The proposals put forward by IEA for constitutional reforms are the best possible ways of strengthening our democracy, and democracy starts with free, fair, and credible elections. Anybody criticizing or unwilling to accept them must have a self-serving agenda that is not in the interest of Ghana and its development. Our weak institutions can easily produce a "constitutional dictatorship" difficult to get rid of.

Those who have genuine and pertinent alternative views and ideas must come out and tell Ghanaians what they have, and should not hide behind to sabotage their adoption and implementation. The proposals, in our view, could reduce partisan politics and strengthen democracy and the rule of law in our country if adopted. On the other hand, if we dare reject their implementation or drag our feet, we will continue to grope in darkness with disastrous consequences.

"Private legal practitioner, Samson Lardy Anyenini late last year brought a suit on behalf of the leaders and against the Chieftaincy Minister whom they alleged had supported one Osofo to mistreat them using national security.

The Osofo was named in the suit as claiming right to the symbolic stool and skin created by the national house of chiefs to reintegrate disaporians.

Samson says that suit was withdrawn earlier this year after the Attorney-General (A-G) called for an amicable settlement."
The question is if the government has declared the status of the US citizens as an illegality, why did the Attorney General beg that the issue should be withdrawn from court. The answer is simple. Withdraw the case, kill the Afro Americans and case die.

There are those in the EC who think they would decide who rules Ghana and not Ghanaians, well those people must be exposed and weeded out immediately.

One joke about Mahama is that he keeps creating the impression that he is fostering peace in other West African countries while at home there is at least an undercurrent disquiet about the way the EC operates and he seems to not care at all.

Mahama is a man who keeps deceiving even himself so how can Ghanaians possibly believe him?

Many of the EC staff were appointed by NDC so it will be difficult for them to be honest and neutral managing the commission. There should be total overhaul at EC to bring back sanity else nothing will ever change

IEA is a wing of NPP and is doing the work of NPP.Because Sulley is a Northerner, heads must be cut in EC.IEA is not the only group of intellectuals and have NO MANDATE to speak for all Ghanaians.They should shut up.

THIS IS BECAUSE SILENCE A TIMES IS GOLDEN.

PLEASE, REFER TO THE ARTICLE AND THE ACT ESTABLISHING THE ELECTORAL COMMISSION AS FOLLOWS:

Act Establishing The EC

Articles 43, 44 and 45 (1992 Constitution)

Article 43. (1992 Constitution)
(1) There shall be an Electoral Commission which shall consist of -
(a) A Chairman;
(b) Two Deputy Chairmen; and
(c) Four other members.
(2) The members of the Commission shall be appointed by President under article 70 of this Constitution.
Article 44. (1992 Constitution)

(1) A person is not qualified to be appointed a member of the Electoral Commission unless he is qualified to be elected a member of Parliament.
(2) The Chairman of the Electoral Commission shall have the same terms and conditions of service as a Justice of the Court of Appeal.
(3) The two Deputy Chairmen of the Commission shall have the same terms and conditions of service as are applicable to a Justice of the High Court.
(4) The Chairman and the two Deputy Chairmen of the Commission shall not, while they hold office on the Commission,hold any other public office.
(5) The other four members of the Commission shall be paid such allowances as Parliament may determine.
(6) If a member is absent or dies, the Commission shall continue its work until the President, acting on the advice of the Council of State, appoints a qualified person to fill the vacancy.
Article 45. (1992 Constitution)
The Electoral Commission shall have the following functions.
(a) To compile the register of voters and revise it at such periods as may be determined by law;
(b) To demarcate the electoral boundaries for national and local government elections;
(c) To conduct and supervise all public elections and referenda;
(d) To educate the people on the electoral process an its purpose;
(e) To undertake programmes for the expansion of the registration of voters; and
(f) To perform such other functions as may be prescribed by law.

Article 46. (1992 Constitution)

Except as provided in this Constitution or in any other law not inconsistent with this Constitution, in the performance of its functions, the Electoral Commission, shall not be subject to the direction or control of any person or authority."

THAT ARTICLE 46 OF GHANA 1992 CONSTITUTION AS PROVIDED ABOVE CLEARLY SHOWS THE POWERS AND AUTHORITY OF THE ELECTORAL COMMISSION "---- shall not be subject to the direction or control of any person or authority."

THEREFORE, IF THE ELECTORAL COMMISSION IN ITS CONTINUES PERFORMANCE OF ITS CONSTITUTIONAL DUTIES AND HAS THE RESOURCES NEED NOT TO SEEK PERMISSION OR AUTHORITY FROM ANY PERSON'S" OR ORGANIZATIONS BEFORE DISCHARGING ITS CONSTITUTIONAL OBLIGATIONS UNLESS THE COMMISSION NEEDS RESOURCES OR ADDITIONAL RESOURCES TO PERFORM ITS CONSTITUTIONAL OBLIGATIONS THEN THE ELECTORAL COMMISSION NEEDS TO SEEK THE PERMISSION AND AUTHORITY OF APPROVAL FROM THE PRESIDENT, OTHERWISE, THE EXECUTIVE AND PARLIAMENT, THERETO.

THAT THE RIGHT TO VOTE IS A RIGHT OF AND FOR ALL ELIGIBLE VOTERS AND IT IS THE CONSTITUTIONAL DUTY OF THE ELECTORAL COMMISSION TO REGISTER ALL ELIGIBLE VOTERS AND TO COMPILE THE REGISTER, THERETO.

THAT THE ISSUE THEN IS "WHO THINKS HE OR SHE IS MORE IMPORTANT THAN OTHER ELIGIBLE VOTERS AND TO BE REGISTERED AND OTHERS TO BE DISENFRANCHISED?"

THAT IT IS ONLY THE ELECTORAL COMMISSION GIVEN SUCH CONSTITUTIONAL POWERS AND AUTHORITY TO REGISTER ALL ELIGIBLE VOTERS AND THEREFORE THE ELECTORAL COMMISSION AS "INDEPENDENT COMMISSION" TO BE GIVEN THE "FREE HAND" TO DISCHARGE ITS CONSTITUTIONAL OBLIGATIONS, THERETO.

THAT AT THIS JUNCTURE, I AM RESPECTFULLY OBLIGED TO REST MY CASE AND ALSO TO WAIT FOR FURTHER CLARIFICATIONS, IF THERE IS ANY, THERETO.
