During the last year or so its has become clear to almost every child the ethnocentric racist anti Akan vicious propaganda directed mainly against the innocent Ashanti and Akyems .Even here on this forum we witness the daily insults , defamation and systematic character assination of any Akan leader who dares raise his voice to cry foul. The Akans lead by the Fantis are fighting back just as they in the early 90's with prof eduboahen and this happened last year after the murder of Mills. these ewe and northerners think if they bribe a few paramount chiefs and buy off Akuffo Addo as they have done they can go back to the business of looting the coffers but not so . They are overwhelmed by the resistance which is being lead by the family heads and the clans . since most the people here writing under false Akan names dont see the difference continue to harass the ashantis and akyems who by the way rarely ever contribute anything to this forum . this prof awonoor has mislead his people into a war they will surely loose , battle after battle they are pounded and bashed , the sophistication of their devious divide and rule strategy has been exposed and backfired ,today the Akans are more united than ever so much so the the Ashantis and akyems no more participate but are standing on the sidelines watching as they are surprised at the fury and determination of the rest of the Akans to rid themselves of this yoke of oppression. Akans will never peacefully accept to be second class citizens like the Indians in Latin America and fight the hegemony and tribalism with these same tools rather than just brushing it off and pretending it doesn't exist . the battle-lines have been drawn in the minds of every Ghanian and as things escalate the business of governance is slowly grinding to a halt soon from verbal warfare we move to open rejection of the govt of the day which will most likely end up in true war . we can not build and develop a sustainable economy if the ayigbe and pepeni can only be focused on the destruction of the Akans and looting the wealth of the nation , sadly when we say this all they say is that their hate is justified and their time has come to chop some . let it be known Akans make up almost 70% of the population, have 90% of the wealth and natural resources and that this govt that practically has less than 10% Akan participation is illegitimate and even the foreign banks and investors have noticed this and are withdrawing , the rest like the Chinese , Indians , Muslim Lebanese and Turkish will soon risk never being paid . billions have been borrowed but nobody has seen any benefits but it has ended up in the bottomless pits of the greed of the ndc pepeni and ayigbe . we propose secession as a peaceful exit to this mess , if persuasion fails force will be applied , long live the republic of Akan

What takes the biscuit is the deliberate sidestepping of the SC own yardstick (the 2 conditions) in preference to the 'Atuguba condition' The Atuguba condition uses the petitioner's 6 individual issues of irregularities. One of them you will recall is same serial numbers. This was included in the Atuguba yardstick...and was voted down as 9-0. We know that Dr Bawumia stated that this particular issue was the vehicle through which all the major infractions were perpetuated. For example, same serial numbers accounted for 75% of over voting, 74% of non signature etc. Therefore it was not a stand alone issue to be determined upon. Shame! Shame! Shame!

Three of them went for re run in the affected places while one of them wrote that the infractions will not affect the outcome the election and dismissed the petitioners case. And only Justice Anin Yeboah said that the whole election be cancelled and fresh election conducted , no wonder Mr. Tsikata accused him of biased.

Gabby Otchere Darku should know that a panel decision is based on simple majority and what he is trying to do is to cause mischief by playing the devil's role.

Which ever way you look at the verdict, the decision was emphatically called for the respondents.With the singular exception of Anim Yeboah who called for blanket cancellation and by a twist of logic asked for a rerun of the election between Mahama and Addo all others handpicked areas and asked for a rerun.The relief of the petitioners asking the court to cancel votes and award those votes to Akufo in order to make him the president was unanimously rejected by all the judges.

In effect one would have thought that since the relief sought by the petitioners failed the judges should have dismissed the claim by the petitioners because there was no relief on the table.If this man is worth his salt he should test the hypothesis he is propounding in court and see whether he will not end up in disgrace instead of the behind the scene noises he is making.It makes no sense and does not meet the test of good reasoning .No wonder he had difficulties in passing his exams.

