I think it is unhelpful to build mountains out of molehills at a period when Ghana is conspicuously bankrupt and being devoured, on a piecemeal basis, by severe and unprecedented corruption in the public sector.So avoiding the trivial stuffs will make the discourse to make Ghana better than we met her simple.

The speaker has sworn in so anytime both the president and VEEP are outside the oath that the Speaker sworn automatically becomes effect... let me ask one question, let assume both President and vise are out today and the Speaker swears in and one of them comes tomorrow and leave again, will you be expected the speaker to swear in again? The swear in takes place one time but in case for some reason the Speaker is also not available then whoever is next on line, swears in. If the argument that that lawyer,Kwaku Baako and other people proclaim is valid then why Mr. Mahama does not swear in again when he comes back to take over from the Speaker? There are some people in Ghana who are bent to use their energy on unnecessary issues instead of important ones. Most of them are useless that's why we are always step back as far as development is concerned.

The Ghana Criminal Code and the 1992 Constitution are silent on specific definition of the two offences and punishment.

Mahama is the sitting President.Adjaho is not the President but could be elevated to the Presidency in absence of the President and his Vice in the Country.And that elevation is Void when any of them is back or present in the Country.So to cut it short,the scenario is :Adjaho was elevatedt to the honor and position of Acting President when the President and his Vice are absent from the Country. Adajho comes back to his Position as Only the Speaker of Parliament and not both as the Speaker of Parliament and Acting President simultaneously.So Adajho
is addressed by the Word "Acting" President when both Mahama and his Vice are out of the Country, and not "THE" President ! The word "Acting" is there to show/qualify him(Adajho) as not the Real President but to Satisfy a Caretaker Constitutional Provision Protocols. Therefore it would be out of place for the President to be Sworn in again after a Trip outside the Country because someone acted on his behalf.It can't be possible,Simply because he is the actual occupant of the Throne/Seat. I think if on arrival back in the Country of Mahama(the actual Prez) the Speaker of Parliament-Adjaho is simultaneously not a acting President,then it implies that Adjaho's honour and position as acting President is Automatically Nullified or Terminated, non and Void on arrival in the Country of the President.
So when the President is leaving the Country again, the Speaker of Parliament has to be sworn in again to the Position and Honour as the Acting President of the Country.Anything short of that is a relaxed Protocol and Adjaho could be overlooked as not the acting President,because the first sworn in is Void.Let's put it this way.if when the President is in the Country,Adjaho Cannot Sign for and on behalf of the President,then Adjaho is not an Automatic Acting President,and becomes Acting President only when he had been Sworn in as soon as or minutes before the President leaves the Country.Therefore, Sworn in is required whenever both the President and his Vice are out of the Country.
Again,the number of times Adjaho acted as President should be on paper or well documented for Statistical data/
purposes.And where do one get the document ? From the office of the Chief Justice,right ! Simple.
If that harboured School of thought is right,then there's not the need to Swear in an incumbent President who has won elections for a Second Term.Because he had been Sworn in before. So, if that is the case,why is it necessary to Swear him in again the second time ?
That School of thought does not make Sense,and need not generate into unnecessary discussion.Hon Adjaho should do the right thing and not to rely on his own flimsy understanding !
This has more to do with "natural everyday law"(life) which does not require a MA/MSc in the subject to know or understand.Anyway.

The constitution says "the Speaker shall before commencing to perform the functions of the President under clause (11) of this article take and subscribe the oath set out in relation to the office of the President".

Okudzato is out-dated with his interpretation and should upgrade it.

All these nonsense of swearing in of Mr. Adjaho as acting or interim President in the absence of the President and his Vice makes no iota of sense. This democratic system of government was imported and as such we have to comply with or do what the owners have been doing and working effectively for them.

In the situation in question, both the President and his Vice are just outside the country on government business so Mr. Adjaho do not need any swearing to act on their behalf. This is temporary other than when a calamity had occurred to make both the President and his Vice incapable to be in office for a long period of time or completely dead.

Cheers, I am just ordinary being sharing my thought. Where are the so-called learned judges - Atuguba and others and their interpretations? E&OE.
