Involuntary manslaughter is the unlawful killing of a human being without malice aforethought, either express or implied. It is distinguished from voluntary manslaughter by the absence of intention. Involuntary manslaughter is treated as a felony and usually carries a jail or prison sentence of at least 12 months, plus fines and probation. OR a 10 to 16 month prison sentence, which increases if it was committed through an act of reckless conduct. (Dzamesi later got to know of this, demanded his fair share of the extra cash, which led to a scuffle, during which Koffie picked a shovel and struck him several times in the abdomen and other parts of the body.)
In making their determination, judges look at factors are those that increase the severity of the crime and include things such as the defendant's history of reckless behavior. the defendant's acceptance of responsibility for the crime and lack of criminal history.

Stephen Dzamesi died due to incompetence and negligence of the hospital.
how on earth did this health care facility missed to diagnose the internal bleeding of the patient,Mr Dzamezi.
These kinna situation is prevalent in ghana's health care delivery system. there are various contributive factor to mr Dzamezi's demised and the most obvious one's are poverty, unqualified personnel, culture of corruption and decadence of the country.
i suspect the victim was neglected at the hospital due to his status, he couldn't bribe his way for proper care, hence was given some APC( pain killer) and discharged to go home and died.
these death is avoidable if empathy, compassion and due diligence was
done. sad to say but this is tantamount to murder by the health care professionals who were suppose to administer a quality care to Mr Dzamesi
shame, shame, shame, this is indictment to the whole health system.
RIP STEVE.

I don't think it is 1st degree Murder, but second degree. Because it is not 'premeditated'. This is the legal situation that if the guy had a good attorney would have gotten like 20 yrs with some parole possibilities. He did not intend to kill the poor work friend but beat him to shown him he deserve to keep the GHC20.00, It is a show of strength and superiority you know, lifting and laying of blocks is not easy and i think this guy may have been doing more of the work than his body so he saw the extra cash as a reward for his more work done than the victim. Very unfortunate but is not Murder to the highest degree. It is not fair to keep all the GHc20.00 to begin with but beating the guy to death was totally outrageous and should be punished severely for that however death by hanging is very stiff for this case base on the evidence in the story unless there are other factors like a history of such high level of aggression or even killing in the past.

There is no.denying the autopsy report in this case. Internal bleeding from a blunt tool/shovel. Evidently, William koffie didn't mean to kill dzamesi becos he could have done that with the shovel right there. Why didn't he? Becos, koffie simply wanted to get back at dzamesi for cheating him of the 20cedis, not kill him? We are not disputing the fact that this blunt tool led to death and that is why this is an involuntary manslaughter.
