On the face of it, Tsatsu Tsikata comes out as an aggrieved person who has an axe to grind because his previous interaction with the judge Anin-Yeboah did not go in his favour. That red-lipped self-absorbed man thinks the whole world revolves around him. Tsikata is some egoistic arrogant man who is still nursing emotional wounds over his imprisonment for causing financial loss to the state. He should know what the families of the judges who were killed by his uncle Kojo Tsikata are feeling.

Looking at his reactions, I have no doubt Tsatsu Tsikata had an invisible hand in the killing of the judges and the setting up of the infamous public tribunals by the P-NDC to bypass the traditional court system. His oversize ego has led him to think if a judge does not tow his line, that judge must be his enemy. You are not the centre of the universe Tsatsu Tsikata. Muff there. Your apology is not needed, go play with your grey balls Mr. Wife Snatcher. You are full of it, arrogant brat.

For someone who accuses another of harboring a grievance, you sound pretty much like you have untold grievances yourself. I am not sure what possible evidence you have to allege that amongst other things, Tsikata had a hand in the heinous murder of judges in the Rawlings era, but that assertion is easily as wild as anything Tsikata has said.

Personally, it is a source of great disappointment that Rawlings struts around the country as if he owns the place, after all that he subjected the country too in the 80's and 90's. It pains me also that people like Tsikata and others gave him the intellectual cover to undertake what he did. But we must move on as a people, stop harking back, and definitely stop engaging in pointless name calling. There's a whole world waiting out there for us as a people and we need our full engagement to make the most of it.

It is amazing to hear this from Tsatsu who is regarded as one of the best lawyers in the country, but of course that is what happens when you let your thoughts get tainted with politics. Why THEY are incurably ethnocentric and always see politics in Ghana in ethnic terms instead of coalition [blood-sucking, aka rent seeking] interests and people across ethnic lines.

Why they always target "Ewes" as their political enemies since the post-Feb. i966 dastardlly coup.

In effect, why, even in spite of the higher academic qualifications of the leaders of "these Akans", they are intellectually bankrupt and exhibit a high level of ignorance about the human geography of Ghana. For instance, most think only Ewes live in the VR, and are often surprised to learn even Akans form a major ethnic group in the VR and Twi is the second most widely language spoken there. Cocoa? They think only Akans grow it in Ghana!

Tsatsu is opening himself up for public criticism not to him alone but also to the entire Ewe tribe. We all know that, there is an Ewe agenda (Ewe Hegemony) being spearheaded by Prof Kofi Awoonor; their hatchet man. It had worked perfectly well for them. Today, this small group of people had maneuvered their way through to the top in Ghana. Talk about politics, military, police, economy, governance, media, etc by their "nyebro" spirit that binds them as one. This is not a secret, but Ghanaians, as peace loving as they are, have kept quiet and allowed these "juju" infested people to thrive on till today. They should not, in the least provoke anyone. If done, they would be shocked of their lives. Or, is it because they are pulling the northerners alone with them, they think, they are invincible. Please, leave Akans alone. If you have rode on their shoulders to get to where you are, keep quiet and enjoy your blood money (emanating from many lives you have destroyed in various organizations through the application of black power). Just Because other people are aggrieved and licking their wounds, we must not rebuke corrupt and fake Judges.

Tsatsu stated clearly that even before the NDC ENJOINED, Anim Yeboah took a persistent and consistent opposing stance and it did't surprise him when in three of the other petitions, he was found to upheld the case of the NPP.

Tsatsu then went on to refer to another ruling where this same Anim yeboah was found to have used the immunity state of IMF, an entirely different organisation to that of IFC to mean same in his decision, Is this man not insane? where is the logic in this if A+B=A+B NOT A+A? because A=B.

In this current ruling, you cannot accuse all the Judges the same as Tsatsu has accused Anim Yeboah. Anim Yeboah therefore has sold his conscience.

Even in America we hear these kinds of analysis as to why some Judges vote in certain directions and sometimes people start speculating how some Supreme court justices will vote because of their political affiliations or based on who appointed them or whether they are liberals or conservatives which we all know what all these things mean.

