It is ok for the ndc to parade thieves like rawlings tsikata konadu mahama kwetey and nketia but when the npp try to field a true Akan warriors who can try and protect the rights of the majority they go and kill him like mills, in fact the blood of the Akan leaders has been spilt so many times no one bothers to ask why , a wise man said wisdom comes after reflection with justice in the heart but that is not the case. pepeni and his alajih thieves could not even offer 10,000 troops to obama our first black president and friend rather these cowards are running around in full body armor trying to frighten the people and will soon be causing trouble .these Arabs are just as evil as pepeni , imagine the Muslims being able to twist even the word of God so it becomes a platform for hate and oppression of others , i hope the Americans bomb them all into oblivion and later come here and bomb these pepeni too, long live the republic of Akan

If such justices sat on a murder verdict, they would send several innocent people to their deayhs unnecessarily. In fact they nearly sent the whole country to death.
The judicial system should come out and assure us all, because Atuguba has shown that there is no justice in Ghana now? A disgrace of the highest order!!

But I can bet my last pound that you will never do that but rather go loose in town with your shallow uneducated, misinformed and biased opinions about a man of substance. Was this Judge not the same man who was accused by some supporters of NDC of having once held an executive position in the Volta region NPP? Would it be far fetched to state that having been unable to secure a win for NPP from the Bench he now has to compensate the party by running down Dr. Afari Gyan´s hard won image both locally and internationally?

The hollowness of the petitioners case made those judges who normally would have sympathised with that party to be careful not to put their reputations on line by ruling in their favour. This man however had to try to maintain his perceived good standing in the party by writing this harmful judgement to satisfy his friends. In spite of this darning effort to dim the EC chairman´s reputation, he will still be remembered as the "YENNYAWOSO"(indispensable) of Elections administration in Ghana. What is now left for him to be officially decorated with this award.

They took a chance. Why? The judiciary and to some extent the law fraternity in Ghana are pro-NPP mainly because of what happened to the 3 High Court judges in 1982 under the PNDC. So hopefully by going to court if by any chance they get a group or majority of the panel who are NPP sympathisers, then may be it might go thier way on the assumption that this might be the time to pay back Rawlings/NDC. Why do you think Rawlings never commented on the case? They only reason the plot did not work is they being "greedy" by including 3 other claims that were non-sensical. The rulings on the other 3 claims as we all can see was very close indeed.Do not forget the Chief Justice is pro-NPP and she selected 6 pro-NPP judges!

