We understand that it is a pro-NPP paper, but one would have expected it to help in the peace efforts by not publishing any story likely to inflame passions at this critical stage of awaiting the SC verdict.
If the Minister felt that he could overdo Sir John in 'contempting' the SC, the editorial board of the paper should know and have done better.
In any case, why can't our politicians live by their word and respect 'the rule of law' they profess to abide by? Couldn't the Minister leave the court alone to show Ghanians whether it has the power to declare a winner or not?

In 2004, Craig Murray was famously removed as British Ambassador in Uzbekistan after accusing the Uzbek government of human rights abuses. But from 1998 to 2002, Murray served as Deputy High Commissioner in Ghana. Here he tells how, against all odds, he helped leave a legacy of free and fair elections in the African country... It was November 1999 and I'd been Deputy High Commissioner in Ghana for almost a year - the culmination of 15 years' Foreign Office service in Nigeria, Warsaw and the equatorial Africa department in London.
I'd always been passionate about Africa and had immersed myself in its minutiae. Nevertheless, my father, who had a timber yard in Ghana in the Sixties, offered a little extra counsel before I departed, aged 40. 'If you see any good-looking girl, aged about 30, light skinned, whatever you do, don't touch her - she could be your sister!'
Not that this was a big concern for me. My most pressing duty was the 1999 State Visit by the Queen and the Duke of Edinburgh, Enhanced Coverage Linking the Duke of Edinburgh, -Search using: Biographies Plus News, Most Recent 60 Days, accompanied by Robin Cook, the then Foreign Secretary. It was a three-day blur of activity, the teeming crowds displaying an uncomplicated and old-fashioned reverence.
A warning that the Duke was averse to looking at things without useful purpose proved absolutely right. As we stood looking at the strip of brass laid in a churchyard that marked the line of the Greenwich Meridian, he said to me: 'A line in the ground, eh? Very nice.'
Ghana epitomises much of the best of Africa, but also throws into relief the tragedy of the continent. It has maintained its higher education and has fewer extremes of wealth than elsewhere. But at independence in 1957, Ghana was richer than Argentina, Brazil, Malaysia or Singapore. Today, those countries are at least ten times as wealthy.
Corruption, cronyism, economic mismanagement, irresponsible lending by the West and the dumping of cheap food all did for Ghana. When I arrived with my wife Fiona, and children Jamie and Emily, Ghana had been ruled for 20 years by Flight Lieutenant Jerry Rawlings.
The son of a Stirlingshire pharmacist and a local woman, he seized power in a coup in 1979, but claimed to have won presidential elections in 1992 and 1996, despite allegations of vote-rigging.
In his early years, Rawlings unleashed a political terror on Ghana. His campaign against the middle classes resembled Mao's Cultural Revolution. People were persecuted for having savings or two indoor lavatories. Market women were sometimes killed for 'profiteering'.
The Queen's visit delighted Rawlings, who craved international respectability. I, too, was determined to make the most of the trip, by helping ensure Rawlings gave up power by the start of 2001, as the constitution required because he had served two four-year terms.
The Queen's speech to the parliament in the capital, Accra, was to be the focus of the visit and I had contributed to its drafting. It contained the usual guff about a future based upon partnership, but there was a sting in the tail. 'Next, year, Mr President,' the Queen intoned, 'you will step down after two terms in office in accordance with your constitution.' The opposition benches went wild and the Queen stopped, looking in bewilderment at the hullabaloo.
Afterwards, Robin Cook was furious. 'It's a disaster. Who the hell drafted that?'
'Er, I did, Secretary of State,' I said. 'I might have guessed! Who the hell approved it?' 'You did.' Cook's Private Secretary had to dig out the draft he had signed. After the State banquet, I retired to a hotel bar with the Royal Household. The senior staff had withdrawn to allow the butlers, footmen and hairdressers to let off steam.
The party appeared, to a man, to be gay. Not just gay, but outrageously camp. We'd taken the hotel for the Royal party, but allowed the British Airways crew to stay. Now three cabin stewards, two Royal footmen and a Royal hairdresser were grouped around the piano singing hits from Cabaret. I was seated on a sofa and across from me in an armchair was a member of the Household who seemed out of place. The valet looked to be in his 60s, a grizzled NCO with tufts of hair either side of a bald pate, a boxer's nose and tattoos on his arms.
He was smoking roll-ups. I turned to the old warrior and said: 'Don't you find all this a bit strange sometimes?' He lent forward, put his hand on my bare knee below the kilt I wore on ceremonial occasions and said: 'Listen, ducks. I was in the Navy for 30 years.' I think he was joking, but some things are too weird even for me. The lower reaches of the Royal Household are one of them.
One enjoyable aspect of our time in Ghana was the constant stream of visitors. Among them was Peter Hain, the Minister for Africa. Hain, a good footballer, agreed to play in a charity match between children from a community football scheme and the High Commission.
Unfortunately, the ground was hard and the opposition turned out to be super-fit professionals. After a heavy tackle, I went down. Result: a dislocated shoulder. I couldn't move my arm for eight weeks. Other visitors included Clare Short, at the time Secretary of State for International Development.
She was in Ghana to try to persuade it to join a debt relief scheme. At a dinner for her, a Minister had made a speech about how much Ghana had learnt from the British Empire. Short stood up and expostulated: 'The British Empire! Don't tell me about the British Empire. I know about British colonialism. My father was Irish and we know about British colonialism. I'll tell you what the British did to your country. They exploited it, that's what they did. They exploited it.' After a few moments of stunned silence, the dinner continued.
On another occasion we were joined by Bobby Charlton, who came to Ghana seeking support for England's bid to host the 2006 World Cup. He was still an astounding player at 60 and it was good of him to get on the pitch for a local community football programme. Nevertheless, I found Charlton disappointing. He was self-centred and ratty - one of those heroes you wish you hadn't met.
Conversely, Roger Moore, a UNICEF goodwill ambassador, was charming and suave, just as you would expect, with a fund of brilliant stories beginning with lines such as: 'One day, Frank, Dean, Tony and I decided to play a trick on Marilyn ... ' He was also well briefed about children's issues in Ghana and was prepared not just to do PR, but to get his hands dirty helping in refugee camps without a camera in sight.

