Am having great difficulty in seeing the point in zeroing in on the CJ, at this point. The pro- petitioners always seem to think that with CJ presiding, the outcome would have been different! Not clear where this perception came from, except they think she is or was a sympathizer to the petitioners.

Like most sensible people on this issue excluding the Cameron (pun intended), I hate to find myself commenting on this issue. The bottom line so easily overlooked by the likes of Cameron Duodo, is the import of the decision. What I heard and can still read is that, by a majority decision, the president validly won the election. Equally importantly, by an unanimous decision, the court rejected the main motion before them which was to declare the petitioner the winner. To a judge, the decision the best case for the petitioners was a re-run in selected areas. Administratively, this meant they would have been back in lap of the EC! how that would have worked in practice and administratively, we would never know!

The conclusion I arrive at is that, everything being equal the participation of the CJ WOULD NOT HAVE MADE ANY DIFFERENCE TO THE MOST IMPORTANT OUTCOME, WHICH WAS A RE-RUN IN SELECTED NDC STRONGHOLDS, AND THE POSSIBLE CHAOS THAT WOULD HAVE CAUSED.

So, Mr. Vulture journalist, many of us who live in Ghana believe all is well that ends well. Your CJ strategically perhaps did the right thing, with hindsight, and has saved the country in ways which might not be obvious to fellow VULTURES!

This tongue-in-cheek indictment of the role of the Chief Justice in constituting the election petition panel is quite appropriate. Why the CJ recused herself from chairing this important panel in the most significant case in the history of our country is a continuing befuddlement to most of us. She has not even found it worthwhile to explain to the nation the reasons for her recusal from the case. It is in this light that I find her totally deserving of the honor just bestowed on her by the highly esteemed Cameron Duodu. She indeed let country down.

Don't you think it is time we moved forward and sought better ways of dealing with our electoral impasse in this country without recourse to such bogus cases of redress? As I am sure you have yourself observed over a period, the NPP's electoral loss was at the 'ballot box'. not the 'polling station, and to expect the Supreme Court (whatever the composition of the paenl of justices) to turn the results in another person's favour whould have resulted in the very violence, chaos and mess up which Cameron Duodu refers to in Kenya, for which this CJ was involved in helping them resolve.

I agree with him the whole issue took too long and should have lasted not more than 2 weeks. I also believe and have argued consistently that it should have been dismissed, for a number of reasons even including procedural and arithmetic errors on the part of the petitioners, their shifting position from their original charges and accusations, to relying on administrative errors on pink sheets which really was more than just trying to catch at straws in my view.

Cameron Duodu in writing this piece has let himself down once again, and only shows his consistent disdain for any other party except his being in government. That particular mindset is worrying and frankly leaves me concerned that we can have such people who rather than seeking the fairness of our electoral process (whoever wins the elections) and seeking to admonish his party to address their own internal problems and find better ways of engaging with the electorate and campaigning to win elections, will resort to such 'below the belt' punches on the CJ.

I am surprised to see it as tongue-in-cheek. It is most certainly uncllaed for now (whatever his motive for writing it), especially at a time that all of us (you included) have sought to ask people to have a more positive outlook and work in the collective interests in the coming year in the interest of our nation Ghana.

I thoght theirs was to establish the veracity of any case brought by petitioners and to provide sound direction about the best cause of action to remedy such grievances. So, in this case applying the same rules of football, are you not familiar with a referee and a linesman disagreeing on a call, yet the referee who has the whistle rules the day?

And what has this to do with GYEEDA and the rest of your beef? Let's not allow our 'personal loss' which did not occur at the court but at the polls, to cloud our vision of reality, the constitution, the law and how to apply them.