Tsatsu is arrogant senseless individual from day one. winning a court case does not necessarily makes one smart, this petition every mad person knew the court was not going overturn the result so Tsatsu did not do anything to win the case. We all saw his interrogation it was the worst in the whole process. It is what comes out of your mouth that describe how smart you are and unfortunately, he has proven to a fool and asshole for such foolish comments. Other judges like Atugba also opposed the petitioners how many times? But am not surprised the whole judgement stinks only that it does not matter we can move on. All the ewe related voted against petitioners why? Check the vote pattern again but is OK, Ghana is still there in one piece not in pieces but Tsatsu must be careful.

If he want to say the truth then what he said was even wrong as everybody saw and heard it with our eyes and ears that the so called chairman or refree was actually wearing NDC jersey. If Tsatu cant voice this one out but rather attacking the other Judge then it is unfortunate. Atuguba started from the onset to show that he was an NDC judge and even during the Judgement day he was guilty for his own deeds to extend that he found it even difficult to pronounce judgement. Tsatu where were you?. You should apologise and stop making as the whole Ghana is in your hands.

Two, in another High court case which most of you put a blind eye, Tsastu criticized this same Anim Yeboah of having used an illogical reasoning of the immunity state of one organisation to another entrily different to make judgment.

Is this what you find difficult to fathom? Grow Up and stop following stooges.

It listed the elected President and the Electoral Commission as the Respondents. It was unlawful to allow the NDC to join the petition hearing.

Excerpts from Atuguba's reasoning- culled from a friend's FB page
"The right to vote is fundamental to our democratic advancement and must be protected unless there is some compelling reason not to. Hence, in Article 42 of the Constitution, the framers entrenched the fundamental right to vote. It has been contended by counsel for the petitioners that the second respondent is mandated under the Constitution to oversee the conduct of public elections in this country. Counsel further contends that Article 49(3) makes it mandatory for the presiding officer to sign the declaration forms in the prescribed manner. Counsel for the first respondent has invited this Court to note that authentication is required to be done not only be the presiding officer but by the polling agents who are present at the polling station on election day.

I find that the petitioners do not dispute that their polling agents signed the declaration forms in the prescribed manner. I also find that the effect of the signatures of the petitioners’ polling agents is to confirm the information contained therein. There is no evidence before this court that the petitioners’ polling agents disputed or raised any protests regarding the information contained on the declaration forms at any of the polling stations complained of. Thus, the petitioners’ polling agents by signing the declaration forms in the prescribed manner represented to the world at large that the results recorded and declared by the presiding officer were a true reflection of the outcome of the elections at the polling stations complained of.

At this stage, it is vital to discuss the constitutionally entrenched right to vote discussed extensively in the cases of TEHN-ADDY and AHOMAH-OCANSEY (supra) as against the duties of the presiding officer to sign a declaration form that has been witnessed by all parties. Should this Court annul votes merely because of a presiding officer on polling day omitted to sign the declaration form in the prescribed manner? Especially, since the polling agents of all the parties involved were present and signed the declaration forms in the prescribed manner? I do not think so.

We have been urged by the respondents to apply the case of OPITZ V. WRZESNEWSKYJ SCC 55 [2012] 3 SCR. I am aware that this authority is persuasive but I find the principles set out by the Canadian Supreme Court to be relevant to the petition before us. Paragraphs 46, 56 and 66 of the OPITZ case are worthy of mention and proceed to do so:

“(46) The practical realities of election administration are such that imperfections in the conduct of election are inevitable. As recognized in Camsell v. Rabesca [1987] N.W.T.R. 186 (S.C.), it is clear that ‘in every election, a fortiori those in urban ridings, with large number of polls, irregularities will virtually always occur in one form or another’ (p. 198). A federal election is only possible with the work of tens of thousands of Canadians who are hired across the country for a period of a dew days or, in many cases, a single 14-hour day. These workers perform many detailed tasks under difficult conditions. They are required to apply multiple rules in a setting that is unfamiliar. Because elections are not everyday occurrences, it is difficult to see how workers could get practical, on-the-job experience.

(56) In our view, adopting a strict procedural approach creates a risk that an application under Part 20 could be granted even where the result of the election reflects the will of the electors who in fact had the right to vote. This approach places a premium on form over substance, and relegates to the back burner the Charter right to vote and the enfranchising objective of the Act. It also runs the risk of enlarging the margin of litigation, and is contrary to the principle that elections should not be lightly overturned, especially where neither candidates nor voters have engaged in any wrongdoing. Part 20 of the Act should not be taken by losing candidates as an invitation to examine the election records in search of technical administrative errors, in the hopes of getting a second chance.

