According Article 60 (11) of Ghana’s 1992 Constitution: “Where the President and the Vice-President are both unable to perform the functions of the President, the Speaker of Parliament shall perform those functions until the President or the Vice-President is able to perform those functions or a new President assumes office, as the case may be.”
Now, there's an obvious lacuna in the law which needs to be interrogated and cured, because the very clause is silent or non-descriptive or offers no clue as to what it means by "where the President and the Vice-President are unable to perform the functions of the President".
Are we to submit that, the President or Vice-President acting in their normal constitutional capacity as the President and the Vice-President outside the jurisdiction of the country, constitutes an inability to perform their functions as a President and a Vice-President?
Article 60(11) of the 1992 constitution, needs to be qualified or totally scrapped, because the present interpretation being sought for that clause to include, the President or Vice-President acting outside of the jurisdiction of Ghana, serving as the basis for swearing in the Speaker of the House to act as the President and the Commander-in-Chief of the country, makes a mockery of administrative governance.
Specificity should be brought to bear on article 60(11), to make it relevant.

Clearly such an action doesn't in anyway clip the wings or the power of the President, which the constitution affords him.
The constitution clearly needs some provisions to be amended to rein in the unbridled power of the Presidency akin to a benevolent or quasi-dictatorship, but swearing in the Speaker, when the President and Vice-President are out of the country, and acting in their various capacities, does not address that issue of the unbridled power of the Presidency, afforded it by the constitution drafted in 1992, for the militaristic and despotic tendencies of the then military junta leader, Jeremiah John Rawlings.

In my estimation that clause need not be shrouded in any ambiguity, subject to all forms of interpretation, because the issue of inability to perform their duties, has not been defined, and exercising their mandate outside the country, should not be the underlying basis to swear the Speaker in as President, when the factum probans has not been established, to rule out their inability to perform their duties as defined by their mandate and by the constitution, via technology or any other means outside the jurisdiction of the country. I stand to be corrected though.

Interpretation and Meaning ought to be given to absence as a result of inability to perform the functions of State, and absence as a function of performance of the duties of state.
They are two different premises, and that ought to guide the swearing in of the Speaker, when both the President and Vice President are out of the country, and should be codified in our statute books ie the constitution to make it binding and of effect.

The two leaders are only out of the country still representing Ghana as the President and vice respectively. The articles only become applicable when they are simultaneously not capable of performing their duties in times of debilitating illness, coma, under anaesthesia and/or death.

In the same sense, you don't study and graduate for anyone but for yourself. Nobody can hold these positions for you in your absence. It therefore does not make any sense for any educated person to make such an analogy. If it is true that the speaker of our parliament made these comparison, then we are doomed. We don't have an intelligent and a wise speaker, period.

For instance, the GNPC has mortgaged our crude oil for a loan(bypassing parliament raises an eyebrow), some of which will most likely find its way into private bank accounts,and deny us a full impact of the loan on the economy,and you are not over-blowing it? What are you doing about the suspected over-invoicing of the road construction contracts(interchanges and all that)? What about the glorified stealing of our monies in the public sector which is getting out of hand? John Mahama and his HOPELESS NDC government are taking us for a ride.Like Dr. Amoah said,they think we are fools.They know Ghanaians are toothless bulldogs who bark a great deal,but do not bite.Hence the rampant display of arrogance and the brushing aside of our welfare,which are pointers to sheer ignorance.The privilege to decide for us does not confer on the government absolute authority.In countries where they can afford referendums,the very pertinent issues are decided by balloting which is nothing but seeking the mandate of the source of authority of the government which is the electorate.In situations where balloting is not feasible,constituency meetings for thorough dissections of the issues in question are the order of the day.
Chapter 8,article 20 which sparked off the controversy looks a little ambiguous.If the framers had inserted 'any time' or "any moment' the president and vice-president are absent from the country,the speaker of parliament should take the oath of president and act as such,we would not have been distracted dissipating our energy on an argument which will not reduce the rate of inflation,fill up the knee-high potholes which is needlessly claiming innocent lives despite the gigantic borrowings,make loans available to the private sector easily and cheaply,increase our seriously depleted foreign exchange reserves,provide social security to our pensioners, and end the dumsor and the water today,no water tomorrow,and is of no consequential relevance.
Though,there is freedom of speech,one's utterances should reflect brilliance and,most importantly,wisdom.
