THE WOYOME CASE: I AM BAFFLED.

The date shows that I first wrote the piece below on 14 Feb. 2012 in reaction to the brouhaha surrounding the Woyome and Co. judgement debt payment. I am NO LONGER CONFUSED ABOUT IT but still as baffled [and roundly just as cynical] about it as I was then regardless of the recent unanimous Supreme Court decision in the case brought by the former Attorney-General, Martin Amidu, against Woyome. Honestly, I am puzzled why he chose to sue only Woyome in view of my concerns expressed as far back as Feb. 2012, which concerns are still valid today, and which concerns some are just waking up to. After all, Woyome had told the whole world how he shared the booty and Waterville even took him to court for taking too much for his "expenses". And Martin Amidu wanted him to refund that money and the SC ruled that the money should be collected from Woyome alone?! How?!

All of a sudden, to all and sundry, Woyome had accomplices who must be arrested too and prosecuted! Are they just waking up from a deep slumber? To the Brotherhood of Nitwits that dominate Ghanaweb on the NPP side of the hood, the case was and must be tribalised (the culprit must be an Ewe) and politicised (it must be an NDC conspiracy to loot and share)! So, Woyome was the perfect fall guy who just fit the bill all too well: an Ewe and an alleged NDC financier, presto! Gosh! Did they relish and wallow in it? Forget the fact that Woyome was magnanimous in his largess. Even my former roommate and erstwhile NPP Gen. Sec., Sir John, got a car from him, for legal services rendered, of course! I must ride in that car by all means one day! Ha! Ha! Ha!

Meanwhile, here's what I wrote and published then. The issues raised then were just as topical as they are now but practically everybody were blind to them, and the comments and write-ups I am reading now hardly address them. Methinks, others cannot see the handwriting of the Costra Nostra all over this case, or they are just scared of the Mafiosi and so concentrating on only the hitman?

WOYOME CASE: I AM CONFUSED!

Honestly, folks, I've been wondering if I am the only person who is confused and cannot understand how Woyome allegedly defrauded the state. Reading through the jumble of information from government sources, including the EOCO Report, correspondences published by the press, and the tons of verbiage by self proclaimed judges and moralists who have poured out their venom on Woyome and all associated with him, I am still left puzzled how and where fraud emanated from. Maybe I might have missed something due to the information deluge, with so much dissonance in it. So I am writing this to seek some clarity.

Methinks, if you filed a case in court, believing in your rights as it were, and you won the case in the face of equally competent legal experts before a judge, or in this case when the defence threw in the towel, believing that they have a weak case, how can that be a fraud? If his claims were fraudulent, then it behoves upon the court to throw it out after the defence had shown stiff opposition and defence. If the defence claimed they had a weak case and did not defend and negotiated a settlement, how can that be a fraud on the part of the plaintiff? Payment to the wife of the Chief State Attorney? Naaw! A smart person can explain that: we were planning a business venture together! Tall tale? OK, in Ghana, we all know that plaintiffs and defenders alike and seekers of public services show “appreciation” for services well rendered. It is a pervasive part of the Ghanaian conundrum. So the payment could be an honest show of appreciation for the way and manner the Chief State Attorney handled the case expeditiously. But if the “weak case” claim was just a contrived and dubious copping out by the senior officials of the Attorney General’s Dept, in tacit collusion with Woyome, then I expect not only Chief State Attorney Neequaye-Tetteh and his wife to be under arrest and so charged. The A-G herself and her assistant, Barton Oduro, must also be in the dock for collusion and abetment of a “gargantuan crime” against the state! Or, have they claimed that they were fooled by Neequaye-Tetteh? With such a big sum involved and they never bothered to review the papers for themselves before going on the debt collection mission for Woyome? Were they so daft that they thought they could pull off such a rip off without detection in the future? I pray, if indeed they acted in collusion or they were conned, whatever is the case, then I put it to you that, that is one more solid evidence to support my hypothesis that idiotic thieves and/or morons have been ruling us!

