Unfortunately, Moses Brew was recuperating from a lorry accident and, therefore, directed that the cheque be issued in the name of G.K.A African Trade Service, a company owned by the MP, George Aboagye.

I was initially wondering why Mr Brew directed the money to be issued in Mr Aboagye's company name but further information provided in this article revealed why it was done that way.

"According to him, the family agreed to charge Ghc10, 000.00 for an acre of land but he, as a businessman, sold an acre for Ghc15, 000.00."

Let's stop jumping into conclusions. The MP might be an NDC MP but if what he is saying is the truth, then the family has no case against him.

He has every right to the money if the family agreed to sell an acre for Ghc10, 000.00 and he as a businessman was able to sell it at Ghc15, 000.00.

He is also right to deduct taxes from this sale as the sale was done through his company's name. Even if he has sold an acre of land for 30,000 Ghana cedis, all the family was entitled to was the 10,000 Ghana cedis they agreed to.

Ghanaians always think they are cheated when they enter into business contracts and later found out the other party made a profit from that transaction.

Let's wait before we make judgement.

My understanding is that the land had already been sold by one agent and it was at the first installment payment stage that the MP was instructed to receive the check on that agent's behalf. The point of the MP selling the land for 5% more is therefore untenable. Furthermore, it appears the purchasers had already deducted tax from the amount payable. Please note that 25% of 4,000,000 is 1,000,000 so if the vaue of the check is 800,000 then there is a missing 200,000 which could possibly be tax already deducted. The MP definitely has lots of questions to answer.

1. Did Mr Moses Brew, CEO of BREWMO who is the agent agreed with the family that due to his health status Mr George Aboagye the MP was acting on BREWMO's behalf to collect and pay the funds to the family? Because the family's agent is charging for the provision of their services to the family. Reasons must be provided why a cheque was issue to a third party without the beneficiary's consent. Why was the cheque not written directly to the family? There could be a deal between the BREWMO and the MP.
2. Is the MP's company tax collection agent for Internal Revenue Services who is mandated to collect taxes for the state? If that is not the case, then criminal charges must be made against both the MP and his company for unauthorised collection of state tax.
3. The MP's claim that he struck an extra 5% deal on his own during his time in GIPC contradicts the tax reasons for the deductions. More so, was GIPC his personal company to be used for personal deals? Is GIPC informed about it?
4. Since 2012, has the MP paid the tax deductions to the taxman if the tax claim is true.
5. Even if there is legislation in Ghana for taxes to be paid on capital gains, how much gains was made by the sale of the land? Or do we pay inheritance taxes in Ghana?
6. Etc etc etc etc...............
I think the family should not "perfect" the title deed as agreed with Oceanic until every dime they are entitled to is received from Oceanic.

I can answer this question for you. Since the cheque was issued in the name of his company, it is his duty to deduct his fees and taxes before giving the rest of the money to the owners since if the owners did not pay taxes, his company will be held responsible.

This is where the MP's defense of the tax deduction excuse might crumble if he did not pay the so called deducted taxes.

The MP's company was given the responsibility to sell this land at Ghc10,000 an acre and as a businessman, if he was able to sell the land at Ghc15,000, then he is entitled to the extra money unless he was paid a fee upfront or accepted to sell the land for ac acceptable fee.

Eg, If the MP accepted Ghc20,000 as flat money to sell the land on behalf of the owners, then he is not entitled to the extra money but if he accepted to sell the land without any fees but as a bailment or on consignment, then he is entitled to the extra money.Actually the cheque was 860,000 not 800,000 but you have a point about 25% of 4,000,000 being 1,000,000 so 140,000 is missing but read the article again. The MP was given only 860,000. I don't understand why the buyers should deduct taxes if actually the 140,000 was deducted as taxes.

Mr Aboagyes's reason for acting the way he did raises some issues:
1. As the CEO of the GIPC, his main official duty was to "promote investment" in Ghana. So identifying and bringing to Ghana, such an investor fell directly in his line of duty. The Centre's duty was to match the investor to the family and to facilitate the sale of the land AND also to assist the investor to establish the establish the business. But in this case, Mr Aboagye sought to create a "business" in his line of duty as a CEO of the Centre, for his personal benefit. This raises a very serious issue of Conflict of Interest-he facilitated the sale of the land at an extra price to pocket the extra amount, when he was performing his duty as the CEO of government's main Investment Promotion Agency. In fact, some criminal charges can be preferred against him.
2. Can his company really account for the withholding tax it charged?
3. If Mr. Brew Moses knew about the extra sales price and didn't tell the family, then, I can say Mr. Brew was not truthful to the family. If he was not well, couldn't he have invited the representative of the family to wherever he was to issue the cheque?

