Atuguba wasn't biased. Tsatsu made an observation in his trial and that of the election petition on the vote pattern, judgement and insinuations of Anim yeboah. Anim Yeboah was part of the judges that voted 9-0 on three different issues. Yeboah did not want to expose himself as the NPP could not back their ghost polling station, serial number assumptions and duplication rubbish so he had NO CHOICE than to vote together with the other judges unanimously. However, as soon as he saw the over vote and omission of Presiding Officers' signatures garbage, he couldn't resist and chose to take the bait rather than follow logical reasoning. These are the issues that opposed common sense in the NPP Tunnel Vision of using the constitution to cancel the votes of 4 million people by placing the importance on the Presiding Officers rather than on the masses who suffered to vote with extreme patience. Anim Yeboah decided to go against the pleas of the INTELLIGENT Tsatsu Tsikata in his final address not to use the sins of the officers against the electorate. He takes delight in opposing Tsikata just because is Ewe and also NDC lawyer BUT Tsikata was in University by the age of 15 so he is far more intelligent than Yeboah. Tsikata made his final address by touching on all issues during the trial with quotes from the same constitution and references from the petition to elsewhere to back his claims and the incompetent and unreliable witness Bawumia being seriously discredited so the judges had no choice than to dismiss the case. There were people in Ghana before Nana Addo was born and we do NOT want him and his 40 thieves from the NPP. A modern day Ali Baba who is so desperate to be president at all cost and will finally die at all cost.

Tsatsu has a beef with the judge due to his previous encounter with him and saw the opportunity given him by Kwesi Pratt as the best time to get his own back on the judge. It was low, childish and irresponsible for such a so called legal brain to descend so low out of anger and hatred. Politics have clouded our judgement so bad that we are all drowning but we fail to see it. This country is sinking fast and the earlier we stop all this pettiness and pull together to get ourselves out of the mess our leaders are leading us into, the better it will be for us.

In case you can't read, Tsatsu stated clearly in simple English that,'from the very onset and even before the NDC decided to enjoin in the petition case, Anin Yeboah took an opposing stance to all their pleadings.

He then supporter his claim or criticism of Anin Yeboah with another court ruling where Anin Yeboah acted against simple Logic, using the immunity of IMF an entirely different organisation from IFC with different immune state to make a judgment.

The above is what you people should analyze whether Tsatsu was not telling the truth that it was because this Jude has allowed his political afilliation to cloud his judgement because he was appointed by KRONFUOR, THE GREATEST THIEF IN GHANA.

When Afari Gyan was still EC Chairman, NPP, then in Opposition won the elections to come to power. They won again for the second time to retain power. Al these two elections, I wonder why they did not cry that Afari Gyan was fraudulently helping them to win. Why will he now help NDC to win? The problem is, nobody in Ghana, tells the truth. Even me, and you reading this. We are all so politically drunk to such an extent that, when fart, we blame our political opponents. When we are even yawning, we blame it on political opponents. This whole petition was just politically biased accusations. No truth in it. And even after lawyers have argued and failed to convince the judges to deny Ghana peace, we still want to even say the verdict is wrong,
Lots of Ghanaians lack simple wisdom to know between a truth and a lie by the politicians and they will always use lies to destroy the country gradually for us. The media is also just looking for money and the political commentators are looking for popularity, so they will also spin everything to make it a hot issue.
Please Ghanaians stop and think about how you talk and judge issues. It is a pity. Wisdom. Tsikata said it at the wrong time and Gabby Otchere Darko said it at the right time and NPP before the start of the case ask some SC judges to excuse themselves at the right time. Because we lack lots of wisdom, we cannot even think properly to know truth and lies. Even prophets lied about who will win this case, whiles simple logic from a wise ordinary man following the petition knew where it was suppose to go and it went. When will we have wisdom at all?
The Whites will laugh at us most times, like they are saying, we are politically drunk to an extent that we don't even know the truth from lies. Ghana paa nie? Nkuraase sem nkoaaaa. Nobody is thinking right anymore. stupidity at the highest level. Both NDC and NPP are just playing with Ghana. Ask why we have so much resources and yet we are so poor and still borrowing? Ask why people spend all their money to campaign fora seat or presidency? All of us reading here are even not thinking right. We think we are good people of Ghana. Nonsense. Coups are not good but I think if we don't start thinking right some young ones will make one and kill all NDC and NPP people so that Ghana will be free a bit for sometime. We have not moral right to condemn Rawlings for killing some people because we are heading to the same Ghana he shaped.Stupid no wisdom Ghanaians, think again.

