The development came to light when the Director in charge of Resource Mobilisation at the Ministry of Finance and Economic Planning, Mr Kwadwo Awua-Peasah, was subpoenaed to furnish the commission with copies of agreements on the supply of vehicles from the AAL to the said ministries.
Mr Awua-Peasah told the commission that the ministry had no records on the agreements in respect of the 19 ministries, departments and agencies (MDAs) that were supplied, and also had their vehicles serviced by the AAL.
After three years of non-payment, the AFRICA AUTOMOBILE is requesting the said amount being the accumulation of interest on the balance.
He explained that AAL went to court over the matter and obtained a judgment that ordered the said MDAs to pay GHc16 million to the company, but the failure to do so caused the amount to balloon to GHc618 million in a spate of three years.

Consider 9 judges deliberating on 6 claims. This gives 54 claim judgements. Of these, the petitioners manage to secure 12 claim judgements of the 54 giving 22%. The respondents secure 42 claim judgements of the 54 giving 78% of the rulings. Even the judges were not convinced with your laptop evidences. That is why some of the judges asked for RE-RUN in SELECTED DISPUTED AREAS which are still NDC strongholds. With this abysmal performance, how would the judges comfortably say the petitioners won the case?

The NPP should learn how to win elections at the polling stations and not through the back door with laptop evidences. The NPP erroneously thinks it has enough “legal luminaries” to hoodwink court cases in Ghana. Is it not possible that the NPP “legal luminaries” specifically instructed and coached some election presiding officers who are NPP affiliates how to commit the very same statutory violations in the nature of omissions, irregularities and malpractices so as to use this irregularity as a basis for a court case if the NPP lost the elections???? From the discussions at the Danquah Institute programme, it is evident that the NPP “legal luminaries are highly capable of such atrocities.

The NPP should bring out convincing policies that the electorate can identify with, not knee-jerk issues like the uncosted, ill-planned "Free education for all NOW" mantra. Ghanaians are discerning enough to know that such bogus policies won't fly in a nation that has no infrastructure and teachers to run the programme.

Also, the NPP presidential candidate, Akufo-Addo, has too many personal issues to settle and many Ghanaians including several from the NPP are not comfortable with him - from his personality, drug and certificate issues, high-handedness in dealing with diplomatic status of a former PRESIDENT OF GHANA, (Rawlings), lack of respect for authorities (Kuffour and NEC of NPP), divisive and warmongering (All-die-be-die) character. Admittedly, many NPP supporters voted for NPP parliamentarians and yet many voted against their presidential candidate, Akufo-Addo?

Okudzeto should help the NPP examine the causes of the electoral flop and seek for solutions. This kindergarten analysis of the SC judgement will not help.

If the NPP does not regroup, assess strategies, proffer solutions and launch out properly, it will remain in opposition for a very long time to come.

Anyway, the NPP court case is like hunting for whales with fish hooks in the gutters around the Supreme Court building - it just won't gel. OKUDZETO, SIT UP. NPP, SHAME.

OK, I am trying to understand this. Okudzeto Ablakwa says NDC won the case UNANIMOUSLY since the petitioners lost all the 6 reliefs sought. The former Ghana Bar Association President is saying NPP won 5-4. So this is my take: The petitioners lost all 6 reliefs (by 9-0 for 3 out of the 6 and 5-4 for another 3 out of the 6). In short they lost on all the 6 reliefs sought. This was what Ablakwa tried to use to explain his position, his only mistake was that he said NDC won UNANIMOUSLY. Sam Okudzeto has a poinnt when he says there were 5 Justices (out of 9) who found some irregularities and ordered re-runs. Looked strictly in the sense he is right. What he did not say was that, the SC looked at these 6 reliefs individually and NPP lost on all the 6 reliefs they sought. The 5 Justices who wanted re-runs of some sort, split their votes miserably there not commanding a majority on any of the 6 reliefs. I think that is how the SC Justices saw the outcome and that is why none of the 5 Justices has protested so far. The final decision was not only ATUGUBA's as some want to misinform readers here. The decision was a collective judgement of all 9 Justices.

This is my take, from a non-lawyer.

I have said it, and will say it again, that any other verdict but the one that was handed down by the SC would have been a gross miscarriage of justice. It is a pity that instead of people like Okjudjeto seeking to uphold the law and the constitution of Ghana, are rather fomenting distrust of the judiciary and trying to throw doubt into what was a lengthy, carefully considered process and which he and his lot claimed would strengthen our democracy.

What is wrong with Okudjeto? Does it mean that as long as his side does not win, then there is no justice? Isn't he in danger of disturbing the peace by giving fodder to unscrupulous elements in the NPP to on a rampage?

It is a complete disgrace to say the least, and Okudjeto had better stop this mindless, fruitless, unhelpful argument.