There once was a good Baptist Minister, who in order to make his family's budget go a little further, rode a bicycle to Church and to Church functions. One day his bike turned up missing. He searched everywhere, but could not find it. Since it was a very small town he lived in, and most of the town was in his parish, he assumed that one of his flock had strayed and stolen his bicycle.
He spoken with his Deacon about his quandry. The Deacon suggested that at the Sermon next Sunday, the Minister talk on the Ten Commandments. When he got to the Commandment "Thou Shalt Not Steal", the Minister should turn on the Fire-and-Brimstone and preach like he had never preached before. The guilty part should then feel such remorse for their wrongdoing, that they would return the bike.
So Sunday came and the Minister gave his sermon. It was a good sermon but when he reached "Thou Shalt Not Steal", there was no Fire-and-Brimstone. The Deacon was puzzled and asked the Minister why he hadn't really socked it to the thief.
"Well" said the Minister, "I was all set to turn on the Fire-and-Brimstone like I had never done before. That part was to be my sermon to end all sermons. But when I got to the "Thou Shalt Not Commit Adultery" part, I remembered where I had left my bicycle!"

I imagine the Court would instruct the EC to declare a new result for the 2012 election based on their findings. Or they could simply say that the declaration was valid.

It is true, the SC CANNOT declare a winner of any election in Ghana. They can ONLY advise the EC to put in place reforms and report back to them.