Then, another puzzle. Some said there was no contract but we have read several times mentions of a contract being signed! They also said the alleged non-existent contract was not in Woyome's name ( ha! so there was a contract after all!) and hence he couldn't claim, but that is a porous argument, as obviously, Waterville and the other parties in Austria had given him power of attorney to collect the 2% fee for financial structuring of the loans that did not eventually materialise. Woyome in his own press statement claimed that 1% of the money he collected was to go to the Austrian consortium. But the consortium withdrew from the deal, they said, but was it after the “illegal” and unconscionable abrogation of the contract by President Kufour personally, just as many other contracts were unceremoniously and recklessly terminated by his regime at great cost to the nation, or before? Clarity, fellow Ghanaians, clarity!

I haven’t read anywhere that any documents presented by Woyome were forged, so I presume the letters of authority he presented from Waterville and whoever were genuine ones. So if there is no claim to be made, as claims have been made that Waterville had already been paid by the Kufuor regime for the abrogation of the contract and for work already done, especially at El-Wak, should the owners of Waterville and the Austrian consortium not be hauled to court too, [since Woyome in a public statement mentioned them as sharing in the booty too. Remember?]. I have gleaned that Woyome was their errand man. Or, am I wrong? I need some explanation here. I beg!

A lot of hot air is being blown over this case but I am not excited by it at all. Maybe it is because I am used to the gargantuan ripping off of Ghana since the early 1960s, to the really massive losses Ghana is taking right now due to the unconscionable oil block sell-outs under the shameful C19th mercantile trade-like agreements our brain dead and egoistic “leaders” have formulated; for the dubious assigning of their cronies to the oil companies as local partners and whatever bribes they are getting. Makes total judgement debts paid so far puny in comparison! But most Ghanaians seem to be totally oblivious to this fact! It is indeed pathetic to be “developing people”! So when are Ghanaians going to reach the mentality of developed people?

BTW, can someone locate the news article in which Betty Mould boasted of payments of judgement debts resulting from the NPP's actions as one of her achievements? She claimed she had saved the state many millions by re-negotiating such debts. That was last year, when she was still the A-G. And to think that Rawlings and the wife Konadu wanted such a woman to team up with Mills in 2008! Foisting two such disasters on us as President and the Vice! Wallahi!

Those of you close to Rawlings should tell him that he is screwed up and should stop trying to make decisional outputs on Ghana, as we don’t want any further disaster emanating from his judgement of persons, including that impostor Patrick Agboba he has been trying to impose on us Anlos as Awoamefia since 1999! Next time he should turn up in court to solidarise with him.

We all heaved a sigh of relief when my sister finally went on retirement from the A-G Dept. recently. We were counting the years, then the months and then the days! I know my even saying this small thing here will make her go into tantrums, she being the totally apolitical type who does not like to be drawn into anything political or controversial!

The former president is just being emotional,Woyome is not a thief,he was actually involved in a transaction with the government of Ghana which they didn't dispute only that the contract was not approved by parliament which was not his fault,contractors don't go to parliament to get approval before contracts are awarded to them but it is the government that has to go to parliament to seek approval for contracts.
As for the money whether he deserves it or not that is a different ball game which should also be blamed on the people who signed off on that,he got the money through judgement,he didn't steal it unless we want to call the judge too a thief.
How can you charge somebody for financial lost to the state when those who caused the financial lost in the first place are all walking free?
Why are we blaming the president and the current Attorney General for those charges when it was during President Mills and Amidu's time those charges were brought?

The former president is right on the prosecutors but this problem is not caused by either the president or the current Attorney General.

The Accra Fast Track Court ruling does not set aside the Supreme Court ruling that said Woyome should return the money.

No court in Ghana is higher than the Supreme Court and cannot overrule its decisions.

The civil ruling by the Supreme Court stands without any effect from the Fast Track court ruling which is a criminal decision.

The state of Ghana should proceed immediately to seize Woyome assets both home and abroad.

The issue is not about the courts and how it functions as an institution but if in fact the actions of any individual or a body in govt have by their actions prevented THAT rule of law to work as it is suppose to.States prosecutors can kill a case before it even gets to the courts by refusing to present crucial evidence to be judged on and that is what clearly happened here and who do you blame if not for the attorney general and his department.THE REAL QUESTION IS WHY THEY CHOSE TO RESTRICT EVIDENCE.

The fast track judgement does not mean he doesn't have to pay the money back. The fast track case dealt with the criminal aspect only. Woyome has already been found guilty on the civil matter by the Supreme Court and this judgement does not render the Supreme Court decision irrelevant.

