An electoral rule accepted by all parties was that no one should be allowed to vote without biometric verification. NBNV was the slogan accepted by all parties..Another electoral rule related to over-voting, where the number of votes cast exceeded the number of registered voters. Still another electoral rule is the polling station results must be certified with the signature of the presiding officer. None of the three was unanimously upheld.
If biometric verification is not that important then why did Ghana spend nearly $75 million and went through all that trouble for the biometric registration – even at the cost of some lives - if it was not going to be used in the election?
Ghanaians living abroad continued to be disenfranchised. They send home about $10 billion a year in remittances, which helps the economy. You want their money but their votes? • The registration period was shortened to two weeks (1 15 October), despite Ghana's Interim National Electoral Commission's own estimate of three months back in 1992. • Aliens were registered to vote exactly the same problem noted in the 1992 IFES Report. • Large quantities of fake registration papers were discovered. • The deputy electoral commissioner David Akanga reported over 2 million registration papers missing, although he later retracted this statement. • The names of thousands of registered voters in opposition strongholds were deleted from the register; in other areas names had been inserted. • Capricious shortening of the registration period to two weeks (Oct 1-15), despite the INEC's own estimate of 3 months back in 1992. • Reports of aliens being registered to vote -- exactly the same problem noted in your 1992 Report: "Thhere were reports that several people registered and casting ballots were not Ghanaian citizens" (Free Press, Sept 20-26, 1995). • Discovery of large quantities of fake registration papers: "Tension has been aggravated by the surfacing of fake registration cards in various parts of the country," The Ghanaian Chronicle, Sept 25-28, 1995; p.5). • Over 2 million registration papers were reported missing by the Deputy Electoral Commissioner, David Akanga, although he later retracted this statement.
Fifty-six years after independence, we act like children playing with fire. I must warn that the destruction of an African country – regardless of the ideology, religion or ethnicity of the leader - always begins with a dispute over the electoral process. Our next door neighbor, Ivory Coast, descended into chaos, savage civil war and carnage following a dispute over the Nov 2010 elections, We dodged the bullet this time around but will we in 2016? What if the losing candidate in 2016 decides not to go to the Supreme Court because it is politically biased and chooses to go to the streets or the bush?
It is imperative to clean up the electoral process and make electoral irregularities a thing of the past. Kofi Annan has called for electoral reforms. The Justices at the SC should have echoed this call. It is now left to the president or Parliament to set up a bipartisan commission to clean up the Electoral Commission

Why on earth couldn't the EC present the records from the barometric machines to support his claim that no one voted without barometric verification, id indeed, he wasn't lying? Of course, he simply didn't know what he was saying, as he wasn't there too!

Secondly, why couldn't the 1st and 3rd Respondents argued on the constitutionality of NBVNV, accepting that, they are all erred by agreeing to something like that? They totally failed to present any legal arguments against the NVBNV idea. NVNV should be simply verification by all means: barometric and Voter's photo ID. The manufacturers of that machine failed to embody a function whereby a code given to those registered can also be inputted to allow the details of the person to appear, just as is done at tills in the shop when the bar code strip fails to read. Once it is used, the machine locks you up and so cannot be used repeatedly.

NBVNV is simply unconstitutional. The justices who dismissed that relief acted correctly, ignoring the failure of the Respondents to act and argue properly.

In fact he Atuguba was so anxious he read a wrong judgement which was corrected after 24 hours in the books. Atuguba is treacherous, dishonest, and did not exhibit objectivity throghout the deliberations In fact if dotse a Kuffuor had not allowed his tribal affliations with Tsikata to cloud his objectivity Mahamah could have lost 4 to 5. THE PETITIONERS in their own right should have taken him off the panel. Isnt it ironic that Rawlings appointees: ATUGUBA, GBADEGBE, AKOTO BAMFO, voted deciding that NO VOTER INFRACTIONS TOOK PLACE in the December 2012 election and that the PETITION was without merit?. Since we have started ignoring constitutional provisions and filling them in with our common sense and logical analysis deem fit to us, we are creating long term pandemonium that will creat bigger issues than what we have today. How do we know that citizens who voted actually have their votes counted as they wanted? If the results is not signed it only means that is not authentic and anybody could have swapped the original result for another. But today is OK and i hope it shall be like that all the time, for your sake, Justice Baffoe.

What was the effect of the "Clerical errors" in an election in which the difference between the declared winner and the next candidate is less than 2%? The petitioner submitted clear evidence of "voting without biometric verification" from the 2nd respondent's OWN pink sheets. Doesn't the onus then shift on the respondent to produce the BVD machines to refute that? Why didn't the court insist in that?

Unfortunately, it seems the only discipline in which common sense works is science. Everything else is stamp collection!

Sorry Kobena you have lost it even in science you don’t use a small sample from a political stronghold to determine a whole.Determining Percent Composition requires knowing the mass of entire object or molecule and the mass of its components.

