The petitioners didn't go to court for the personal OPINIONS of those judges, but rather to consult the CONSTITUTION and apply what the law says on electoral irregularities. The judges who rubbished the infringements admitted by Afari Gyan before them have CORRUPTED the law, because instead of applying the law as stated in Article 49(3)of the 1992 constitution, they used their SUBJECTIVE opinion in declaring the verdict. This is a wrong precedent for our nascent democracy. Do you underatand? Those judges that disregarded our constitution have questions to answer the people of Ghana.

You sound like one of those who don't base their arguments on issues or the law: a typical NDC characteristic huh?

Was it not the judges? “the decision is corrupt because it gave a corrupted interpretation of the [1992] Constitution.." Is the decision a human being that gave a corrupt interpretation of the constitution or the judges made the decision and therefore are the ones that gave a corrupt interpretation of the constitution? Well it stands to reason that, by categorical syllogism, one can safely infer that, the Justices out of the nine, who ruled to dismiss the petition on all counts are corrupt, and also those who upheld some provisions and dismissed others, are also equally corrupt. The two are not mutually exclusive Gabby.
My advice to you is to tone down a bit and let's do this analysis devoid of the emotions, and high handedness.

This is the inquiry Gabby is putting out at the public sphere. We must be honest in the strictest sense of the constitution. Anything otherwise is chaos. Don't you think so?

In the absence of the exhaustive document on the ruling and the various statutes that were relied upon to arrive at this flawed or excellent judgment, depending on which aisle of the political divide you belong to, words such as "corrupt judgment" or words to such effect from Gabby or the statement that seeks to impugn on the integrity and intelligence of his Lordship Justice Anin Yeboah, are all unwarranted and in bad taste.
In any case, the judgment would be premised on the constitution and the relevant statutes and this most definitely would be subject to their opinions and it's relation to the case, and the evidence so adduced, and other extraneous factors, outside the remit of the court. Is that right for our democracy? That's a cause and effect, which would be answered down the line, as we progress as a country on this well trodden path of democracy.

These are what our so called supreme court judges are telling us to do? I wonder whether they themselves will use the law to obtain justice in their daily tasks. By the way, why did they correct the 6/3 to 5/4, If errors are not meant to be corrected. I feel pity for Ghana. We still do not have strong institutions, judges look at the truth and denies it. Please you have time, read psalm 94, it tells what God will do to corrupt judges. I pray for the few judges who boldly were truthful to the law and i know God will reward them.

Why do I say this? Can you imagine two boxers in a ring, same ring, and one losing the fight and blaming it on the slippery nature of the boxing ring? Assuming that it was true that the ring was slippery, were both boxers not in the same ring so that both boxers were equally impacted? Why would NPP claim victory for the same condition that impacted them during the election? Another analogy, why would a failed candidate in an examination claim pass candidates were favored by difficult questions set by the examiner? This failure can only be attributed to inadequate preparation by the failed candidate. NPPs message did not convince electorates – free education… everything was hooked unto free education. All die be die deducted marks, kill all Ewes, Gas by leading members, at all cost… and twisting of facts on discussion programmes, the candidates, yen akanfo> etc. They should stop accusing the SC judges of bias when they have not been able to produce a single evidence to prove even a single vote cast by filling complaint form. This case is a frivolous case indeed, it should have been thrown out long ago. When you listen to them you marvel, they are twisting the judgment to mean that SC has given the green light for over voting, voting without BMV, presiding officers need not sign the documents. Only seared minds could be making such deductions.

Gabby is a lawyer and knows very well that courts do not always uphold verdict in favour of the plaintiff. In any case, there is plaintiff’s version, the respondent’s version and the truth. The court rules based on evidence presented to them. And the fact that court does not rule in plaintiff’s favour doesn't make the court corrupt. Article 49 of the constitution demands signatures of presiding officer and parties representatives, however it didn't indicate the absence of the signature of the presiding officer invalidate the votes count. That's how the judges looked at. If you didn't trust the court and you could be your own judge, why petition the court? Do you think any sensible court will annul close to 4 million votes to enable Nana Addo win? What were your meaning of LET MY VOTE COUNT? What do you take these people for? Why didn't you petition the court to annul all votes cast in Ashanti Region but other regions? Gabby knows very well that it is illogical for NPP to win only 2 regions and win majority. These comments against SC are very disgraceful, balderdash, illogical and without legal reasoning and therefore must be condemn.