(66) By contract, if a vote cast by an entitled voter were to be rejected in a contested election application because of an irregularity, the voter would be irreparably disenfranchised. This is especially undesirable when the irregularity is outside of the voter’s control, and is caused solely by the error of an election official.” [Emphases added.]

I find the above paragraphs very pertinent to the petition before us. The petitioners have not proved that the absence of the presiding officers’ signature was willful. Accordingly, I would dismiss the petitioners’ claim that the absence of the presiding officers’ signature on the declaration form is an irregularity, violation or malpractice and that same affected the outcome of the 2012 presidential elections." - His Lordship Justice William Atuguba of the Supreme Court of Ghana

A Pre-Verdict Opinion by somebody

No Signature by the Presiding Officer

According to Article 49 (3) of the Constitution and Regulation 36 (2) of C. I.75, the EC-appointed presiding officer shall sign the statement of declaration of the polling results (i.e., the pink sheets). It is the petitioners’ case that 995 pink sheets were not signed and should not therefore had gone into the collation of the results.

The EC does not deny this in its address. Rather, the EC argues that the petitioners’ polling agents signed 99% of these pink sheets. According to Afari Gyan, he considers the polling agents’ signature acceptable for the purposes of the declaration of the Presidential results.

Put more vividly but accurately, Afari Gyan has suo moto amended Article 49 (3) of the Constitution. The mischief that this Article was intended to cure is so grave that it happens to be one of the few entrenched provisions of the Constitution. It is not up to the EC, Afari-Gyan or anyone to decide which of the provisions of the Constitution they are going to enforce or not enforce.

It is abundantly clear that the presiding officers’ signature is necessary to validate a pink sheet. It is for good and obvious reasons that the Constitution requires a signature of a non-partisan EC-appointed official. Accepting pink sheets signed by only partisan agents is an invitation to fraud and chaos in our elections.
Absent the signature of the presiding officer, the pink sheets MUST NOT enter the collation of the Presidential results. It is a willful violation of an entrenched provision of the Constitution for the EC to have included these inchoate and invalid pink sheets in its collation. Regrettably, several months after the violation, the EC does not seem to realize the harm that this reckless conduct has caused.

Incidentally, the EC does not offer any explanation for why 995 presiding officers failed to sign the pink sheets. In fact, the EC offers no evidence of any internal investigation to understand and remedy the problem. Ironically, one of the reasons cited for the EC to disqualify the NDP Presidential candidate from contesting the 2012 elections was the absence of signatures for those who endorsed her.

Either our constitutional provisions matter or they do not matter. But we cannot have it both ways.

Opitz v. Wrzesnewskyj SCC 55, ([2012] 3 S.C.R).

Finally, in its conclusion, the EC refers the Court to the Canadian case of Opitz v. Wrzesnewskyj SCC 55, ([2012] 3 S.C.R). While the EC correctly points out that the case has a persuasive effect on the Court, it was less than diligent in properly situating the case for the Court and provided out of context quotes from paragraphs 46, 56 and 66 that could mislead the Court. In reality, the Opitz case was about disputed elections in an electoral district, not a presidential election, and the issue was whether votes should be annulled because of votes cast by individuals who were not entitled to vote under the Canada elections Act.

The case has nothing to say about constitutional violations in the form of overvoting, absence of presiding officers’ signatures. Nor does it shed any light on voting without biometric violation or duplicate pink sheets.

The quote in paragraph 46 is misleading in that it gives the impression that imperfections in the conduct of elections are inevitable as a result of inexperienced workers performing under unfamiliar condition. This gives the impression that anything goes. However, a fuller version of the quote is in paragraph 2, which ends as follows: “Only irregularities that affect the result of the election and thereby undermine the integrity of the electoral process are grounds for overturning
an election.” Clearly, the irregularities, malpractices, omissions and statutory violations at issue in WRIT No. J1/6/2013 undermine the integrity of the electoral process.
In quoting paragraph 56 of the Opitz case, which talks about the risk in adopting the strict procedural approach, the EC should have been more forthcoming in revealing to the Court that the position taken by the Opitz Court obliterates the distinction between qualification and entitlement to vote. As the Chief Justice of the Opitz Court stated in his dissent (this case was a 4-3 decision), “my colleagues take the position that everyone who is qualified to vote and ordinarily resident in the electoral district is entitled to vote. Thus, a voter who is not on the electoral list and has not filed a registration certificate can be later held to have been “entitled” to vote if he was qualified to vote and ordinarily resident in the electoral district. I cannot accept this view.”

