No matter the lies and deceit some facts are evident and the people have woken up to the reality .One mans reality is another's madness. Hegemony you can only fight with hegemony , tribalism with tribalism , chauvinism with chauvinism and if you dont fight or adopt the attitude of turning the other cheek you run the risk of your children being enslaved or ending up like second class citizens in their own country like indians in latin america today . We Akans realise these ugly truths and the agenda of the ayigbe toxic program and their pepeni / islamic agenda of enslave the Akan ,deny all rights of self governance etc etc . we have no choice but to fight back and even if it means sacrificing a generation in war we are ready . in fact the whole world knows its now only a matter of months when the shooting actually begins as the injustice today is unbearable . they steal our money in broad day light going for loans and taking bribes from all sources but let their partners in crime know we will not pay these loans especially since there was no benefit in any of these things for the Akans and were approved by a minority govt that has no respect for the majority . this govt has lost all credibility , claiming a throne does not make you a king , we do not recognize this govt and its nothing but a pest . Imagine the nations of the west such as the Americans etc better understand us than our so called neighbors pepeni and ayigbe , just analyze the the insults as its an expression of whats deep down in their black hearts of ignorance,we definately have no business staying in the same country talk less same destiny, long live the republic of Akan

For me anyone who thinks that because the constitution says 'XYZ' therefore it means'xyz' and must be understood to be only 'xyz' and applied'as 'xyz' IS MISLEADING THE PUBLIC. PURPOSIVE INTERPRETATION IS FOR THE PEOPLE AND FOR GENERATIONS.IT SEEKS TO LOOK INTO THE MINDS OF THE FRAMERS OF THE CONSTITUTION AND NOT ONLY HOW WORD ARE WRITTEN! Atuguba is treacherous, dishonest, and did not exhibit objectivity throughout the deliberations In fact if Dotse a Kuffuor had not allowed his tribal affliations with Tsikata to cloud his objectivity Mahamah could have lost 4 to 5. THE PETITIONERS in their own right should have taken him off the panel. Isnt it ironic that Rawlings appointees: ATUGUBA, GBADEGBE, AKOTO BAMFO, voted deciding that NO VOTER INFRACTIONS TOOK PLACE in the December 2012 election and that the PETITION was without merit?. GOD SAVE GHANA Nana will win hands down next time. IT is now open sected that ATUGUBA twisted Dotses arms to vote with him.

In the absence of a valid written reason for not signing the results will be validated by the signatures of the party polling agents who are enpowered by the "SHALL" in Article 49

Like I have said before if the presiding officer had refused to sign a nd given a valid reson which was then ignored or overlooked by Afari-Djan then there would be a serious case to answer, This never happened!!

1) atubiga rulling was asertive to the point that, agents are not exolted individuals but have a duty of protecting the interest of thier principal. you are bias to the point that you are not able to identify that, the presiding officer is not the only person required by law to authenticate the pink sheet by signing and that, the law say p/o and agent must sign.
the reality on the ground is that, the p/o with the help of the agents of the political parties do the ff immidiatly after voting ends
a) sourt (b)count (c)annouce the result in the open, that is why it can only be an ommission on the side of the p/o not sign the pink sheet rather than rejection of the results he/she presided over. in any case if results are to rejected by a p/o, it is not done by not signing the pinksheet but by a prescribed way spelt out by the very law that grants power to declare votes null and void. mr. lawyer come again

Justices Atuguba did not in anywhere in the judgment put premium of the polling agent's signature over that of the presiding officer. He only maintained the by 'fact' and by the 'constitution' contrary of to Prempe's straw man's argument, the polling agent has a duty even if not equal to that of the presiding officer. Therefore circumstances such as (I)voting in public view(II) counted in public view and (III)recorded in public view' without any concerns or protest, common sense dictates not to annul votes. 'Straw man' argument is cheap. Try to criticize objectively.