What the Adticle says is the truth about Ghana. And it has always been so since Nkrumah's time.

The only difference now is that such partisan taint has become more visible with our increasing claim on democracy by which these entities invoke their right to freely express themselves.

So, we would be deceiving ourselves if we said they all give unbiased opinions on national issues. The Public even tacitly acknowledges this partisan coloration of the entities mentioned but remains indifferent until a particularly high-profile case has been commented on by any of the entities.

There is also a twist to this phenomenon. That is the dileberate planting of loyal partisan Officials deep within Agencies by various Administrations who upon the changing of batons to other Parties' Administrations leak information to the Opposition or work to sabotage the incumbent administration's goals.

A case in point is the idea rumored around that the Ya Naa case which the Mills' Administration prosecuted was sabotaged by certain NPP remnants at the Attorney-General's office who caused some documents of evidence to disappear resulting in a technical acquittal of the suspected culprits. Similar judicial tricks were also believed to have caused the failure of the Government to win most of its high-profile cases that either would have convicted NPP officials or discredited the Party.

I personally believe both the NDC and NPP behave simIlarly to influence cases. So, Justice in Ghana has always been less fair than it needs to be.

The NPP always wants to prove that NDC is a Party that hates rule of Law and does not believe in real Justice via the Courts. The NDC also always wants to show that our Judiciary has been packed with elitist selfish Judges who only favor NPP because it is under NPP that they could enjoy their exclusive bourgeoisie benefits without fear of being questioned by anyone, hiding behind the thin veil of democratic Capitalism but denying all others the opportunity to compete in the marketplace.

Appeal and Supreme Courts verdicts always favour the leanings of their party (Conservative for Republicans and Liberal or moderates for Democrats)so why should it be different from that of Ghana? Before this Petitions case began I knew where it will end.One does not need to be a Political Scientist or a lawyer to know the outcome of the verdict. Ghanaians should accept it whether good or bad for the country to move on. Ghana has shown to the world that we are matured in our democratic dispensations. Muhammad Jamil,a newsman wrote in his colum in "The Nation" a Pakistan news paper on April 25,2013 that "no matter under what dispensation,whether military or democratic, elections results are often not accepted" in the third world countries.Even it is true throughout the world. So if that being accepted why should Ghana's be different?

even students elections are now characterised and branded with party affiliations WHY? It is high time we moved away from this cheap and selfish politics to more development oriented country. TV stations, radio stations can do better if they bring experts on their shows rather politicians.

