Since you are that smart can you tell us how the election was stolen? I don't remember hearing that as one of the pleadings. No presiding officer appeared anywhere to say he/she did not sign because the results were false or he/she was coerced not to do so, nobody came out anywhere including all the NPP supporters to say that he/she voted without going through biometric registration, and none of the NPP polling against laid any complaint of over voting in any of the disputed polling stations. These are the processes that the NPP needed to dwell on if GENUINELY they felt they won the election. But they never pursued any of those courses because they will not help them. They simply relied on errors to get to power and thanks to the discerning judges who were smarter in ensuring that they did not circumvent the will of the populace.

During the petition hearing I used to listen to Maurice on TV3 and thought he was good and politically neutral. He praised the SC President profusely when he stabilised the country. I now feel completely let down.

I guess Justice Atuguba is bad and don't give a hoot about the petition's evidence on illegalities, irregularities, omissions, commissions, violations or malpractices that they claimed came across his desk hence his indifferent attitude even before the election petition trial, huh?

The year is 2013, digitally din dunged and none is ever going to fool us again with their cheap and bias talk just to mount the corridors of the presidency at our expense. It's all over, NPP, those days are gone for good, period.

Some of these NPP personnel anad lawyers must stop exposing their shallow mindedness (in fact half-bakedknowledge). Justice Atuguba was careful to qualify the statement with READILY. He didnt rule out a verdict that could favour the petitioners. I believe the use of READILY just presupposed that to get a ruling in their favour the petitioners needed to adduce overwhelming, indisputable eveidence backed by credible witnesses.

I would have thought lawyers undergo a careful rigorous selection process and subsequent intensive training prior to qualification. This election palaver has really exposed how superficial lots of thes supposedly learned fraternity chaps are.

This election case was not an ordinary/light weight case to be disposed off flippantly. The judges allowed this clearly baseless case to run for some 9months withthe petitioners flip flopping over specifics/ and essence of their accusations/allegations.

NPP grow up and be fair to the average Ghanaian and let us enjoy some peace of mind to continue with our "hussling". The case was blatantly bogus and had no bit of merit. Accept the verdict and move on. 2016 is upon us already!!!

I have heard several other interviews he has granted after the initial 'disaster',and his participation in the recent needless post-mortem panel discussion on the SC verdict,blew his cover as an ardent NPP sympathizer/member! The Supreme Court made John Mahama President not Electoral Comission. The SC knew what they were doing, the Judges can not overturn a decision the made only in Janaury 4.
People should stop undermining our Supreme Court and respect their decision. How stupid will Atuguba look if he breaks our Supreme Court Laws. Supreme Court decisions are always right in the eyes of the Law and we should respect it.
Swearing John Mahama as President in January can never be change. The Petition was against Electoral Comission not the Supreme Court. The SC had already decided and made JM the president. Its wouldnt be Supreme if thing decided by it can be change or overturn.
Ampaw should go back to school of Law and get some respect for our SC.

You may not agree with this but the way some of the SC judges upheld some of the reliefs really baffles me. That is actually the danger - that an SC knowing very well that the petitioners refused to bring presiding officers to explain why they did not sign, to appreciate the pink sheet as a complete document rather than look out for errors, to invite anybody including NPP members and the petitioners themselves who voted without biometric registration to testify or get their polling agents to agree that there was actually over-voting in the disputed polling stations. Nobody who has the public at heart should vote for any of these reliefs and that is why I understand how dangerous judges can be in this country. I would love to have a candid chat with any of those judges to see if they really believed that what they did was in the interest of the country.

I really did not know that Maurice Ampaw was an NPP surrogate. In any case the petitioners could not discharge the burden of proof beyond reasonable doubts to convince the Justices. It is simply a case of seeking the Presidency through the backdoor. Which election has ever been conducted without flaws. If the SC had sustained the petitioners wish, future elections in Ghana would been determined thru the SC. "Show me a sinless man and the fellow would be the first to cast the stone." I thought Dr. Ampaw was somebody who was fair and transparent as well as working to elevate the level of political discourse in the country? He has disappointed me indeed. He was one of noisemaking lawyers who chastised Tsatsu for his fair statements about Annin Yeboah. How do you reconcile Ampaw's statements about Atuguba vis-a-vis Tsatsu. Hypocrites.