There was an opening at the local zoo. Upon inquiry, he discovered the zoo had a very unusual position that they wanted to fill. Apparently their gorilla had died, and until they could get a new one, they needed someone to dress up in a gorilla suit and act like a gorilla for a few days.
He was to just sit, eat, and sleep. Of course, his identity would be kept a secret, and no one would be the wiser, thanks to a very fine gorilla suit. The zoo offered good pay for this job, so the man decided to do it. He tried on the suit and sure enough, he looked just like a gorilla. They led him to the cage; he took a position at the back of the cage and pretended to sleep
But after a while, he got tired of sitting so he walked around a little bit, jumped up and down and tried a few gorilla noises. The people watching him seemed to really like that. When he would move or jump around, they would clap and cheer and throw him peanuts. And the man loved peanuts. So he jumped around some more and tried climbing a tree.
That seemed to really get the crowd excited. They threw more peanuts. Playing to the crowd, he grabbed a vine and swung from one side of the cage to the other. The people loved it and threw more peanuts.
"Wow! This is great," he thought. He swung higher and the crowd grew bigger. He continued to swing on the vine, getting higher and higher and then all of a sudden, the vine broke! He swung up and out of the cage, landing in the lion's cage that was next door.
He panicked. There was a huge lion not twenty feet away, and it looked very hungry. So the man in the gorilla suit started jumping up and down, screaming and yelling, "Help, help! Get me out of here! I'm not really a gorilla! I'm a man in a gorilla suit! HELP!"
The lion quickly pounced on the man, held him down and said, "Will you be quiet! You're going to get both of us fired!"

Just yesterday i read a comment about how one cannot win a police case against the powerful and rich.In deed the writer went on to boldly state that the police have been used by high profile politicians and public officials to bully and victimize others mainly through monetary inducements not in the corridors of power.My experience with the justice system of this country following my brother's resolve to suit Ghana Health Service for illegal and wrongful dismissal leaves much to be desired.To be honest with you any country with a porous and fragile justice system is a lawless country with heightened insecurity.The lackadaisical attitude of law enforcement agencies(the police and the judiciary) supposed to uphold justice will definitely drive this country into anarchy in the near future if care is not taken.It is quit obvious we are now dealing with a selective justice system full of ambiguity and bias,with one favorable law reserved for those with the affluence and influence in the corridor of power and another unfavorable law reserved for the ordinary Ghanaian.Unfortunately for the ordinary Ghanaian we are usually the unfortunate victims of malicious persecution by the powerful and rich.But any time we heard to the police or court to seek redress we are surprisingly left in the cold with awe by those supposed to ensure justice with the rich and powerful having the last laugh,after all the laws of Ghana is their bonafide property.I had a root shock in my life when the Director General of Ghana Health Service Ebenezah Appiah Denkyira dubiously forged a mental illness on my brother based on which he dismissed him in less than month of assuming post as the new DG.My brother became an obvious victim of the corruption in GHS when he was very vocal against corrupt acts killing patients whiles management enriched themselves.It was quiet obvious Appiah Denkyira made my brother a scapegoat to cover the rot by dismissing him with the excuse he refused compulsory assessment and treatment for a mental illness.When my brother suit the GHS to fight a criminal and illegal act there we realized the sort of justice system we have in this Country.My brother had his live attempted on two occasions,often received messages of death threats and became a target of public abuse and incessant harassment in an attempt to criminalize and incriminate him.Letters personally delivered to the police headquarters(to both the PRO and IGP) requesting police inquiry into his case yielded nothing with the police turning a deaf ear on him in the midst of his life under serious threats.My brother suffered incessant abuse and maltreatment by court staff and was even told a number of times his docket could not be traced in an attempt to frustrate him and gag the case in favor of Ghana Health Service.Everything in this suit against GHS pointed to an incredible act of corruption and illegalities by powers that be against somebody fighting against corruption maiming and killing patients whiles a corrupt management enriched themselves.For the Director General Ebenezah Appiah Denkyira to falsely accuse a subordinate of a mental illness dismissed him with copies of his letters to then Health Minister Alban Bagbin just because he was vocal against corruption smacks of corruption and illegality of the highest order least expected of people supposed to uphold highest moral esteem in our public institutions.The bribery scandal that cause the death of one Patient Sakpetey because she could not pay a bribe of 50 Ghana Cedis for blood transfusion widely captured in the media among other heinous illegalities in that hospital died a natural death under cover with those supposed to institute investigations and disciplinary action bottle neck deep in the corruption syndicate by turning a victim into a villain to cover the rot.I am not surprised at all the same Attorney General who indicted the GHS for 8 million Ghana Cedis financial malfeasance this month is now running away in the case between the doctors and the GHS at the fast Track High Court because of a possibility of judgement debt as a result of negligence,recklessness and irresponsibility on the part of the hierarchy of GHS.In my view the AG Department of Ghana wielding too much powers usually decides which cases to prosecute and which judgement debts to pay by influencing judgement on behalf of government.The worse culprits in most cases are Heads of Public Institutions.The situation where government institutions are left of the hook for all the wrongs done because of backing by Government is the major reason why corruption is pervasive and judgement debts inevitable.If there is one thing Ghana should do to enhance justice and minimize corruption in public institutions is to ensure we have an independent Attorney General without the ambiance and manipulation of Government.There is no doubt Ghana has a draconian system of justice that ensure white collar criminals involved in heinous acts of corruption and illegalities walk of free because of their links with the corridors of power and the Governments interest in protecting its image when it comes to the issue of payment of judgement debts.I can understand why Chairman Rawlings is so furious as this will be an abomination during the revolution days attracting capital punishment.It will be impossible for any group of persons to gang up to defraud the state in this manner during the PNDC era.But that is the beauty of a nebulous and sham democracy in Africa and for that matter Ghana which we must unfortunately painfully cope with.It is only an indication that corruption has been institutionalized and fighting the canker now is herculean task certainly requiring political commitment as key factor.