If anybody does otherwise, it's infringement on the law and MUST be PUNISHED, like any other infringments, so future potential offenders will be DETRRED. but where is the PUNISHMENT to serve that purpose in this case? Afari Gyan's famous "NO VERIFICATION, NO VOTE" was extraporated from that part of our statutes.

We'll be in trouble soon if we conduct ourselves in a manner that's contrary to what the CONSTITUTION stipulates under the pretence of so called "interpretation" of the law.

Yes "LET MY VOTE COUNT" was the banner, but it has an assumption or implication of a CLAUSE, that it followed the LAID DOWN RULES, otherwise it's "NOT WORTH THE COUNT".

Your statement, "Do you think any sensible court will annul close to 4 million votes to enable Nana Addo to win", is uncallled for unless you think the election is about Nana Addo: That statement will be deemed to be subjective, because NOBODY asked the judges to apply their "opinion" or "sense", but the LAW. The reason why we have chaos in our body politic is our inability to apply the law, as is, and still find flimsy excuses to justify them.

Finally, Ghana's election is based on POPULAR VOTES as against REGIONAL VOTES, so two most populous regions could place enough votes behind a particular party to win election.

Stop accusing Gabby of making unreasonable claims, because the opposite is tha case. Gabby is questioning the rationale behind the judges rubbishing of Article 49 of our constitution.

If the law did not specifically say the word "ANNUL", you must likewise understand that it neither said "IGNORE". Between that, the sensible thing the judges should have done in order to be "INDEPENDENT of any blame was to, at least, re-run the election at polling stations where Afari Gyan admitted irregularities occured. If they did that, whatever outcome of the re-run would have been the voice of the electorate, and the role judges played would be deemed to be "refrees". The judges SHOULD have themselves to blame for acting contrally to Artcle 49 of our CONSTITUTION.

He stated in his opinions that he didn't much care if he was called in for contempt, and cited his uncle Dr JB Dankwah "who suffered for sticking to his convictions". Clearly he knows he was having a dig at the justices and created the impression he would speak his mind, damn the consequences.

So why is he spending time trying to "clarify" what he said? Surely if his great Uncle - Dr Dankwa had convictions, what is clear is that Otchere-Darko lacks them and is as irrelevant as he is inconsistent.

What a foolish observation. The petitioner alleged statutory violations and irregularities that are not defined to that extent by the Constitution. Unsigned pink sheets by Presiding Officers, duplicate serial numbers on pink sheets among other matters did not reveal electoral fraud or wilful misconduct on the part of election Officers.
More so, to seek the nullification of 4 million votes in a case presented with so many amendments, corrections and in an incoherent, inconsistent and incoherent manner by Counsel was a legal slight of hand. Considering that the petitioner did not have access to the Asokwa pink sheet.
They came to equity with dirty hands.

From the comments I see in various Ghanaian forums, I conclude that Ghanaians have an impulse to suppress opinions with which they do not agree. I do not know what Gabby meant by this statement, nor do I know what reasoning stood behind the decision of the Supreme Court justices. I will accept both at face value however. The problem is not the decision or the comment by Gabby. The problem is that Ghanaian society is hopelessly corrupt. I believe that every one in the electoral process was corrupted. A bribe here, a bribe there and one gets elected or re-elected to office. This is Ghana we are discussing, where one has to bribe the nurses in the hospital if you are unfortunate enough to find yourself sick. You also have to bribe the mortuary people if you are unfortunate enough to find yourself dead! In between those two events, you have to bribe everyone you meet. I have this gut feeling that people at all levels of the election process were hopelessly compromised even before the election took place. People in the NDC found that during their time in opposition that they were destitute. They were determined not to ever be in that position again. Add new found oil money and you find the Woyome phenomena. In the final analysis, an election means something when the people who count the ballots are honest and incorruptible, and in Ghana that is a very commodity indeed.

Gabby previously announced that he was going to retire from politics. I think that will serve him better and he might have to consider correcting the NPP intolerance or quit.

The recent judgement by some so-called shit and crackpot supreme court judges on the Akuffo Addo & co matters has really justified the assertions of the Chief Justice.

Atugubah and some others have been mentioned in a 2 million dollars plus one 4x4 bribery incident in this matter as an incentive for their willingness to pervert the course of Justice.

I am appealing to the so-called judges concerned to come out and publicly swear an oath to deny these allegations and the facts would then be brought to light.

You clearly indicated your willingness to accept money for the judgement when you uttered some words in the Sir John contempt trial. That is when you sent the signal out that you were ready for the money.