THAT AS I HAVE POSTULATED TO THE ENTIRE WORLD THAT "JUSTICE SEEKS THE TRUTH AND NOTHING BUT THE TRUTH".
THAT THE LEGAL ISSUES BEFORE GHANA SUPREME COURT THAT THE COURT ADJUDICATED AND RULED ON THE MATTER AND BY MAJORITY DECISION DISMISSED THE PETITION THAT WE MUST ALL CALL "A SPADE A SPADE".
THAT IT IS ALSO A TRITE KNOWLEDGE THAT THE LEGAL RESEARCH AND INDUSTRY THAT COUNSELS/LAWYERS PUT INTO A CASE HELPED THE JUDGES WORK TO BE VERY EASY.
IN FACT, THE SAME CANNOT OR COULD NOT BE SAID WITH THE 2012 PRESIDENTIAL ELECTIONS PETITION CHALLENGED SINCE COUNSELS FOR RESPONDENTS INSTEAD OF TO RAISE "A PRELIMINAY CHALLENGE ON THE PETITION ITSELF AND OTHER LEGAL ISSUES RAISED AS FRIVOLOUS, CAPRICIOUS, VEXACIOUS AND MALICIOUS" BUT RATHER ENGAGED THE PETITIONERS ON "PINK SHEETS CLERICAL ERRORS INSTEAD OF ON POINTS OF LAW AND LEGAL BASIS".
THAT THE WHOLE MATTER WAS "A QUESTION OF LAW AND NOT PINK SHEETS".
HOWEVER, THE SUPREME COURT OF GHANA HAS NOT BEEN FULLY APPRISED WITH THE LEGAL POSITIONS SINCE COUNSELS FAILED TO MAKE THE RELEVANT LEGAL ARGUMENTS BUT JUST DWELL ON FACTS AND RATIONALITY OR RATIONAL ANALYSIS OF THE FACTS.
IT IS MY FIRM BELIEVED THAT IF THE COUNSELS FOR RESPONDENTS WERE TO RAISE THE PRELIMINARY OBJECTIONS TO THE PETITION AND MADE THE RELEVANT LEGAL ARGUMENTS SUPPORTED WITH THE RELEVANT PROVISIONS OF THE CONSTITUTION AND OTHER RELEVANT LAWS THE COURT WOULD HAVE DISMISSED THE LAWSUITS ON THE ONSET.
THAT I AM RESPECTFULLY CALLING ON ALL THE MEDIA HOUSES THAT COVERED THE PROCEEDINGS TO PRODUCE THE TAPE RECORDINGS OF THE PROCEEDINGS OF THE AMICUS CURIAE REVIEW MOTION AND THE LEGAL ARGUMENTS THAT I ADDUCED AT THE COURT AND EACH COUNSELS RESPONSE AND THE COURT RESPONSE AND THE THE COURT RULING TO HELP THE READING PUBLIC TO ASCERTAIN THE DIFFICULTIES POSED BY SOME OF THE COUNSELS RESPONSES TO THE JUDGES.
THAT DR.AFARI-GYAN IN THE FIRST PLACE DO/DID NOT HAVE FULL RESPONSIBILITY OVER TEMPORAL 2 OR 3 DAYS ELECTION OFFICIALS SINCE THEY WERE NOT PERMANENT STAFF AND THAT THE INSTRUCTIONS GIVEN TO ME WERE ACROSS THE BOARD.
THAT THE TRUTH OF THE MATTER WAS THAT THE MALPRACTICES AND OTHERS THAT THE PETITIONERS COMPLAINED ABOUT AND COMMENCED THE LAWSUITS DID NOT OCCUR IN REALITY AT THE POLLING STATIONS THEMSELVES THAT THE LEGITIMATE VOTER COULD BE BLAMED OR ACCUSED OF BUT JUST "MERE CLERICAL OR ADMINISTRATIVE ERRORS" THAT DID NOT ACTUALLY AFFECT THE FINAL OUTCOME OF THE FINAL RESULTS DECLARED THAT IT THEREFORE DEFILED COMMON SENSE THAT THOSE GENUINE AND HONEST SINCERE VOTES CAST TO BE PURPORTED TO BE ANNULED THAT THE ISSUE THEN IS "WHERE THEREFORE WILL BE JUSTICE ITSELF?".
TO PURPORT TO FIND A FINDING FOR "A MERE HYPOTHETICAL SPECULATIVE CASE WOULD HAVE REALLY CAST A SLUR ON OUR JUDICIAL SYSTEM AND WOULD EVEN AMOUNT TO "JUDICIAL SABOTAGE".

BUT THANKS TO THE MAJORITY DECISION THAT DISMISSED THE PETITION.

THAT DR.AFARI-GYAN HAS DONE NOTHING WRONG TO CAST A SLUR ON HIS REPUTATION AND INTEGRITY ESPECIALLY AS DR.BAWUMIA TOLD THE SUPREME COURT IN HIS EVIDENCE IN CHIEF AND UNDER CROSS-EXAMINATIONS THAT WHEN THEY WERE PREPARING THE PINK SHEETS TO COMMENCE THE LAWSUITS THEY ALSO MADE "MISTAKES" AND HE EVEN FURTHER STATED THAT "THEY MADE MISTAKES AS ANYBODY OR ANY PERSON CAN ALSO MAKE MISTAKES" AND THAT THE LEGAL POSITION AND LEGAL EFFECTS OF DR.BAWUMIA TESTIMONY WAS NEVER ADDRESSED IN LAW.