Although the issue is not before our Court, I believe most Ghanaians will be wary of any system that entitles a qualified voter to vote on voting day without having gone through prior registration.

Similarly, the reference to paragraph 66 is misleading without context. Paragraph 67 provides an example, which could have put paragraph 66 in context and highlight the real issue before the Opitz Court:

“For example, compare the situation of two voters who arrive at the polling station with inadequate identification. The deputy returning officer (DRO) personally knows one of the voters, and vouches for him, enabling him to cast a ballot. The DRO does not live in the polling division, so he has vouched in a manner not permitted by the Act. However, the voter leaves the polling station believing that he has cast a valid vote. If a court later rejects the voter’s vote, he is irreparably disenfranchised, through no fault of his own. In the case of the second voter, the DRO properly refuses to let her vote without proper identification. This voter can return to the polling station later in the day, accompanied by a voucher who lives in the polling division, and cast her ballot. She has not been disenfranchised.”
Again inadequate identification is not the IMOV that our Court is dealing with. Thus, Opitz is of little relevance and use to the Court.
To sum up, we invest a lot of resources in the EC to manage our electoral process, to declare the results and, where necessary to provide unbiased and relevant information for our Court to determine whether declared results are valid. It is my assessment and opinion that the EC has woefully failed to carry out this burden. If the EC cannot defend its processes and outcomes, it is hard for me to see how anyone can!

If Justice Anin was bias because he was appointed by Kuffour, what about the other five Justices who were also appointed by Kuffour? What about Atuguba who voted in favour of Tsikata and his party in all the cases levelled out by the petitioners?
Let us move on as a country and bearing in mind the lessons we have drawn from the SC on the election dispute.

Instead of analysing his statement and examining the FACTS he displayed we rather ignored the facts of the matter and climb on personal insults. He Mr Tsikata had made the comment loosely without any fact to support his statement then I can understand and join the many voices asking him to apologiseAt anyrate, has Mr Justice Anim Yeboah denied what Mr Tsikata had said? I think he need to clear the air. Obviously I don't expect him to say that he was partial to any party but for the benefit of the nation and the our justice system he must explain how he interpreted the IMF clause to Mr Tsikata's case. As for Mr Kufuor I think he has just exhibited 'a knee jerk' reaction to the situation. His reaction was premature.

My brother, I am not holding brief for Tsatsu as to whether he is right or wrong but let the truth be told: From all indications, Tsatsu is bitter and worst off because it appears he wanted Nana Addo to challenge the verdict and to his dismay, the opposite prevailed. His timing is also very questionable. And so what I am driving at is that, this very matter can equally be handled in the right atmosphere and time and not now. Maturity and tact are the virtues eluding him currently. As an experienced lawyer, I think he should be able to assess and decipher for appropriateness and relevance. NOW, TSATSU HAS LOST THE PLOT COMPLETELY. GHANA FIRST, GUYS and not any egocentric, whymsical individualistic and selfish interests. GOD bless our homeland GHANA.

His consistency is very much appreciated in the face of the huge pressure from the political establishment to bend him to do their bidding.
Tsatsu Tsikata's stance is all well and good, since that is his opinion, in dealing with this particular election petition.
His incarceration from his case of causing financial loss to the state was also good, and as an ex-convict, his politically motivated effusions, to seek to suggest that by some twist of fate he was wrongfully put in the cooler, which surfaced in the interview he granted Akwasi"nkwan di wa"Pratt is neither here nor there. He did wrong and was convicted and nothing can change that. As an ex-convict, I would not attach much importance to his loose analysis and talk. He can effectively go to hell.