Deputy Minister, Mortala Mohammed was absolutely correct in his statement. By the Constitution, the Supreme Court has no jurisdiction or authority to declare an election. It can only pronounce the verdict of the court case and therefore make appropriate recommendations for the future. Many so called learned legal and constitutional experts or analyst know this but for some strange reasons fail to tell the public. This is an ABC legal and constitutional fact .The only person that perhaps would benefit from acting as the President of Ghana until appropriate structures and means are made would be the Speaker of the National Assembly, Mr Adjaho. As the saying goes, 'lack of knowledge my people perish'. It is about time we encourage proper education on constitutional and legal matters in Ghana.

(1) The Sovereignty of Ghana resides in the people of Ghana in whose name and for whose welfare the powers of government are to be exercised in the manner and within the limits laid down in this Constitution.
(2) The Constitution shall be the supreme law of Ghana and any other law found to be inconsistent with any provision of this Constitution shall, to the extent of the inconsistency, be void.
(3) A person shall not be elected as President of Ghana unless at the presidential election the number of votes cast in his favour is more than fifty per cent of the total number of valid votes cast at the election.
(4) Where at a presidential election there are more than two candidates and no candidate obtains the number or percentage of votes specified in clause (3) of this article a second election shall be held within twenty-one days after the previous election.
(5) The candidates for a presidential election held under clause (4) of this article shall be the two candidates who obtained the two highest numbers of votes at the previous election.
(6) Where at a presidential election three or more candidates obtain the two highest numbers of votes referred to in clause (5) of this article, then unless there are withdrawals such that only two candidates remain, another election shall held within twenty-one days after the previous election at which the candidates who obtained the two highest numbers of votes shall, subject to any withdrawal, be continued until a President is elected.
(7) A presidential candidate under clause (5) or (6) of this article may, be writing under his hand, withdraw his candidature at any time before the election.
(8) If after a second presidential election held under clause (4) of this article the two candidates obtained an equal number of votes, then, notwithstanding any withdrawal, another election shall be held within twenty-one days after the election at which the two candidates shall be the only candidates and the same process shall, subject to any withdrawal, be continued until a President is elected.
(9) An instrument which -
(a) is executed under the hand of the Chairman of the Electoral Commission and under the seal of the Commission; and
(b) states that the person named in the instrument was declared elected as the President of Ghana at the election of the President, shall be prima facie evidence that the person named was so elected.

(1) The validity of the election of the President may be challenged only by a citizen of Ghana who may present a petition for the purpose to the Supreme Court within twenty-one days after the declaration of the result of the election in respect of which the petition is presented.
(2) A declaration by the Supreme Court that the election of the President is not valid shall be without prejudice to anything done by the President before the declaration.
(3) The Rules of Court Committee shall, by constitutional instrument, make rules of court for the practice and procedure for petitions to the Supreme Court challenging the election of a President.

The Electoral Commission shall, by constitutional instrument, make regulations for the purpose of giving effect to article 63 of this Constitution.

(1) A person elected as President shall, subject to clause (3) of this article, hold office for a term of four years beginning from the date on which he is sworn in as President.
(2) A person shall not be elected to hold office as President of Ghana for more than two terms.
(3) The office of President shall become vacant -
(a) on the expiration of the period specified in clause (1) of this article; or
(b) if the incumbent dies or resigns from office or ceases to hold office under article 69 of this Constitution.
(4) The President may, by writing signed by him, and addressed to the Speaker of Parliament, resign from his office as President.

The President shall, at the beginning of each session of Parliament and before a dissolution of Parliament, deliver to Parliament a message on the state of the nation.
68.
(1) The President shall not, while he continues in office as President -
(a) hold any other office of profit or emolument whether private or public and whether directly or indirectly; or
(b) hold the office of chancellor or head of any university in Ghana.
(2) The President shall not, on leaving office as President, hold any office of profit or emolument, except with the permission of Parliament, in any establishment, either directly or indirectly, other than that of the State.
(3) The President shall receive such salary, allowances and facilities as may be prescribed by Parliament on the recommendations of the committee referred to in article 71 of this Constitution.
(4) On leaving office, the President shall receive a gratuity in addition to pension, equivalent to his salary and other allowances and facilities prescribed by Parliament in accordance with clause (3) of this article.