Let`s no forget the fact the this Lady chaired a board of enquiry which looked into the disappearance of a huge shipment of narcotics into this country in 2007,came down with findings that have gotten us nowhere!
I take comfort in the fact that eminently qualified Statesmen like Justice VC Crabbe[Codeo],and Fmr. Pres. Obasanjo of Nigerian,who witnessed things on the ground,first hand,signed off on the outcome of the 2012 presidential ballot as being credble and fair;so I do not know what else the CJ herself,could have done to alter the situation on the ground! She sensed the 'trap' that had been set for,and rightly side stepped it! Could this lady get herself involved again in an election dispute,given what later became 'public knowledge' in the Atta kyea tapes? Some of you sore losers can continue to goad her into committing 'judicial suicide',but I believe she is now mature enough to determine what is best for her own future as a Jurist,and that of this nation!
Btw, how many among the 'gang of four' or it is four and a halh,if you listen to Gabby Asare Othere Darko and other,were bold enough to to say that Akuffo Addo won the elections? And you think the CJ,Goegina Wood,as an individual would have able to 'install' Nana Adoo into the Presidency? The award should have been given to some who has some sense and respect the Laws of a country.
She is the most evil person to be give anything to do with honesty. The woman who brought ghana to its knees for seven months plus because of the doubt she put in John Mahama and his govt heads about the petition by Nana and co.
Any award should have been given Nana Akufo Addo for his respect of the Laws of ghana during the petition cause by Georgina Wood.
NDC, John Mahama, NPP, Nana Akufo did not do anything wrong about the petition, it was the evil woman and the supreme court who messed ghanaians for not doing their job well. How can a person like Georgina Wood ever get an award. Shame to those who elected her.

Is Cameron Duodu suggesting that despite all the accolades he showered on Ghanaian Justices (including the Chief Justice), that somehow we lack high quality Justices to adjudicate in such cases in our country?

Is he suggesting that the panel constituted was of poor quality and that the chairman of the panel was not fit to lead the panel?

Is he suggesting that the issues of contempt of court and the polarisation and increasing chaos that was unfolding in the country because of recalcitrant and rude GHanaians TAKING TO THE AIR WAVES IN THE NAME OF "PARTY" AND "POLITICS" SHOULD HAVE BEEN LEFT TO CONTINUE TO DIVIDE THE COUNTRY AND CAUSE CHAOS?

I agree with him that the case perhaps should have taken a much shorter time - perhaps two weeks as he suggests and in my opinion, based on the constitutional provisions, the case should have been DISMISSED within those two weeks because it was BOGUS, not based on any strong evidence of WRONG DOING on the part of any of the parties involved, but a matter of administrative errors on the part of electoral officials and the poor oversight of party election agents, a matter which could easily have been resolved by simply going back to those constituencies and making sure that the so-called signatures etc. were appended.

It was a case that some counting / tallying errors which could easily have been corrected occured, and which the electoral commission had rectified themselves in their own final cross-chekcing of the polls.

It is shocking to read this from Cameron Duodu of all people (except for its sattire) but should anyone be surprised? He has been consistent in his preference for certain types of government and party and so gives the impression here that his disappointment stems more from the failure of the justices to rule in favour of his own side.

He still tries to create the impression that the judgment was biased, wrong and inconclusive which is not only an attempt to rewrite the facts and history, but one of self-deceit in my view.

Is Cameron Duodu seriously telling us that based on the fact that the justices, wanting to ensure that every apparent 'stupidity' and nonsense was properly exposed to ensure that their verdict in the end was clear to even illiterate Ghanaians had taken an unduly long time to go through the process, makes them culpable in perpetrating an "injustice" in his eyes?

Surely Duodu can do better than that!!! Why try to ressurect a dead horse at this time when everyone is calling for national unity and a brighter 2014, a fresh start if you like for all of us? Is this the way Cameron Duodu reviews the year?

Sir, you have a reputation, built over many decades, of being a well known and accomplished journalist and writer, but this is most disappointing for an elder statesman like you Cameron. We don't need this.

Cameron Duodu must behave his age and try to protect a reputation of yesteryear.We know he is of the Danquah Busia camp but one would have thought that for his own good commenting on matters of such national importance, he will at least be objective and ride above partisanship.Unfortunately he failed himself and his reputation and chose to play politics with this very important event.

As to his question whether Lord Dening would have reacted to the contempt of court provocation, my answer is yes otherwise he would be undermining the authority of the courts.Lord Denning himself was not without controversy and had to resign for making rude remarks against blacks.More so most of his latest judgements have been overturned because of the flaws in it.

Perhaps old age is taking premature toll over Cameron Duodu sense of judgement and if I were him I will sit back and live on my reputation rather than damage it. If he is no longer capable of making sense and unable to make balance and reasonable objective analysis, then it is time for him to retire rather than see the pathetic side of his old age.

What this 'gentleman' is saying here is that the CJ, should have sat on the on the panel,and tipped the decision in favour of Nana Adoo and the NPP;when the results on the ground clearly indicated otherwise.
This is a shame,and goes to show the level of 'subtle inertia' which has been created in our polity,built solely along ethnic and personality cult lines.
I am only a few years younger than Cameron Doudu,and remember the kind
of positions he expoused as a journalist way back in the 60`s and 70`s. The good thing is that like the proverbial "NYINS3N",he has shown us his true colours!
I just hope that talkative JDM will will gird his loins,listen to good counsel from the likes of Martin Amidu,and prove the naysayers wrong!
I am not too sure he appreciates the fact that many of the fairweater friends and family wish him well, and are anxious to see him succeed!