I listened to a Dr Maurice Ampaw on one the TV stations yesterday on this issue and my goodness, I asked what did the station see in him as a legal person to consult him for comment. He was a complete and abysmal failure full of bias highly unexpected of a lawyer who is consulted for opinion on a national issues. Why tv stations consults him, I do not know as his bias is not hidden. Kofi Abotsi of GIMPA is the man to consult on legal issues. And that Sampson Ayinene of Joy, he thought he knew the law and ethics of the profession more than Tsatsu as he came out with a brutal force to condemn Tsatsu. How old has been his practice in law? Did the two lawyers know better than Tsatsu?

Responding to a questioning about whether a Judge’s political affiliation should matter when taking decisions on issues before the court, Mr. Tsikata said: “It should not but I’m giving you a frank example in a situation where it seems to me like somebody like that [Justice Anim-Yeboah] really did not take up what I will call a truly balanced judicial posture in relation to the matters that were before him and I say that very frankly, but I believe that that is an observation that one can make and we do recognise as Lawyers and as Law teachers particularly, we do recognise the ways in which sometimes decisions are affected by some of these personal prejudices and positions”.

Adducing further anecdotal evidence to support his allegations against Justice Anim Yeboah, Mr. Tsikata recalled that: “I gave you an example in relation to my own case. Again Justice Anim-Yeboah, he sat in the court of appeal. He gave a decision. Its in the reports - you can go an read it – in which, you know, against the position that I had taken that the IFC International Finance Corporation – is not immune from the jurisdiction of the Courts of Ghana. He gave a decision asserting an immunity and in asserting it, all he relied on was the statement of the immunity of the International Monetary Fund, a different organisation".

"I mean its in black and white. He read, you know, an article from a statute which is about the International Monetary Fund and he read it to apply to International Finance Corporation. I mean you don’t do that but he did, in my case, and again in that case, there was no doubt in my mind about his political convictions being the driver of the decision”, Mr. Tsikata noted.

According to him, “…I think we need to uncover them in order to correct them also, because Judges should not, indeed, let political partisanship be the determinant of positions they take”.

The question we should ask is: Has it ever occurred in the history of jurisprudence that a judge has ever been biased?
If the answer is "NO" then definitely Tsatsu in spite of all his reputation, has erred because in that case, I don't expect the first case of a biased judge to occur in Ghana. The wise King Solomon said there is nothing that happens under the sun which is new - it must have happened before. That is why we have biased referees in say football.
But if the answer is "YES", (and I expect it to be "YES" because judges are but human and to err is human) then it serves our interests best to examine Tsatsu's claim to determine its veritableness. In football, there have been several times when referees displayed clear biases against ‘away’ teams. Judges are just like referees because all them have absolute power and authority to determine the fate of the parties in front of them and the temptation to favour one against the other is real. When it comes to politics the temptation is even bigger because judges will naturally have their political parties. But the good thing about being biased is that, anybody who watches closely can see it because biased officiating leaves a pattern behind.
So what pattern did Justice Anim Yeboah leave? According to Tsatsu, Justice Anim Yeboah was persistent and consistent in opposing the stance of the respondents from the outset to the end of the petition hearing. A judge is supposed to hear all the sides before coming out with a ruling. So if there is a judge who sees everything of yours wrong all the time (that is to say all respondents’ objections overruled and those of petitioners upheld) then that is proof of bias.
By the power the law places in their hands, it is necessary to demand accountability from them if not we are all dead.

My opinion, is that the two judges who did not dismiss the claim were STRONGLY PRESSURED right up to the last minute, hence the almost 4hours delay before the SC judges appeared in the courtroom. Fear, threats and intimidation may have been meted out to them after refusing to offers of huge amounts of money. This explains why tsatsu tsikata is peeved because certain judges put up resistance. It seems we no longer enjoy Justice and soon we may not even enjoy freedom and freedom of speech

