Like I have said before if the presiding officer had refused to sign a nd given a valid reson which was then ignored or overlooked by Afari-Djan then there would be a serious case to answer, This never happened!!

He only maintained the by 'fact' and by the 'constitution' contrary of to Prempe's straw man's argument, the polling agent has a duty even if not equal to that of the presiding officer. Therefore circumstances such as (I)voting in public view(II) counted in public view and (III)recorded in public view' without any concerns or protest, common sense dictates not to annul votes. 'Straw man' argument is cheap. Try to criticize objectively.

In denying the petitioner's petition under the signature head, Atuguba put up several arguments, one of which was the presence of the signature of the polling agents. That portion of the opinion neither transposes the agents into the apotheosis of the electoral process nor denigrate the function of the presiding officers into the sanctum of the otiose. If Atuguba wanted those accolades being mouthed by the venerable professor to attach to the polling agents, or the presumed consequence to inure in the electoral process, he would have plainly declared same.
No further meaning of Atuguba's opinion should be inferred from its plain meaning, that in the absence of the presiding officer's signature, the polling agent's signature could be used as a validating factor of the electoral results.
I don't like Atuguba for his stupid contempt convictions, but I respect his argument here and would refrain from a dilatory import of such.

“According to the winning logic of Justice Atuguba, acts and omissions of Polling Agents must be irrefutably (and adversely) imputed to the Party or Candidate that appointed them, but acts and omissions of Presiding Officers cannot be adversely imputed to the Electoral Commission, unless those acts or omissions are shown to have been done wilfully.”
This is rather a wrong deduction from Justice Atuguba’s reasoning;
Mr. Prempeh fails to realize that the constitution puts equal weight on both the Presiding Officer and the Polling Agent (Representative of the Candidate). The word shall is applicable to both Presiding officer and the Polling Agent defined here as the representative of the candidates. Mr. Prempeh must read the constitution again and I quote the clause here for him to refresh his mind in case he misread it.
“((49.3) The presiding officer, the candidates or their representatives and, in the case of a referendum, the
parties contesting or their agents and the polling agents if any, shall then sign a declaration stating –“
It is pathetic that some persons have decided to give their own definition of a Polling Agent (PA) and are concluding that the Polling Agent is not required to sign the Pink sheet and that if the PA signs but the Presiding Officer (PO) fails to sign, the votes must be annulled. This amounts to selective justice and I am not surprised that such is the opinion of the NPP activists and their cohorts because their whole line of thinking and reasoning is always selective justice. If the constitution mandates two parties to sign a document, why will you declare that document invalid if one party signs and the other party refuses to sign and there is no evidence provided to prove that the party who failed to sign refused to do so because he/she firmly believes that the poll was fraught with malpractices. The petitioners failed to prove that lack of signatures was a result of the PO dissatisfaction with the poll and the burden of proof lied with them.
Atuguba’s reasoning, to the contrary, is highly logical because what he implies is that, be it the PO or the PA, the failure of any of them to sign should not invalidate the votes of an innocent third party, particularly as there is no evidence before the court that the failure was due to a perceived malpractice and that is very logical and will hold in any court of law. It is rather illogical to conclude that he put more premium on the PA that on the PO.
