Is the voters register not the primary document to show how many people are registered to vote?

That second definition of over-voting is just purely sickening. Don't take us for fools, we can reason on our own. If 100 ballots were cast and 99 were issued to voters, the EC has explained MANY TIMES that its as a result of one spoilt ballot which will be recorded at another portion of the pinksheet. DOES THAT AMOUNT TO BALLOT-STUFFING? Is the NPP trying to tel us that anytime ballot papers get spoilt at polling stations, (which causes a difference between ballots cast and issued), votes should be annuled.

This is pure desperation to the point that, common sense doesnt work out anymore. The EC has given simple and very reasonable reasons for these little issues, yet the lazy, intellectually lazy part of the NPP fail to understand

We all saw and listened to the case. Even one of the judges said it before they referred to the voter's register that the 21 was actually 71. So you need to get it right, it wasn't 66 ballots issued and 67 found in the ballot box but 66 valid votes and 1 rejected vote which totaled 67. So the question was how come 21 people registered to vote but 67 votes found in the ballot box according to the pink sheet. You and the writer need to go back and check before speculating anything. Just because Addison showed that particular pink sheet does not means that it was right. They had a copy of the register but yet they ignore to double check or they deliberately did that to confuse the judges that why they objected when EC was trying to prove that that was just a mere mistake by the presiding officer by showing the court and us the actual people registered to vote on the voter's register.

Go read Justce Dotse opinion. The classical ballot stuffing as we knew it the past cannot happen now. This is largely due to measures Afari Gyan introduced. Ballot papers are numbered, are stamped and signed by presiding officers.So to sort out these foreign material from genuine ballots, the numbers have to be inspected to find out if they fall within the numbers in the booklets used, from which of these booklets were they torn, wwere they stamped and signed/ These would weed out any such stuffed fake ballots for the genuine ones to be counted. There is therfore no grounds for annuling any votes because of the presence of fake ballots. The situation could be improved further by requiring the party representaives to countersign the ballots and that will make any attempt at stuffing unattractive.

"The foregoing evaluation of the impact of the nullified votes shows that they resulted in neither the first petitioner nor the first respondent obtaining the critical fifty percent plus one valid vote threshold.

As neither the first petitioner nor the first respondent had the required number of votes by the constitution to be declared the President of the Republic of Ghana,
I make the following conclusions and directions:

1. That the relief that an declaration be made that Mr. John Dramani Mahama was not validly elected the President of Ghana, is hereby granted;

2. That a declaration be made that Nana Akufo-Addo be declared the candidate who was validly elected the President of Ghana, is also refused.

3. The consequential order I make is that the E.C. conducts a re-run of the Presidential elections for the two leading candidates, Mr. John Dramani Mahama and Nana Akufo-Addo, in all the polling stations affected and indicated in the petition and its supporting documents, forthwith."

If this what what Justice Ansah wrote, then the net effect was zero. and the Mahama's delaration as president be maintained. The justice seemed to have contradicted himself though.

Pink sheet overvotes were administrative errors that were never associated with complaints from polling officers, presiding officers or members of the public who were present when counting took place!!

Common sense should be applied to the Law.

To be honest I am at a lost, because whatever material was used to stuff the ballot box ( be it leaves or toilet rolls}, it has been counted and written on the pink sheets and subsequently used to declare the winner. Common sense dictates that whether ballot stuffing or over voting it must be rejected.
This man was quoting a lot of cases in his written judgement to justify this corrupt judgement.

His mind was made up before the case even commenced and he was going to vote for Raymond Atuguba and his boss regardless of the evidence. This is very shameful and has cast an unrepairable aspersion on the integrity of the supreme court. When a judge is having ex parte communications with parties who have a case before him as Atuguba was doing with RAYMOND and his boss, it calls into question the integrity of the whole proceedings. This man does not deserve to be a judge.

It is a published document, just as that of all the other judges. I reproduce below the complete paragraph:

"The first is where the number of those who voted at a polling station exceeds the number of voters contained in the relevant polling station register. The second SITUATION IS WHERE THE NUMBER OF BALLOTS IN THE BALLOT BOOK EXCEEDS THE NUMBER OF BALLOT PAPERS ISSUED TO THE RELEVANT POLLING STATION. Pondering over these two categories closely I would think that the second category of overvoting is rather an instance of ballot stuffing as testified by Johnson Asiedu Nketia."