Perhaps somebody (probably some layman) has to explain Justice Atugugah to the learned lawyer.
This is what the Justice said: “For starters I would state that the Judiciary in Ghana, like its counter parts in other jurisdictions, does not readily invalidate a public election, but often strives in the public interest, to sustain it.”
This statement is another way of saying that, it would take the petitioner to prove all his allegations beyond all reasonable doubts to reverse the EC's results. This is because, the EC holds a constitutional mandate to run an election in Ghana and duly declare the result. So if the SC reverses the EC's decision based on flimsy allegations, the mandate and relevance of the EC would be completely wiped out and this is a recipe of chaos.
For instance, let's use the following scenario in a presidential election. At several polling stations (whose total votes can affect the results), and a candidate through his agents at the polling stations complained about cheating, rigging or fraud and nothing was done about it by the EC. Then the polling agents protested accordingly by not signing the electoral records (or pink sheets) and filled the complaints forms. If the candidate proceeded from there with a petition to the SC, that will be a solid case.
Contrast this to what happened on 7 & 8 December 2012. There were no protests from the polling stations. But after the overall result was announced, one losing candidate set-up a task force to assemble the pink sheets and took advantage of the clerical errors and non-signatures by the presiding officers to make a petition. This is clearly a useless petition hence its dismissal. That is the import of Justice Atubugah's argument.

NPP had solid legal basis to demand his withdrawal but chickened out. Atuguba was not going to vote against Mahama and let his nephew lose his job. He was secretly communicating with his nephew who was passing on information to the respondents during the entire proceedings. He is a disgrace to the judiciary and is not worthy to be referred to as ajudge.

Dr Ampaw has exhibited a crass misunderstanding of how the courts arrive at their judgements and the rules that they follow.Every case that goes to the court, the court must premise its search for the facts or the truth with the presumption that the defendant or the accuse is innocence until proven otherwise.

Its therefore goes without saying that since the evidential burden and onus of proof lies with the plaintiff or petitioners,it is their duty to discharge that that duty on the balance of probabilities that their case is more probable than that of the defendant.Until then that presumption of innocence stands.

For the judge to start from that basis and for Ampaw to twist the normal process to mean bias and preconceived ideas is a very irresponsible thing to say by a lawyer.I have had the occasion of listening to some of his legal analysis on joy news so I am not surprise about his lack of knowledge on judicial reasoning.

The little I know about him suggests he is a legal lightweight and he should not be taken serious.If I have had any doubt at all about his legal credentials and weight it has been dispelled by his very partisan and cheap hype at this judge even more so his lack of in depth of the law.

Even with those regions NDC had managed to impact the result of what otherwise would have been declared a clean sheet outcome for NPP. Yes Atugubah made up his mind before the court proceedings because he was in Ghana and followed every news leading up to the declaration of the election results. To allow the legal tussle to rage on was therefore just a matter of formality and I believe very honest NPP followers saw a losing verdict coming their way. It is about time the party admits losing the 2012 election and start to digest what really went wrong. An olive leaf to Brobbey, Pianim, Asabee and of course the Doc. will be a plus for NPP. Best of luck.

I'm actually not surprise about the verdict because from day one this judge Atuguba or whatever his name is took sides in the case,i was rather surprise to hear Tsatsu saying one one of the jugdes made his polictical support ...

I'm actually not surprise about the verdict because from day one this judge Atuguba or whatever his name is took sides in the case,i was rather surprise to hear Tsatsu saying one one of the jugdes made his polictical support cloud his judgement,i wanted some of the leading members in the NPP to reply by saying exactly what they saw in the presiding judge,but they were all cowed to keep quiet because of contempt of court.This judgement has set a very bad precedent for future national elections, because whatever way you use to win the court cannot overturn it because a win is a win,and that can bring caos in the country.Nobbody wants to take his/ his case pertaining to elections to court anymore but rather look for all means to win the elections even if it will call for some innocent people's death.
I'm really glad this was telecast to the world public.We all saw the outcome of this election,but the supreme court didn't see anything wrong with it because maybe nobody died from it.The whole nation should thank Akuffo Addo for being a very peaceful politician.