HOWEVER, JUST TO SET THE RECORDS STRAIGHT THAT I AM RESPECTFULLY WRITING THIS REJOINDER.
THAT BEFORE ONE CAN OR COULD UNDERSTAND THE SITUATION UNDER WHICH DR.AFARI-GYAN FOUND HIMSELF THEN ONE WOULD APPRECIATE THE HARD WORK AND THE GOOD WORKS HE HAS DONE.
THAT IT WAS THE SAME DR.AFARI_GYAN WHO WAS THE CHAIRMAN OF THE ELECTORAL COMMISSION DURING 2000 AND 2004 PRESIDENTIAL AND PARLIAMENTARY ELECTIONS AND DECLARED THE NPP PRESIDENTIAL CANDIDATE THEN H.E.FORMER PRESIDENT OF GHANA JOHN AGYEKUM KUFUOR WINNER OF BOTH ELECTIONS WHEN THE GOOD PEOPLE OF GHANA CLEARLY VOTED FOR HIM.
THAT AS I HAVE POSTULATED TO THE ENTIRE WORLD THAT "JUSTICE SEEKS THE TRUTH AND NOTHING BUT THE TRUTH".
THAT THE LEGAL ISSUES BEFORE GHANA SUPREME COURT THAT THE COURT ADJUDICATED AND RULED ON THE MATTER AND BY MAJORITY DECISION DISMISSED THE PETITION THAT WE MUST ALL CALL "A SPADE A SPADE".
THAT IT IS ALSO A TRITE KNOWLEDGE THAT THE LEGAL RESEARCH AND INDUSTRY THAT COUNSELS/LAWYERS PUT INTO A CASE HELPED THE JUDGES WORK TO BE VERY EASY.
IN FACT, THE SAME CANNOT OR COULD NOT BE SAID WITH THE 2012 PRESIDENTIAL ELECTIONS PETITION CHALLENGED SINCE COUNSELS FOR RESPONDENTS INSTEAD OF TO RAISE "A PRELIMINAY CHALLENGE ON THE PETITION ITSELF AND OTHER LEGAL ISSUES RAISED AS FRIVOLOUS, CAPRICIOUS, VEXACIOUS AND MALICIOUS" BUT RATHER ENGAGED THE PETITIONERS ON "PINK SHEETS CLERICAL ERRORS INSTEAD OF ON POINTS OF LAW AND LEGAL BASIS".
THAT THE WHOLE MATTER WAS "A QUESTION OF LAW AND NOT PINK SHEETS".
HOWEVER, THE SUPREME COURT OF GHANA HAS NOT BEEN FULLY APPRISED WITH THE LEGAL POSITIONS SINCE COUNSELS FAILED TO MAKE THE RELEVANT LEGAL ARGUMENTS BUT JUST DWELL ON FACTS AND RATIONALITY OR RATIONAL ANALYSIS OF THE FACTS.
IT IS MY FIRM BELIEVED THAT IF THE COUNSELS FOR RESPONDENTS WERE TO RAISE THE PRELIMINARY OBJECTIONS TO THE PETITION AND MADE THE RELEVANT LEGAL ARGUMENTS SUPPORTED WITH THE RELEVANT PROVISIONS OF THE CONSTITUTION AND OTHER RELEVANT LAWS THE COURT WOULD HAVE DISMISSED THE LAWSUITS ON THE ONSET.
THAT I AM RESPECTFULLY CALLING ON ALL THE MEDIA HOUSES THAT COVERED THE PROCEEDINGS TO PRODUCE THE TAPE RECORDINGS OF THE PROCEEDINGS OF THE AMICUS CURIAE REVIEW MOTION AND THE LEGAL ARGUMENTS THAT I ADDUCED AT THE COURT AND EACH COUNSELS RESPONSE AND THE COURT RESPONSE AND THE THE COURT RULING TO HELP THE READING PUBLIC TO ASCERTAIN THE DIFFICULTIES POSED BY SOME OF THE COUNSELS RESPONSES TO THE JUDGES.
THAT DR.AFARI-GYAN IN THE FIRST PLACE DO/DID NOT HAVE FULL RESPONSIBILITY OVER TEMPORAL 2 OR 3 DAYS ELECTION OFFICIALS SINCE THEY WERE NOT PERMANENT STAFF AND THAT THE INSTRUCTIONS GIVEN TO ME WERE ACROSS THE BOARD.
THAT THE TRUTH OF THE MATTER WAS THAT THE MALPRACTICES AND OTHERS THAT THE PETITIONERS COMPLAINED ABOUT AND COMMENCED THE LAWSUITS DID NOT OCCUR IN REALITY AT THE POLLING STATIONS THEMSELVES THAT THE LEGITIMATE VOTER COULD BE BLAMED OR ACCUSED OF BUT JUST "MERE CLERICAL OR ADMINISTRATIVE ERRORS" THAT DID NOT ACTUALLY AFFECT THE FINAL OUTCOME OF THE FINAL RESULTS DECLARED THAT IT THEREFORE DEFILED COMMON SENSE THAT THOSE GENUINE AND HONEST SINCERE VOTES CAST TO BE PURPORTED TO BE ANNULED THAT THE ISSUE THEN IS "WHERE THEREFORE WILL BE JUSTICE ITSELF?".
TO PURPORT TO FIND A FINDING FOR "A MERE HYPOTHETICAL SPECULATIVE CASE WOULD HAVE REALLY CAST A SLUR ON OUR JUDICIAL SYSTEM AND WOULD EVEN AMOUNT TO "JUDICIAL SABOTAGE".

BUT THANKS TO THE MAJORITY DECISION THAT DISMISSED THE PETITION.