I am not as old as you but Cameron Doudu has never been a fan of the Danquah-Busia tradition. Remember Prof Busia sacking him from the editorship of the Ghanaian Times(?) for his advocacy of "Dialogue with South Africa?" Ultimately, it was dialogue that won the day for South Africa, thus vindicating Busia.

The porous Electoral Petition judgement of 29th August was a disgrace and will be a blot on Ghana's judiciary, not so much as to who won, but the manner in which the judgement was delivered. That is a fact that has become a huge legal joke around the world!

Ivory Coast and a few other African countries at the time had "dialogue" with South Africa but did that make any difference?

At the time, even the US where you reside, and Britain (the latter because of their own commercial interests and feeling that the balcks were a lower caste) supported the wicked apartheid regime which was brutal in its oppression.

You seem to forget that for over 3 decades, it was the constant agigation, desperate violence and organised chaos to disrupt the apartheid government's running of the country, plus the fact that the rest of the world and in particular well meaning individuals and common peoples all rallied and put pressure on all these governments that helped win the day.

Aren't you also forgeting that the unified global anti-apartheid movement and its support, constant reminders and making sure MANDELA was always in the press that helped keep him alive and ultimately won him his freedom?

Why do we try to re-write history when the facts are there and clear for all to see? I think we sometimes make too much of Mandela's own part in his freedom and his success. To me his greatest strength as an individual is his constant and consistent DIALOGUE with the apartheid authorities seeking to let them see reason and the logic in hsi arguments that all south Africans are the same and that there is more power in the collective than one race being superior to the other.

In fact, Mandela's philosophy is bourne out of the fact that today's divided South Africa and the wide gulf between the poor and the t=rich stems from the apartheid regime's failure to see this logic and to 'equalise' the system for all South Africans to develop and build their country.

The fact that he was magnanimous in "victory" and sought to forgive his enemies is a mark of the man, but to suggest (as president Obama wrongly did in his eulogy) that the man somehow succeeded more or less on his own and through his 'guts' is much more further from the truth than many care to admit.

The millions of unsung heroes in Mandela's legacy have been ignored in my view. It is the school children who contributed pennies and a few dollars for the cause, the various charities and peoples who stood and marched in front of South African embassies all o=ver the world, the numerous people who wrote and condemned the apartheid regime's brutality and those brave people who smuggled terrible atrocities and images which were published in the press to press home the point about what was going on.

It is the countless school children who were massacred inthe name of freedom and in the name of Mandela!!! Whose name were these innocents chanting when they went out marching? Is it not Mandela's? What did Mandela really do in prison? You tell me what he did. Did he march?

It was the likes of the leaders of the pan Africanist movement who suffered abuse, torture and death in the name of freedom in South Africa. Steve Biko's life and ultimate sacrifice (you were nearly such a matyr yourself at one time) which was made into the famous classic film did a lot to shed light on the South African case and Mandela's own safety and freedom. Don't you think?

By the way have you visited Sharpeville to see the evidence of the school children who went on the march and were massacred for speaking about freedom and wanting to have a standard (not Bantustan) education?

Please with all due respect, let us be very careful not to support people in the wrong way or to seek to rewrite the cause of history. Simply put, Camron Duodu was wrong to suggest dialogue with South Africa at a time when they were not listening and frankjly, it was not going to make a dent in any thing.

Please note that finally, it was when the whole world shunned South Africa p- from Sports (remember the cases of the West Indies and English cricketers who became outcasts for going to south Africa to play?), the trade embargoes, and finally the forcing of Britain, US and other strong nations to tow the line of the anti-apartheid movement that gave sway and allowed the opportunities for dialogue!!!

Why do you seek to go back to a historical past which was unwise and wrong? Much as I have very little4 respect for the achievements of Busia's government as an enthosiast of contemporary African political history, I think Cameron Duodu was wrong, and Busia's government should not have engaged with South Africa.

The fact is Cameron Duodu has had a great career and I respect him for that. However he has made many mistakes and continues to make them such as in this case.

Do you Kobena suggest to us that NPP lost the elections at the ballot box or at the polling station?

