togethera and put up their needs before the government of our nation. as the new geographical demarcation of the country into the new districts that have created, i can boldly testify that Kpedze is one of the biggest and farming community in the district, the population of the town is about 3000+. but what is the government doing to help the people around this area? since the year 2000, according to my research, i have come to the notice that development have massively taken place all over the country but still kpedze was left out,since the year 2000, the only thing that the government can boast of is that he puts on a two room newly depreciated post office, it this all we need to survive around this area? the government have created absolutely not a single job opportunity to the people of this area,the youth employment have not yet extended to this area,not even to talk of the school feeding program,even look at this even the good will St Anthony catholic church of the town have sacrificed their hard earn money to build a nice place just for the government to com and introduce the program, but he fails.the only government office in kpedze is the public schools only and maybe the post office that they put on.

Retroactive punishment therefore would represent the state of mind of an individual or group of individuals reflecting on an act that yielded no benefit to them; an act that in their free will would not have undertaken, for example, standing under the sun for hours or in the rain for hours. If someone cast his or her mind back to the fact that he/she stood under the sun/rain for many hours to cast his/her vote and only to be told eight months after that someone did not do what he/she had been paid to do, therefore the votes are nullified. This could amount to Retroactive punishment to the one who suffered under the sun/rain to cast his/her vote.

He pointed out that in the event of a judgement that upholds the case of the petitioners, the president, according to the law, would have been deemed never to have been in office. Someone should tell Abotsi that 1. Finding in favour of the petitioner is not upholding the case of the petitioner. A decision of a lower court can be upheld by a higher court on appeal, but this is not the case. 1( b) Also,
we don't know if the votes are invalid or not, that is what the SC is called on to decide on preponderance of the evidence before it, 2. He should know that the 'ratio' of the case will decide which of the parties prevail, 3. Nullifying the votes cast by individuals as they are expected by law to do and voters by legally discharging their duties as electorates would be punishing them for not fault of theirs, but for the sins committed by an agent of the state or its representative. The law requires that invalid votes should not be quantified, and should be rejected instantly. If the votes were not rejected at the casting and quantifying point, then the voter had accurately discharged his or her burden. If the returning officer for his part neglected to discharge his burden which is not the fault of the voter, then the offending officer should be punished but not the voter who did his part according to prescription of the electoral laws. Nullifying a voter' s vote for no fault of his is not punishing the president but the voter. Turning around to disenfranchise him is to punish him after the fact and therefore retroactively, which no one can justify. For there is no grounds for punishing any one retroactively, which is Tsatsu's point. Tsatsu use of the word is in reference to voters disenfranchisement but not punishing the president or the presidential candidate.
4. The constitution says that in the case of disputes, the out come of the case, even if it goes against the siting president, or the president whose legitimacy as such is in dispute, should not be prejudicial to the said president. This means that Mahama would be recorded in the history books as the president for the period of the disputes - from December to August. This case is about the constitution and the electoral laws of Ghana, it is not solely constitutional and it is a complex case. 5. The SC has the facts and the laws before it , so pundits like Abotsi etc should refrain from prejudging the case. The respondents ' address is just that. The SC would find for one party or the other depending on which party 's argument persuades it on the balance of probabilities.