It is an accepted fact that constitutional interpretation must be expansive and not narrow as some of these judges wants to ascertain.it beggars belief that some of the judges did not go along with the maxim that when there is a constitutional duty and a constitutional right equity imposes a duty that right must be given the benefit of the doubt.

To say that the word "shall" is imperative and therefore imposes a mandatory obligation is nonsense.In constitutional interpretation there is always the need for common sense.Even in the advance democracies there is always a margin for appreciation for mistakes.There is no perfect elections and Justice Anim's logic will make elections impossible in Ghana.

It is also true from the written judgements that five of the Justices held that Mahama was not validly elected. It seems Atuguba misled the petitioners. This is what Gabby is talking about. 3 Were unanimously rejected and the rest was dismissed on a majority decision.If you doubt that ask for a review and I have no doubt that it will as well be dismissed.

I am not the one to seek a review because I am not one of the petitioners; neither do I belong to any political party. Some of you are fond of pigeon-holing people based on which side of an issue they take and that is dangerous for the progress of our nation. Because of this attitude all the professionals in our country have taken a back seat, ceding the space for shaping opinions to inexperienced party operatives and partisan journalists. As a Ghanaian I have every right to comment on issues as much as you have. It does not mean that we have to agree on all issues all the time but we will both be doing our civic duties by expressing our opinions.

Now let me break down the logic of Gabby’s article for you. First of all, there is a difference between the categories of infractions and reliefs sought in the petition. The petitioners went to court alleging infractions, three of which are against either the Constitution or statutes and three falling under the general category of malpractices. They did not say that these categories were mutually exclusive. In fact they contended that some of these occurred together on same pink sheets.

Using these infractions as the vehicle, they prayed for the Court to grant them three reliefs being:

1) John Mahama was not validly elected;

2) Nana Akufo Addo was rather validly elected; and

3) Any consequential orders the court may deem fit.

It is true that all the Justices threw out all the infractions under general malpractices. However, contrary to the widely-held impression that the infraction relating to duplicate serial numbers were summarily thrown own, some of the Justices held that there was some mischief in that malpractice. The only reason why they did not uphold it was that no law existed that mandated that pink sheets should have unique identification marks. They thus recommended that this should be so for future elections.

It is true, as you said that if you take individual constitutional and statutory infractions, and if you compartmentalise these, and if you assume that they are mutually exclusive, then the majority dismissed these claims as well. However, on the pleadings by the petitioners that they were not fighting the case on categorisation for its own sake, but that they used the categories to help the court understand the nature of the infractions, then every infraction is an infraction.

More importantly though, let us look at the rulings and the reliefs that the Justices granted. They were unanimous in denying relief (2), as I have listed above, that Nana Addo was not rather validly elected. They also granted relief (3) unanimously in some calling for reforms and/or some (majority 5-4) that elections should be re-run in polling stations affected by the infractions they upheld. Rather more importantly, majority of the judges (5-4) granted the first relief that John Mahama was not validly elected. These were Justices Ansah, Baffoe-Bonnie, Dotse, Owusu, and Annin-Yeboah. I urge you to read the conclusions of their judgements.

So it is only when, you compartmentalise the infractions, and also hold that they are mutually exclusive, that you can say majority dismissed the petition.

William Nana Addo Danquah Akufo Addo, has said he would not seek a review of the case, and is currently riding on a soaring crest of global goodwill, in-spite of everything within his being, which tells him to reject, the verdict of the Justices of the supreme court. His whole upbringing and whatever he has done and whatever he stands for, all pushes him to reject this verdict, however, he has accepted it in good faith and would not seek a review. Ghanaians heard him loud and clear when he uttered those words, and also witnessed the proceedings in court and have adviced themselves accordingly.
The academic exercise is very good and falls very much in line with what the CJ proposed with respect to educating the citizenry about the laws governing the country and our constitution devoid of the bias and so it's perfectly within the remit of Gabby and his various experts, to dissect the verdict, and see where it came short, but it should not be limited to the perspective of just the petitioners, since such an exercise would be just be an exercise in futility and a waste of effort.
