Tsatsu could have waited much longer to make those comments even if he thought his professorial acumen rightly detected some flaw with the decision Justice Anim made.

Such a skewed analytical observation as Tsatsu made could only fit in a classroom Law tutoring and in his Memoire.

Following so closely at the heels of the verdict of the Petition makes Tsatsu's comment most likely contemptuous and unwise for securing Peace.

Gabby, on the other hand was simply blowing his usual Partisan horn. He is enraged by the specter of his Uncle, Nana, not ever going to become the President of Ghana, and blaming everyone else for that but his own poor counseling of Nana to be more inclusive in his campaigns.

Mr. Tsikata personally attacked Justice Anim-Yeboah for voting according to the dictates of his conscience on the NPP's Election petition. Gabby on the other hand, spoke out his mind against what he thinks was a failure on the part of the Highest Court of the land, given the volume of evidence, cross-examinations, and the report of the Audit Company, I understand, the president of the SC himself called in to set the records straight. I think the SC like the other two arms of government can be criticized if one believes it did not live up to expectation in a democracy. Therefore, if Gabby’s were to be placed on the same scale as Mr. Tsikata, regarding their utterances and GBA’s requested disciplinary action, in my opinion, would appear like comparing apples and oranges.

We ought to put things in perspective and admit that the denunciation of Justice Atuguba by Sir John that rewarded the latter with a conviction on criminal contempt was an accentuated version of what Tsatsu said about Justice Anim Yeboah.

On the surface, one could readily identify Tsatsu's deserving of similar charge as was brought against Sir John. However, legal minds prod deeper to find a loophole for Tsatsu's escape from that charge by virtue of him being part of a legal team that contested the case. As an attorney on the other side, Tsatsu is believed to have the right to question the thought process of any Justice whose decision hampered winning the case for his side,

First, it should be bear in mind that Mr. Tsekata did not mount a press conference to make the alleged unwarranted attack on the judge. He was granting an interview in relation to his observation about the outcome of the petition.

SUBSTANTIVE ISSUES
He was asked if he was surprise about voting patterns of the dissented judges. His response was NO. Here, he only cited Anim Yeboah's name as to why his answer was no. He argued that right from the onset the said judge was not even in favor of NDC joining the petition as interested Party. THIS IS FACTUAL

He further argued that throughout the proceedings, he was not satisfied with NDC's position and voted against them in many instances. THIS IS FACTUAL.

Tsekata further reminded the host and the audience that for whatever the reasons of said judge in doing that, judges are also humans like anyone else with ideological, political etc. coloration in the decision that they make. THIS IS FACTUAL

He further explained that in Anim Yeboah's case, he was appointed by President Kuffour (THIS IS FACTUAL) and he PROBABLY be loyal to Kuffour's cause. THIS IS AN OPINION based on the facts above with a preceedent below and there is nothing wrong with this in any academic discussion. It is what scholars call Critical Reflection.

Preceedent
He further cited a scenario as to why Anim Yeboah could still be loyal to Kuffour and bidding his party's cause-- a case where the judge err in juxtaposing IMF and IFC regulations. A stark fact which all critics are silent about. Looking at the foregoing, the difficulty of his critics are non existent. It' has therefore arose out of sheer hatred born out of jealousy.

However, I am with the same opinion that the timing and the platform was wrong. This should have been laid bear on a serious intellectual or a professional platform where the judges himself will be a participant to respond.

The nifty hush-hush retributive shadow-boxing of both sides since Kufuor's Administration is a very big part of what is playing out right now.

Tsatsu could see himself as a NPP target for impaling J.J. By proxy. He and his sympathizers believe Kufuor purposefully wished for and directed his conviction as a way to send a message to J.J.

The late addition to the SC by Kufuor after Tsatsu's earlier victory in his trial so as to ultimately ensure Tsatsu's conviction lends some credibility to the Attorney's belief.

So, we could safely suspect a deep-seated grudge in Tsatsu's heart for which he might seek vengeance by taking up the Petition case.

This is why many cannot necessarily let any part of the Petition case stand on its own even though we all know the case was decided on the evidence presented.