There was an opening at the local zoo. Upon inquiry, he discovered the zoo had a very unusual position that they wanted to fill. Apparently their gorilla had died, and until they could get a new one, they needed someone to dress up in a gorilla suit and act like a gorilla for a few days.
He was to just sit, eat, and sleep. Of course, his identity would be kept a secret, and no one would be the wiser, thanks to a very fine gorilla suit. The zoo offered good pay for this job, so the man decided to do it. He tried on the suit and sure enough, he looked just like a gorilla. They led him to the cage; he took a position at the back of the cage and pretended to sleep.
But after a while, he got tired of sitting so he walked around a little bit, jumped up and down and tried a few gorilla noises. The people watching him seemed to really like that. When he would move or jump around, they would clap and cheer and throw him peanuts. And the man loved peanuts. So he jumped around some more and tried climbing a tree.
That seemed to really get the crowd excited. They threw more peanuts. Playing to the crowd, he grabbed a vine and swung from one side of the cage to the other. The people loved it and threw more peanuts.
"Wow! This is great," he thought. He swung higher and the crowd grew bigger. He continued to swing on the vine, getting higher and higher and then all of a sudden, the vine broke! He swung up and out of the cage, landing in the lion's cage that was next door.
He panicked. There was a huge lion not twenty feet away, and it looked very hungry. So the man in the gorilla suit started jumping up and down, screaming and yelling, "Help, help! Get me out of here! I'm not really a gorilla! I'm a man in a gorilla suit! HELP!"
The lion quickly pounced on the man, held him down and said, "Will you be quiet! You're going to get both of us fired!"

I am outraged as a native of Ghana. Imagine how much 50 million plus cedis would do for a hospital, district, or school. When is the state going to appeal this case? Where are the first rate lawyers who are in the attorney general's dept? This case reflects our crown of shame. Why would anyone want wealth at any cost. You can go into industry; engage in industrial farming or fishing; you can build and sell houses; you can engage in manufacture. How can we not be in genuine business? Must we steal and steal to appear wealthy? What are we trying to prove? This case shows our national shame. Now we have a law court that dismisses this case on technicalities? I prefer to live with modesty and a free conscience than to take what does not belong to me. My personal integrity is not for sale. I am angry at this legal quandary that the country had to be dragged through when the outcome has been predictable and anticipated by the culprits.

And if I may ask, what did his government do with those sales proceeds? Can he point to anything, say, an investment in an infranstructure- roads, railways, ports, airports,etc -that was completed during his almost twenty years of ruinous rule?