This indeed is a historical moment in our nation's history with the Supreme Court sitting on a Constitutional matter. The court is being asked to review and set aside a declaration by the EC. In a sense it will adjudicate on whether a public body, in the exercise of it's statutory obligations and duties, has acted incompetently, improperly or so perverse as to injury an interested person or party. This is Judicial Review of the highest order. Specific to the case at hand, is whether the Electoral Commission of Ghana in the recent election acted incompetently, wilfully, colluded with other persons and so fallen extremely short of its statutory obligations to organise a free and fair election. And also a matter of concern is whether the organisation has ever been fit for purpose bearing in mind that the conduct and declarations of past elections have also been discharged by the same public body?
The petition requires votes to be annulled and a declaration made to reverse the EC declaration of December 2012. Central to the claims, are that statutory violations and irregularities occurred. The evidence being the records of the pink sheets. Even though the Petitioners are not alleging electoral fraud nor collusion between the First and Second respondents, nonetheless references have been made to these alleged electoral shenanigans, as for example when it was mentioned and then retracted in court by the Petitioner's Counsel. Indeed the genesis of the petition before the Supreme Court lies in the claim of electoral fraud. The Petitioners in the past alleged electoral fraud.
The statutory violations and irregularities in so far as they imply electoral fraud is predicated on conjecture. As for instance when the Counsel for the Petitioner stated that " someone could have picked a pink sheet, filled it in and thrown it in there". The short comings of the brief and the paucity of hard evidence no doubt compelled the Lead Counsel to conjure an inelegant turn of phrase and not display the finest of advocacy skills.
Dealing with irregularities and violations, the issue is whether at the material date or dates in December 2012 , the Petitioners would have been able to submit such burdensome proof as tendered before the Supreme Court to compel the Electoral Commissioner to declare the elections in the First Petitioner's favour.
No doubt there are lessons to be learnt and things would be done more diligently next time round.
Annulling 3 or 4 million votes, on the other hand is a proposition which requires incontrovertible evidence pointing to illegality, unfairness and irrationality on the part of the EC, and I do not believe that petitioners have made a consistent and compelling case.

It's just logic for the SC to uphold the declaration of results made by Dr Afari Gyan.The SC cannot overturn the will of the people because somebody who lost the élections is not satisfied.The petitioners were given opportunity to file a petition but they messed up the evidence with so many mistakes more than the election itself.Look at the petition cases in Kenya,Nigeria,Uganda and Zambia.The EC with the support of the International community cannot be underestimated.Besides,the pink sheet evidence was a big mistake on technical grounds because the facts on the face of the sheets were not proven or let's say not enough to warrant any radical changes at the moment.Come to think of KPMG audit where the petitioners could not even tell how to present their petition.Thank you.

If this is what the Constitution says, then why would the nine judges waste our time. Anyway, from the grave vine, its being said that, millions of dollars have been given as bribe to throw away the petitioners case. I do not believe these fine judges would go that way. The SC is looking at the petitioners case to nullify votes and so far they have not been able to prove their case beyond reasonable doubt so the court WILL uphold the EC decision of declaring Mahama President. All persons with common sense that have seen the trial knows the petitioners failed woefully to even prove cases of overvoting as Presidential and Parliamentay elections were held the same day and any one could have by intention or error put both ballots given to him or her in the wrong ballot box eg. the presidential one resulting in what will look like an overvote but it is actually NOT since those votes will be rejected unless all the agents there miss it so the NPP cannot prove double verification or voting without verification or whatever nonsense they are arriving at. The EC declared them winners twice and on this ocassion they even won some parliamentary and presidential votes in other polling stations so what are they talking about going on a war with selective justice hoping to be granted favours by their friends in the court through INJUSTICE. They said they wanted JUSTICE and based upon the court proceedings there is already JUSTICE and the SC will have to ENDORSE and HAMMER it into their thick heads or any form of INJUSTICE will be met with brute force.