Prof. Prempeh's argument is disingenuous as it relies for its sensational effect on the contrapositive, which is a fallacy in logical reasoning.
In denying the petitioner's petition under the signature head, Atuguba put up several arguments, one of which was the presence of the signature of the polling agents. That portion of the opinion neither transposes the agents into the apotheosis of the electoral process nor denigrate the function of the presiding officers into the sanctum of the otiose. If Atuguba wanted those accolades being mouthed by the venerable professor to attach to the polling agents, or the presumed consequence to inure in the electoral process, he would have plainly declared same.
No further meaning of Atuguba's opinion should be inferred from its plain meaning, that in the absence of the presiding officer's signature, the polling agent's signature could be used as a validating factor of the electoral results.
I don't like Atuguba for his stupid contempt convictions, but I respect his argument here and would refrain from a dilatory import of such.

What that ruling means is that next time around, there will be lots of battles at the polling stations, and not much voting will go on!

How the hell are you going to annul votes declared valid in full public view without concerns or protest because of absence of the presiding officer's signature who did not pend any reasons of misconduct whilst certified by the all candidates' representatives-- (about 5 in number)? In any case, it's it in the interest of justice to punish to punish innocent votes whilst leaving the Presiding Officer who failed to pend his signature?

If there were no party agents, then we would rely entirely on the presiding officer. Would you then agree with your reasoning that, if a presiding officer makes a mistake and all the party agents attest to the mistake, it will be the presiding officer's mistake that will be validated at law?

“According to the winning logic of Justice Atuguba, acts and omissions of Polling Agents must be irrefutably (and adversely) imputed to the Party or Candidate that appointed them, but acts and omissions of Presiding Officers cannot be adversely imputed to the Electoral Commission, unless those acts or omissions are shown to have been done wilfully.”

This is rather a wrong deduction from Justice Atuguba’s reasoning;
Mr. Prempeh fails to realize that the constitution puts equal weight on both the Presiding Officer and the Polling Agent (Representative of the Candidate). The word shall is applicable to both Presiding officer and the Polling Agent defined here as the representative of the candidates. Mr. Prempeh must read the constitution again and I quote the clause here for him to refresh his mind in case he misread it.
“((49.3) The presiding officer, the candidates or their representatives and, in the case of a referendum, the
parties contesting or their agents and the polling agents if any, shall then sign a declaration stating –“

It is pathetic that some persons have decided to give their own definition of a Polling Agent (PA) and are concluding that the Polling Agent is not required to sign the Pink sheet and that if the PA signs but the Presiding Officer (PO) fails to sign, the votes must be annulled. This amounts to selective justice and I am not surprised that such is the opinion of the NPP activists and their cohorts because their whole line of thinking and reasoning is always selective justice. If the constitution mandates two parties to sign a document, why will you declare that document invalid if one party signs and the other party refuses to sign and there is no evidence provided to prove that the party who failed to sign refused to do so because he/she firmly believes that the poll was fraught with malpractices. The petitioners failed to prove that lack of signatures was a result of the PO dissatisfaction with the poll and the burden of proof lied with them.
Atuguba’s reasoning, to the contrary, is highly logical because what he implies is that, be it the PO or the PA, the failure of any of them to sign should not invalidate the votes of an innocent third party, particularly as there is no evidence before the court that the failure was due to a perceived malpractice and that is very logical and will hold in any court of law. It is rather illogical to conclude that he put more premium on the PA that on the PO.

he treats the signature of a presiding agent as nothing magic about it, yet he goes on to raise that of the polling agent to such levels as to say their signatures are everything. such hypocrisy. will he say the same thing in four years time given the same conditions and evidence if the NDC is now the petitioners complaining about the same issues of irregularity? will he uphold the same crude definition of over voting if the tides turn? is ballot stuffing a better alternative to overvoting? should we now go and stuff the ballot boxes ahead of the polls and not expect the law to deal with us? We are all thanking God for the cancellation of the doomsday predictions. But that is for the moment only as I can see the planting of an insidious and cancerous seed into our future politics. The SC to which we can all run to for adjudication in future is so glaring compromised as seen through the eyes of ordinary citizens and even people of the law then what shall we do next time when disputes which shall surely come some day arise again. Really, we should be worried about the future of this country.