I beleive if this unfortunate statement had been made by Lawyer Addison, Justice William Atuguba will hit the ceiling in fury and God knows what will happen.
I was not suprise by the voting pattern of justices Atuguba, Gbedegbe and Ansah Bonnie.I told my friends,about my concerns for these three judges especially the president of the nine - his heavy handedness on the petitioners lawyer and the way he pampered someone like Tony Lithur.For example Lithur intentionally and ungentlemanly dropped those documents in the course of proceedings,Tsikata's late of his submission to the court.
Did justice Atuguba, refered to the misconduct of Sir John's misconduct as bigotry? This case is over and Ghanaians can tell who the real bigots are, especially among the nine Supreme Court Judges.History will be the better judge.These judges have set the tone and Ghanaians should be guided by this precedent.
I don't think it matters who wins,we were looking up to them to give us a yard-stick to work with to clean up the mess at the Electoral Commission, and this is where they failed us as Ghanaians.We don't expect them to be perfect in pronouncing judgement,however, their voting pattern is what stinks and they must face it.
Look at who is talking nonesense - Tsatsu Tsikata, who thought he owned GNPC and can therefore misuse it's resources by planting that economy entity,though state owned into a financial loss.He had his day in a court of justice, unlike the Kangaroo court established under the PNDC,the government that he served;that put innocent people in jail, some killed.This is the man who claims he knows God and quotes the bible at the least chance he gets to support his arrogance.
My fellow Ghanaians,in the professional discipline of Auditing,an auditor in his/her, assignment to express an opinion on an entity does not give absolute assurance.Auditors, give reasonable assurance as to the fair presentation of financial statements-thus financial statement attested to are free from material mistatement.Likewise, Ghanaians did not expect our electoral system to be foolproof.However, we expect the EC to take its responsibility seriously to put in place controls that will bring acceptability to the conduct of any election under its supervision.This is where the EC failed our country, it could have been worse but for the love of country by Ghanaians we have restrained ourselves for peace and nation building.
To the NDC the outcome of this case does not give your members in positions of trust to continue to rape our country,ie Woyome, GYEEDA etc.I hope the love of our country will come first in all your under policies for governance.Hopefully President Mahama would come grips with his position, to make appointment in any capacity by appointing people with integrity and professional capacity to help salvage the little that is left in the Nation's Treasury.

I am dedicating this piece to Mr. Baah Boakye, a former employee of the Foreign Service of the Republic of Ghana, for the emotional trauma he might have suffered when he was transferred under a certificate of emergency by those who made themselves lords of the manor, in those heady days of the Culture of Silence.

When he was asked to leave this country and operate from the Embassy of the Republic of Ghana in Bonn, then capital city of the Federal Republic of Germany, his matrimonial home was torn apart. As a matter fact, his lawful wife failed to turn up in the country he had been posted to.

If you talk to Baah Boakye, you are likely to get the impression that he is still nursing the feeling that he was done in by people using their closeness to the power base of the Provisional National Defence Council to virtually seize his wife from him

Mr. Baah Boakye now lives in London. The information I am gathering is that he is still suffering from the effects of losing his wife under very frightening circumstances. And that is making it very difficult for him to relocate back home, especially when the beneficiary of that transfer still walks in the corridors of power.

That is one reason I am irked anytime I hear Mr. Tsatsu Tsikata, one of the power brokers of the dreaded Provisional National Defence Council, which put fear in the citizenry, and ultimately, smuggled in the National Democracy Congress as a political concept, making reverences to morality and conscience in public discourse.

At the weekend, my good friend Kwesi Pratt hosted Mr. Tsikata on TV3, now owned, I am told, by power brokers behind the ruling party. Let me stress here that both interviewee and interviewer have never been strong advocates of the principles on which the NPP stands politically.

In an answer to a question deliberately couched to enable Mr. Tsikata visit his vituperations on one of the judges, the former law lecturer at the University of Ghana said Mr. Justice Anim Yeboah consistently took an opposing stance against NDC’s arguments and positions as far as the Electoral Petition was concerned.

Mr. Tsikata told bewildering audience of the television network that he was not surprised by what he termed Mr. Justice Anim Yeboah’s persistent and consistent opposition to the stance of the NDC, because he (Justice Anim Yeboah) was appointed to the Supreme Court by former President John Agyekum Kufuor of the NPP.

Trust the New Patriotic Party to react. Mr. Kwadwo Owusu-Afriye, General Secretary of the party, issued a statement in Accra, in which he questioned the logic in Mr. Tsikata’s flawed statement. “If going by Tsatsu’s logic, Anim Yeboah was appointed by Kufuor, and as such, owes his loyalty to the NPP, then what do we say about the four judges who decided that no irregularity occurred in the 2012 elections to warrant a nullification of the tainted votes?” Sir John queried.

Note that you're neither Johnnie chocran(r.i.p.)nor Allan Dershowitz. You are a criminally convicted lawyer who should have been barred from practice but Ghana being Ghana an ex-convict is allowed to practice law.