What analysis did he do that the justices and the rest of us cannot do? What about the analysis of ACTUAL VOTERS who cast their votes and whose votes MUST count? I would argue strongly in the same way if the positions were reversed and it was the NPP whose win was being contested by any other party. We must be seen at all times to uphold our constitution and for a so-called 'legal luminary', this is shameful!!!

I am sure Justice Baffoe-Bonnie's secondary school children will read his written judgement and tell him that he was not convincing.

I said right at the beginning of the proceedings that the Supreme Court had boxed itself into a tight corner by crstallising the petition into two issues. It the end, it did a very clumsy job by ignoring its own set rules.

If Sam knows the law properly without bias, he will be the first to admit that the action of an agent if it done within the authority granted him/her by the principal, those actions are binding on the principal and valid before the law.
The polling agents have been given a special role by the 1992 Constitution which is very critical but being ignored by many who don’t know the Law of Agency to the core. It is the major topics for a student of banking which I was sometime past.
NPP will have good grounds to contest this case if their agents protested and did not sign the results. To me the signature of the polling agents committed the party of the NPP. The signature of the presiding officer in my view was not critical as that of the polling agent. The polling agent represented the presidential candidate at the polling station on this occasion and his action was as valid as the the action of the presidential candidate.
Sam, this is not a moral case and as a lawyer I expect you to look at the case from a legal perspective. From the word go I have made the case that the case was a legal one even though I am not a law person even though I has studied various laws in the course of my studies. Right from the secondary school, my literature and history masters have advised I pursue law instead of science which I opted for at that time. My interest for law cannot be contested as of now. I know I would have been a great lawyer if I has taken that profession.
Sam, be fair to the profession you earn your living from. You are a member of the NPP through and through but lets be factual in our presentations unless we show ignorance.

There were nine judges. Five of the nine judges agreed in some shape or form with the petitioners that there had been irregularities, omissions, violations and oversights in the way the December 2012 elections were carried out. Four judges disagree.

Yet the chairman of the panel is so respectful to Ghanaians that he takes all of ten minutes to inform the whole country that the Petitioners' complaint has been dismissed 5-4. End of story. Return to business as usual.

As a country, we lack the power of analysis so even a Supreme Court gets things wrong. It is quite clear from Justice Atuguba's written judgement that they were never going to overturn any elections in Ghana. They saw the duty of the court as striving to sustain election results once declared. In this quest, the court failed to do a clean job and therefore left itself for criticism and that is what Mr Okudzeto is talking about.

The court set itself two issues to determine:

1) Were there any irregularities, omissions, statutory violations and malpractices that attended the 2012 elections; and

2) If there were any, did they affect the results as declared?

How did the Justices answer these questions:

Justices Atuguba, Adinyira, Gbadegbe, Akoto Bamfo - no or minimal irregularities and results are not affected;

Justices Ansah, Annin-Yeboah and Rose Owusu - yes there were irregularities in the form of voting without verification; no signature of presiding officers and over-voting and these affected the results as declared.

Justice Dotse - yes there were irregularities in the form of over-voting and no signatures by presiding officers and these affected the results;

Justice Baffoe-Bonnie - Yes there were irregularities in the form of voting without biometric verification and over-voting. However, only voting without biometric verification affected the results as declared.

Thus, in terms of the issues set out for trial, 5 of the Judges found that there were some forms of irregularities and that these affected the results.

This makes Justice Atuguba's summary inconsistent with the written judgement. How people cannot do this simple intellectual analysis beats me.

It may be that the Supreme Court wanted to dismiss the petition but they went about it the wrong way because they chose to vote on the categories of infraction instead of the issues set out for trial.

It is not surprising that very ordinary politicians go to buy aircraft using a warehouse in Cayman Islands as company address, and turn round to lease the same aircraft they have bought with the Ghanaian taxpayer's money to the government of Ghana!

From what I read about the election dispute records, I believe the judgement was erroneous. The judges in their argument believe that cancelation of the affected result is tantamount to disfranchising some voters. But I believe also that allowing votes affected with irregularities to stand is also tantamount to disfranchising the majority who voted for the true winner of that election. The best decision should have been the re-run of the affected polling station even if we have to buy the fact that Ghana was not able to afford the re-run of the whole election. Also it is hard to believe that Ghana would not have afforded the re-run of the whole election considering the GOLD RUSH of looting the nation coffers. The bogus judges and their incompetent president are the real cause of the economic depression not Akuffo Addo as alleged by some NDC sympathizers. Why should it took 8 months to come out of this bogus verdict? but just to pretend as if they are impartial. Don't take the bribery story regarding Asantehene for granted. There is no smoke without fire. That is why Ghana cannot progress because all our leaders are corrupt including even that Akuffo Addo.