THAT DR.AFARI-GYAN HAS DONE NOTHING WRONG TO CAST A SLUR ON HIS REPUTATION AND INTEGRITY ESPECIALLY AS DR.BAWUMIA TOLD THE SUPREME COURT IN HIS EVIDENCE IN CHIEF AND UNDER CROSS-EXAMINATIONS THAT WHEN THEY WERE PREPARING THE PINK SHEETS TO COMMENCE THE LAWSUITS THEY ALSO MADE "MISTAKES" AND HE EVEN FURTHER STATED THAT "THEY MADE MISTAKES AS ANYBODY OR ANY PERSON CAN ALSO MAKE MISTAKES" AND THAT THE LEGAL POSITION AND LEGAL EFFECTS OF DR.BAWUMIA TESTIMONY WAS NEVER ADDRESSED IN LAW.

IT IS AT THESE RELATED BACKDROPS THAT TAKING COGNIZANCE OF THE FOLLOWING LEGAL THEORIES OR LEGAL PRINCIPLES IF THEY HAVE BEEN ADDRESSED WOULD HAVE HELPED THE COURT TO MAKE EASY DETERMINATION OF THE CASE:

(i) THE LEGAL PRINCIPLES OF EQUITY

(ii)THE LEGAL THEORY OF "MENS REA" OR THE "INTENT OF THE ELECTORAL OFFICIALS OF MAKING THE CLERICAL ERRORS".

(iii) THE LEGAL PRINCIPLE OF "HONEST MISTAKES AND ITS EFFECTS".

(iv)THE CONSTITUTIONAL AUTHORITY VESTED IN THE ELECTORAL COMMISSION UNDER CHAPTER 007 OF GHANA 1992 CONSTITUTION

(v) WHETHER OR NOT THE PURPORTED MISTAKES MADE CAN BE CURED BY THE COURT WHEN THE PETITIONERS THEMSELVES ALSO MADE THE SAME MISTAKES?

(vi)WHETHER OR NOT THE PROVISIONS UNDER CLAUSES 4,5 & 6 OF ARTICLE 57 CHAPTER 008 OF GHANA 1992 CONSTITUTION OF THE CASE OF A SITTING PRESIDENT OF GHANA WHILE IN OFFICE ACTED AS OUSTER CLAUSE(S) TO

ARTICLE 64 UNDER WHICH THE PETITIONERS BROUGHT THE PETITION THAT COUNSELS FOR RESPONDENTS FAILED WOEFULLY TO ADDRESS THE LEGAL ISSUE AND RATHER MADE A SITTING PRESIDENT OF GHANA H.E.PRESIDENT JOHN DRAMANI MAHAMA A LITIGANT.

THAT ASSUMING THAT THE PRESIDENT OF GHANA TO BE PERSONALLY ATTENDING THE SITTINGS OF THE SUPREME COURT FROM 9.00 AM TO 4.30PM EVERY SITTING(S) THAT THE FACT REMAINED THAT "WHAT KIND OF WORK WOULD THE PRESIDENT BE DOING TO UPHOLD THE TRUST AND CONFIDENCE THE GOOD PEOPLE OF GHANA REPOSED IN THE PRESIDENT TO DO THE PEOPLE'S WORK?"

WHETHER OR NOT THE COURT RECORDINGS OF THE PROCEEDINGS DENOTED THE PRESIDENT AS "ABSENT?"

WHETHER OR NOT THE PRESIDENT OF GHANA BEST INTEREST HAS BEEN PROTECTED BY HIS COUNSELS?

The trick employed is too complicated for people who are not mathematically inclined to appreciate, Atuguba did not appreciate the slightest intricacy of the columns and rows on the pink sheet, no wonder he was chastising Bawumia that no body had a PHD on pink sheet. so who designed? the pink sheet. Atuguba is a lawyer Bawumia is an economist/banker at the highest level so statistics is his bread and butter.

All the nonsense he wrote about Afari Djan doesnt raise him above anybody on the SC. If there were mistakes made by election officers in polling stations, which happens every where including the USA the beacon of democracy, (Bush vs Gore), remember? If these mistakes do not affect the elections so as to change the outcome, why blame the EC Director in such vile terms. It simply shows the the judges political learning which everybody knows.
