The Contractors Waterville should pay up the money. As a Public Interest case this should send a clear warning to all potential Contractors bidding for government contracts that make sure you read both then BOLD and SMaLL PRINTs. Secondly, if you allow politicians to help you circumvent national laws to win a government Contract, you don't have anyone to blame but yourself. This would help sanitise the system.

If these private Contractor is not forced to pay up, they would continue to use politicians to circumvent the law to win contractors illegally without any repercussions.

However if the law lays blame on them and make it known that as a private entity you would pay the price for the acquisition of contracts which did not go through due process it would serve as a deterrent for them to get politicians to front for them outside the the law.

What the SC has said in this case is that the onus of responsibility lies with the private company to ensure that it goes through due process to acquire government contract and that you would be responsible if that is not done. This would help clean up the Procurement System which in its current state politicians and their Watervilles have made nonesense of the law.

Waterville should be forced to pay up. It is in the national interest for them to do so. Clear warning to all future Contractors.

All they need to do is to get a politician and pay him or her to front for them to circumvent the rules and whether legitimate or not they get away with it for free. So what is the point of breaking the law if you can argue immunity. Everyone would use crooked politicians to break the law at will and our lawlessness would become worse by the day.

But when a company is aware that it has to abide by certain rules otherwise it personally would pay the consequences it would ensure that it does things properly before it signs up to a contract. This ruling would prevent crooked politicians fronting for companies like the Watervilles and help bring sanity into our procurement rules.

Waterville did put in a bid for a contract and was promised by a crooked politicians and some gov't goro boys but at the end of the day the Ghana Parliament which awards such contracts on behalf of the state did not award nor give any contract to Waterville. Waterville's case was that since they were "promised" of the contract they sought all the necessary financial assistance in the form of loans from international banks and therefore since they were denied they have to pay back the loans plus interest. This is the case they took to court and I don't know what kind of a judge awarded the judgement debt in their favor. So, in a nut shell there was NO CONTRACT BETWEEN Waterville and the Republic of Ghana period.

Governments don't deal with politicians as middle-men to sign contracts with companies. If a politicians was your agent to win a contract, that was proof enough that there was no contract to start with.

If the SC ruling is upheld it would stop companies hiring crooked politicians to front for them.

That politicians did not come upon this deal by accident. It was a deliberate ploy to get him involved by Waterville to circumvent the laws of the country.

Waterville is culpapble for violating the laws of the country and should pay up.

I don't support either political party but those who blame the NDC for paying that judgement debt are simply not being objective. This is one more revelation that Kuffour's administration was the most corrupt.