So its wrong to use a backdoor approach to hoodwink the judges by using technicalities to power.Sometimes I wonder whether you actually believe in what you say because some of your analysis beggars believe.

Whether you like it or not the courts have their principles which guide them and apart from the law common sense is also applied.There was no evidence of the petitioners allegation of padding the the presidents votes.The election was as well transparent so why do you want to win on technicalities.

In arriving at their decisions the courts recognize one of its major principles the role of equity in arriving at its judgements. Equity has always been the conscience of the judicial system and has always been charged with doing complete justice regardless of technicalities.

After reading these 94 pages of texts you may be armed with knowledge and clear understanding of the case. Dont take anybody's opinion. Form yours and be a judge yourself.

Since the respondents wanted to disprove the petitioners' case why didn't they present the remaining 2002, since they were the custodians of it?

For the judges, in my line of work if four out of five or 80% of my data flash a red light, I would certainly go back to review every available information there is, because that means millions of dollars!

Besides, Justice Dotse and to some extent Justice Ansah were the only ones who tried to put the SC's own questions and find answers to them.
That is my point. I don't particularly care who won the case. My concern is that we should begin to do the right thing in Ghana!

My point is that the Petitioners, with the limited amount of time at their disposal, looked at data from 24,000 polling stations that were available to them. Out of that they found 11,915 or 45.8% of them to have been affected by irregularities. From these more than one third or over 33.3% of the total votes cast in the election were found to have been tainted. If the difference between the winner and the next candidate is only about 2%, then surely an error of 33.3% cannot just be wished away.

And especially if after 8 months of examination, 80% of the reviewers raise red flags, then for the sake of thoroughness and the reviewers' own peace of mind ,it is worth calling for and reviewing EVERY piece of available information!

Tsastu's argument resonated, RETROACTIVE PENALTY. The Judge respects that and he is unable to annul votes of folks that have done nothing wrong. He could only ask for revote for those who were also disenfranchised because they could not vote due to the biometric requirements and machine malfunction. Unfortunately it was 5:4 and that is it.

What this judge is saying is that let every household get a basket during the elections and let all members of the household cast their votes into that basket. Let us count them at the end of the day and let us collect same across the country, count and tally then he who would get the highest number is declared winner!!. Look, there are rules that govern everything we do and if the rules are compromised in anyway it tends to affect the results and for that reason the game at worst must be cancelled and a new one started. How can voting with biometric verification be implemented in some part of the country not in other parts of the country? Let me tell Ghanaians that this judgement brings instant peace but in the long run it is problematic for the country. Henceforth, no matter the quality of the evidence, no one would seek the legal redress because judges simply "cannot annul votes" because the voters did not cause the problem. What a foolish judgement!!

If they were certain piece of papers or say, kontomire leaves, then it could be described as foreign materials because thy bore no resemblance to the ballot papers in the ballot boxes. Only fools will describe the same ballot papers as foreign materials since there was no wan anyone could identify them as foreign... See where wisdom resides? There is no election ever held the world over that does not have flaws. The most important ingredient there is whether those flaws should affect the outcome of an election. If the answer is no, there is no reason why such election results should not be upheld. Clerical and technical missteps should not be reason why a valid vote should be overturned or those voters who are affected by those errors, should be disenfranchised, which is what the NPP sought to do with their petition. They want peoples' votes to be cancelled (which is disenfranchisement), due to technicalities, but still want to rule over those same people, after throwing away their votes - granted that relief is granted.

NPP has poison in their hearts and are full of mischief.

Thank God people like this learned gentleman could see through the machinations of the NPP and threw out their petitions as lacking in logic, common-sense and fairness.

When the petitioners used the pink sheet as their primary source document to demonstrate over-voting, and you claim there were other source documents such as the voters register to completely prove over-voting, besides pink sheets, at some polling stations, the burden of proof shifted to the 2nd respondent to produce the other source documents, such as the voters register, to support their defence that over-voting did not take place. The failure of the respondents to demonstrate same at ALL the polling stations mentioned by the petitioners left the petitioners claim of over-voting on the face of the pink sheet unrefutted. Further, when Justice B B claims even where over-voting occurred, the numbers were insignificant. He could stated this so called "insignificant" number. Justice B B, from how many pink sheets did you find over-voting for you to conclude the number was not sufficient to affect the results? Just curious!!!

You are not qualified to be a judge because you cannot settle matters betwixt two parties. this tells me that Baffoe Bonnie did receive bribe from jon thief mahama. If you cannot annul votes why would you accept to be one of the judges? After every case, there the winning party is awarded settlement so that the losing party pays a price. Baffoe Bonny is not qualified to be a judge, period!

This is very shameful - he even agreed with Asiedu Nketia that there would be no over voting so far as the votes counted is not greater than the registered number of voters even if the counted votes is greater than the number of ballot papers actually given out to voters on voting day.

How can a judge be so myopic, no intellect and reasoning ability and these are the people who are suppose to interprete our laws. No wonder Ghana is beyond repairs.