You are a politician I admire and rather want to do well, but equally, I am critical of you because you let me down countless times for reasons such as I have expressed here and I am writing this more to you, than to the general readership. You need to be careful with your analyses and utterances.

This whole nonsense of over-dwelling on Lord Denning is becoming a farce, if you ask me!!

I have been away, but this seems to be a very interesting debate. for starters, as far as I remember, Busia only advocated dialogue as way of engaging the Apartheid authorities. He came to power in 1969, shortly after Sharpville, not too dissimilar to our 24th February Castle Road shootings? There was no indication that he was going to start it himself.

Everybody who cared to know at the time knew that the UK, US, Germany, and Israel (with whom we incidentally had a very cosey relationship) were all actively supporting South Africa militarily and thwarting all attempts at the United Nations, to bring the Apartheid regime to the negotiating table. Was that really different from Kwame Nkrumah's mission to Hanoi? I don't believe so.

In the meantime, the western countries were arming South Africa to the teeth. South Africa only destroyed its chemical weapons arsenal after Mandela came to power. And those Afrikaans were prepared to use those chemicals, if it was the last thing they did.

So which African government was going to fight that kind of war? Where do sports, trade and cultural boycotts fit in the scheme of things, if not in peaceful opposition? How many of the western youth that protested in the streets of London (myself included), Washington DC, New York and other western capitals would have volunteered to fight in South Africa if it was all down to armed struggle?

As for the Election Petition, we can have 20 million opinions as Ghanaians, but the manner in which the judgement was delivered and the details and reasons given by some of the judges are nothing to write home about. What is wrong can never be right at any time or place, unless of course, we let the politicians bamboozle us into believing that a goat can suddenly become a cow! To keep the whole country in suspense and bungle on the announcement of the simple votes of just 9 judges is nothing anyone should be proud of. That is what Cameron Doudu was talking about, and I don't believe is wrong on that.

Also, if the poor taxpayer has to fork out millions for the EC to present such illiterate results to Ghanaians, then we might as well resort to show of hands! Something went seriously wrong with Election 2012, and like Ananegate, Woyome, GYEEDA,and other corrupt things that go on in our country, unless we are all prepared to discuss them dispassionately and find solutions to them, our country is not going anywhere. That is my worry as a citizen, and someone whose business taxes are simply poured down a bottomless hole by clueless politicians.

You seem to underestimate what the decades of concerted efforts, demonstrations, sit-ins and pressure of governments contributed to the overthrow of the apartheid regime. I will still strongly argue that many are the martys who fought and contributed immensely to Mandela's very survival and apparent success.

I'm afraid Cameron Duodu's argument is a very biased, one-sided one and that is what some of us are arguing against.

I support 100% what he has written and I have myself written profusely on the concerns he has raised here.

Which of these paint our judiciary in the right light?

1. The refusal of the Chief justice to preside over the most historically important issue to be heard in her court.

2. The appointmnet of a justice who never went through the ranks (District to Circuit to High to Appeal Court judge) to preside over such an important case.

3. The lack of a reading by each Justice and the given of reasons why they voted either way. This was the time any Justice will pride showing his/her legal reasoning. But we got a whimper of a ruling.

4. Getting the vote tally of only nine judges wrong.

5. Referring to citizens who are also stakeholders in society as 'mere' you

6. The pronouncement by the Presiding Judge that a court's duty is to 'strive to sustain election results' rather than overturn it. Thus indicating the case was pre-determined even before the hearing.

7. The legal excursion all over the world in search of precedents, thus ignoring what abounds in Ghana

These are not elegant happenings. It is not about the verdict, which some of you appear to misunderstand. It is about showcasing what our country can do and offer to electoral jurisprudence.

On the above grounds, I really share Cameron Duodu's sentiments. If you have followed court rulings elsewhere (especially the Pinochet case in the UK and how each Law Lord delivered his ruling), our Justices have a lot of catch up to do.

Each Justice is regarded as a legal authority and what they say, even if not in the majority, has something to offer precedence. What occurred in Ghana was a disgrace to our Judiciary.

Please get me correctly here - I have no prblem with the ruling if it had been delivered forthrightly with legal reasoning or authority. It is the manner in which it was delivered that has given rise to all the speculations about the honesty of some of the Justices.

I do not belong to any poltical party but I voted in the 2012 elections. I witnessed that electoral officers as well as party agents were bribed and therefore overlooked all the malpractises that went on at the polling station I casted my vote. Where are the great men of this great country when the country is sinking.
