Instead we should be calling for a law that makes it compulsory for these officers to sign the sheets once the results have been declared.

The electoral rules make provisions to call back such defaulting presiding offices to sign if need be. If the NPP meant business, the party would have asked for a simple recount to justify their claims. It is sad to see a party ask firmly for 4 million votes to be annulled for Nana to be president. As a prof in law, that ought to have been obvious to him. Furthermore, cases were cited by justice Atuguba to back his opinion abt absence of signatures by certain pple not being a sufficient enough grounds to invalidate a document ie render it illegal or not binding.

If a Doctor does not sign a death certificate, the person will be dead alright but, the fact of his/her death cannot be used to legally claim/appropriate any of his/her properties without an authentication of the death by a signed death certificate.
More so, if you went to the pharmacy to buy certain category of medicines without a duly signed prescription form from a Doctor, you can have all the money in the world but, you cannot procure the said medication. It is only Ghana that prescription drugs are sold over the counter like any other drug. So please look for better analogies the next time you want to do a riposte.

Are people just stupid or they just refuse to see the dangers in the s.c interpretations of the laws is nothing but making mockery of the people who wrote the laws and saying that they know better. when the law say the presiding officers shall sign, the judges failed to acknowledge the importance of that and why it is necessary that they sign and so they think that the fundamental right to vote ends everything forgetting that there are humans and for that matter Ghanians that have to ensure that that right is protected in that without the signature, that right can not be said to have received the proper care and protection. what is achieved when some few people can change what that right is suppose to achieve. when that right is exercise it must show the will of the people and the signatures is part of the process that will have ensure that no individual or group of people could change that.

The position of the law is that after several years together whether properly married or not,you are entitled to all rights of a married person.No need for signed certificate.Lord Denning master of the rolls ruled on that in his epic case the the deserted wife's equity which has become part of common law.So you don't need a certificate to establish marriage.The relation between the two determines if is marriage or not and not necessarily a signed certificate.

The judges looked at it in this way, if the information on the original pink sheets were different from the copies which every party obtained then it affected the results but since every information on the original pink sheets match the copies how do you say it benefited one candidate?

My goodness, do we have another professor without sense of reality or critical thinking? Professor Kumado’s assertions are not only infantile but goes to show why the legal system is dead in Ghana and the GBA is not worth a hill of beans. Would the professor explain why if there are three or more signatories to a document, two-thirds of the signature would be accepted as sufficient? Would the professor explain why laws passed by parliament do not require every lawmaker to be present to make the enacted law valid? It is not only childish but a sign of political party partisanship that permeates Ghana's so-called intellectual class when they make these idiotic pronouncements. Nowhere in the statutes governing Ghana's electoral process does it mandate that without the signature of one person the votes cast there should be invalidated. As a matter of law and principles of common sense that can and should be adduced from the law, the presiding officer in his or her refusal to sign must affirm his/her actions with a protest statement. Professor Kumado ought to get his nose out of the legal literature he reads and let common sense prevail lest he become a mere Ghanaian with classroom earned credential that is worth no more than toilet paper.

We did not when the election. Simple and short. Let us not swallow hook line and sinker the inward-looking propaganda of our leaders. Whilst the NDC uses propaganda to capture power during national elections, in the NPP our champagne-popping cigar-smoking leaders have mastered the art of lting their own party faithful and rigging to sail though primaries but when it comes to national elections they are found wanted. Ask your self, did our candidate extend his campaign in 2012 to the Volta, Upper East and Upper West Regions or just concentrated on a few towns in the remaining regions, relying on media hype to do the rest. In a country of 70% rural dwellers media hype has a diminishing role in elections, their is no substitute for organisational effectiveness and grassroots feedback.

Our party chairman is about to introduce the most dictatorial amendment to the NPP constitution, just for the 2016 elections, as if he already knows who will be or must be the candidate. The warped winner-takes-all logic underlying the proposed amendment is that if the Presidential candidate is elelcted first, those who dont support his candidature can all go to hell. The Presidential candidate takes over the party structures from national, regional, constituency to polling station, and ward level (including party affiliated organs) so that he can prosecute the election as he pleases with any hindrance. Is that a democracy. What then happens when he wins with such a divided party?. Of course the logic is that he will continue to work with "only those he can work with". In effect the party is no longer a collective association of persons with a common philosophy and goal. Why should provisions be made for those who out of their own character flaws cannot reconcile and unit their political parties to capture power. Such infantile arguments should not be entertained after so much struggle to bring about democratic governance. Is this what we fought against the Rawlings Dictatorship for, i.e. just to finally introduce our own farcical iron-clad rule over political parties, make and mockery of time-honoured principles and label our selves "democrats, patriots and intellectuals". A sad day it will be when Chairman Jake reads out the proposal at the National Council meeting of all places.

The constitution provides that parliament debates and enact an act, and the president of the land is to sign before it becomes a law. So if the president does not sign the parliamentary proceedings does it become a lwa, Justice Gbadebe? Certainly the presiding officers has far more weight and responsibility than party agents. Parties MAY appoint pooling agents, but the EC SHALL appoint the presiding officers. I believe in the law dictionary, may is discretionary, wholes shall is mandatory. We know that not all political parties had pooling agents in all pooling stations, but the EC had Presiding Officers in all pooling stations. Why is that so? This is because without a presiding officer an election cannot be held, even if there are party pooling agents. Gbadebe is therefore totally wrong and should be ashamed of himself, so also all the others who think like he did.

If none, what will be happened in the future elections if the judges happened to annul innocence voters votes? These officers are not permanent workers for EC but recruits. So, if officer is a party sympathizer, and knowing well his or her party is losing, wouldn't he/she refuses to sign just to get the results annul and get away with it? So if there is no punishment for an officer who refuses to sign, then how do you want the judges to impose punishment on innocence people who did nothing wrong? If NPP happened to prove that the entries on the original pink sheets were different from their copies then yes, the results needto be cancelled and call for re-run but not a situation whereby all the entries are the same. Polling station results are counted and displayed publicly before they are recorded on the pink sheets so the absence of presiding officers' signatures does nothing to devalue the results. If the petitioners' argument was that the results on the unsigned pink sheets were wrong figures, they would have a good case.
The majority Justices did not rule that signatures are not required in official documents. To suggest that this was what majority Justices meant in their ruling shows a naive interpretation.

This is indeed shocking especially coming from a judge who is rather being naive and sensational. What is the value of a signature and why did the constitution stipulated that the returning officer must sign? Without the returning officer's signature, the document is but ordinarily paper without weight. How did the honourable justice know that the votes on those pink sheets were genuine but not somebody somewhere who had accumulated the figures? The only sure word in this is that the returning officer has confirmed by signing the document. Is really a dangerous precedent these justices have cowardly set and we shall surely reap the fruits soon; and I do hope that these justices will live to see the consequences of their actions.