IT IS AT THESE RELATED BACKDROPS THAT TAKING COGNIZANCE OF THE FOLLOWING LEGAL THEORIES OR LEGAL PRINCIPLES IF THEY HAVE BEEN ADDRESSED WOULD HAVE HELPED THE COURT TO MAKE EASY DETERMINATION OF THE CASE:

(i) THE LEGAL PRINCIPLES OF EQUITY

(ii)THE LEGAL THEORY OF "MENS REA" OR THE "INTENT OF THE ELECTORAL OFFICIALS OF MAKING THE CLERICAL ERRORS".

(iii) THE LEGAL PRINCIPLE OF "HONEST MISTAKES AND ITS EFFECTS".

(iv)THE CONSTITUTIONAL AUTHORITY VESTED IN THE ELECTORAL COMMISSION UNDER CHAPTER 007 OF GHANA 1992 CONSTITUTION

(v) WHETHER OR NOT THE PURPORTED MISTAKES MADE CAN BE CURED BY THE COURT WHEN THE PETITIONERS THEMSELVES ALSO MADE THE SAME MISTAKES?

(vi)WHETHER OR NOT THE PROVISIONS UNDER CLAUSES 4,5 & 6 OF ARTICLE 57 CHAPTER 008 OF GHANA 1992 CONSTITUTION OF THE CASE OF A SITTING PRESIDENT OF GHANA WHILE IN OFFICE ACTED AS OUSTER CLAUSE(S) TO

ARTICLE 64 UNDER WHICH THE PETITIONERS BROUGHT THE PETITION THAT COUNSELS FOR RESPONDENTS FAILED WOEFULLY TO ADDRESS THE LEGAL ISSUE AND RATHER MADE A SITTING PRESIDENT OF GHANA H.E.PRESIDENT JOHN DRAMANI MAHAMA A LITIGANT.

THAT ASSUMING THAT THE PRESIDENT OF GHANA TO BE PERSONALLY ATTENDING THE SITTINGS OF THE SUPREME COURT FROM 9.00 AM TO 4.30PM EVERY SITTING(S) THAT THE FACT REMAINED THAT "WHAT KIND OF WORK WOULD THE PRESIDENT BE DOING TO UPHOLD THE TRUST AND CONFIDENCE THE GOOD PEOPLE OF GHANA REPOSED IN THE PRESIDENT TO DO THE PEOPLE'S WORK?"

WHETHER OR NOT THE COURT RECORDINGS OF THE PROCEEDINGS DENOTED THE PRESIDENT AS "ABSENT?"

WHETHER OR NOT THE PRESIDENT OF GHANA BEST INTEREST HAS BEEN PROTECTED BY HIS COUNSELS?

IN FACT, THESE ARE ALL MATTERS OF LAW AND THE LAW WAS SIDE LINED AND IN THE SAME VEIN THAT DR.AFARI-GYAN ASSERTED HIS CONSTITUTIONAL AUTHORITY AT THE COURT AND ASSERTED THAT AS CHAIRMAN OF ELECTORAL COMMISSION THAT HE HAS NO BASIS TO CHANGE THE FINAL OUTCOME OF THE RESULTS HE DULY DECLARED ON DECEMBER 9,2012 AND ALSO DULY GAZETTED, THEREFORE IF ANY PERSON OR PERSONS OR JUDGE(s) HOLD OR HELD CONTRARY TO HIS ASSERTION THEN THE PERSON OR JUDGE SHOULD PROVE IT ON POINT OF LAW OR LEGAL BASIS AND NOT MERELY RATIONALIZING MERE SPECULATIVE HYPOTHETICAL FACTS THAT NEVER OCCURRED AT THE REAL POLLING STATIONS BUT ON MERE PINK SHEETS.