The bottom line is: Mr. Aboagye could not have used GIPC to create any business for his personal company whiles he was still in office. In fact, he couldn't have established any such company to provide any form of services to any investor brought into the country by the GIPC.

That statement implies that the only means by which he came into contact with the investor was his office as a CEO of GIPC. As such any business he transacted with the investor, thereof, was made by that initial "GIPC contact". Thus the date of transaction is immaterial.

Of course, we have to wait and hear if Mr. Aboagye will come out and say he was "misquoted" or what he said was 'misconstrued".

With a purchase in the millions of New Ghana Cedis, one would expect that the initial deposit on the offer would be made in trust to a law firm representing representing the seller which is refundable if the transaction falls through(does not close) for any reason.For example, if there is a dispute over title. The balance payable upon closing. Why would the purchaser pay the deposit to a person or company that is not a party to the transaction. What if even a penny of that money never made it to the sellers. The buyers would have themselves to blame.

If the Land was valued at GHC 10000 an acre, why is he, a person supposed to facilitate smooth transactions on Ghanas behalf taking advantage of the Family by adding 50% of the land cost and pocketing the difference. First ask yourself why Mr Brew did not instruct the other company to issue the check in his business name but that of Mr Aboagye's company?

Second, the company that issued the check would not have issued the check in Aboagye's company name if it has no contractual obligation. If you know the law of. Contracts, you would have known tbat no company will issue a check to another company for payment of a property.

Third, look at the dates the contract was signed and the date the check was issued. Was Mr Aboagye the CEO of GIPC when this transaction took place? There is no information you can glean from the information provided here for anybody to conclude there is a conflict of interest here.

Mr Aboagye might have contracted with Mr Brew to sell the land on behalf of his company on contract of assignment if you know Business law and Mr Aboagye can sell the land above the stipulated price of 10,000. Cedis and keep the difference.

I am not an Ndc apologist and because I don't like them does not mean I should not be objective. Blind support or hate breeds idiots and you are in the incubation idiotic factory. Have a good day.

How did the money end in Aboagye company's name? No company will issue you a check of that amount if he was not a party to the contract. His reasons make a lot of sense than what the family is saying.

A fruit farmer hired two new workers for his fields, but before he sent them out for the day's work, he told them he had just one rule: don't steal any fruit. The two agreed to obey the rule.

After the day was over, the two workers came in to report to the farmer. He asked them if they had stolen any fruit, and immediately their conscience forced them to tell the truth.

"Yes, we did. We ate some when we got hungry," they said.

The farmer replied, "Ok, here is your punishment. I want each of you to go pick ten of your favorite fruit and come back to me."

The men couldn't believe their ears. This seemed more like a reward than a punishment!

After fifteen minutes, the first thief came back with ten Grapes. The farmer promptly told him that as part of his punishment, he would have to stuff each Grape up his nose. The thief was upset about this, but he knew he had done wrong, so he slowly began to push the cherries up his nose one by one.

As he was working on the third Grape, he began to laugh hysterically. The farmer asked him, "What's so funny?"

Each one of Ghana's members of parliament is a businessman or woman yet they do not produce, manufacture and or development anything of value but are very good at using inside government information to form and register businesses knowing of a pending procurement package where they will become such suppliers of finished products in need by an agency within the national government.
For an MP to be accused of acts of moral turpitude he should be removed from parliament. Oh but of course this is Ghana where even cocaine smugglers sit in parliament and or are welcomed as heroes in our dear political parties.

Christine Agbagba is a 14-year-old girl who attends Asukawkaw Evangelical Presbyterian Primary School in the Krachi East of the Volta region of Ghana, West Africa.

She is a Christian and a member of the Evangelical Presbyterian Church, Ghana.

A hardworking, serviceable and cheerful girl. She is a stout member of the Christian Youth Builders at Asukawkaw.

Three years ago, a small growth was detected in her breast. This has resulted into the situation you see in pictures.

Some attempts were made by parents, well wishers and the Asukawkaw district of the Evangelical Presbyterian Church, Ghana for the correction to be made but could not yield full result.

At the time of writing this piece, the medical report cannot be traced. According to the parents, philanthropy took it with the promise to help. The parents are still trying hard to reach him through the contact he left behind.

Per my assessment and a chart with the parents, they had exhausted their little resources and the only hope left is the GRACIOUS MERCY OF GOD through somebody like you and me.

It is on this ground that I am calling on all to join hands to put smiles on Christine’s face.
