It doesn't matter whether this idiot doesn't have the HIV virus, he still admitted having anal sex with an underage boy and as such, he's GUILTY for sexual abuse of a minor. Don't use his HIV status as an excuse to throw away this case.

  Ask yourself this question: Why would anyone who says they were sexually abused in October 2013 at Kasoa make a decision to go with the alleged abuser for a second round of painful abuse 6 months later at Alajo in April 2014?
  Ask any 16 year old if they would do that. It is madness to say they would.
  Secondly, the doctor could not have given the complainant the hiv since the doctor does not have hiv. It follows that the complainant caught the hiv from another person. The complainant's previous sexual encounters therefore become relevant to the case.
  The allegation that sex was conducted in a CAR in front of a bank is self-evidently absurd. The location affords no privacy and the vehicle burglar alarm would go off if the doors were locked.
  This case should never have got this far and should have been resolved out of court but since it is before the court, charges should be dismissed.
  
  The doctor should be asked by the magistrate to support the student friend to finish his education and to help provide him with anti-viral medicine to maintain his health.
  Common sense and fairness should prevail. The student needs help, not publicity. The police should be advised to refer cases like this to social welfare workers for amicable resolution. Magistrates should give directions at the next hearing.
  
  Lengthy court cases like this are a waste of court and police time and financial resources. What good outcomes can come from this case proceeding as it is? Answer: Zero.

You see oooo this is the highest state of inequalities some of us are fighting against. Tomorrow some one would be walking free and even go to the church to thank God for his freedom.   The fact that a corrupt,incompetent,money grabbing buffoon and nonentity remains the Medical Superintendent of Effia Nkwanta hospital,unfortunate but avoidable catastrophy of this nature are inevitable.The problem with Dr Paul K.Ntodi is that he is an extremely lousy and greedy cocoon flexing his muscles around as the so-called MD who want to always ripe where he has not sown.Dr Ntodi is an avidly greedy opportunist who is ready to exploit,sacrifice and destroy colleague doctors to make his filthy dirty money.To be frank if not for the endemic corruption and entrench nepotism in the Ghana Health Service he should not be the Medical Superintendent of a Regional hospital.It is an open secret at least among doctors including house officers that he is grossly deficient,recklessly incompetent and a disaster in health management.When you have a manager whose mentality is geared towards how to exploit,use colleague doctors to illegally enrich himself caring little for their welfare then it is a very big, big problem.He is far from being a good model to emulate ethically and professionally.Dr Ntodi did very little to help the extremely hard working Dr Gabass who was so dedicated to his profession.He identified Sulley Gabass as a potential cash cow greedily and selfishly interested in exploiting him rather than helping him over come his personal deficiencies as a man.Those who have been in Effia Nkwanta for long new Sulley Gabass as a very likeable person but with inherent psychosocial problems based on antecedent events in the past.Dr Ntodi took advantage of Dr Sulley Gabass peculiar problems to forge a loose association with him merely to exploit him giving Gabass an unfortunate sense of false security.Though other senior staff like Dr Sarah Baffoe fought relentlessly to protect and guide Dr Gabass,Ntodi was unputurbed other than standing by with a wetted tongue as usual to milk Dr Gabass who was extremely reformed by the pain staking efforts of Dr.Sarah Baffoe.Dr Ntodi as the MD of the hospital initiated and nurtured divisions and factions in Effia Nkwanta that ensured most doctors were not seeing eye to eye.Doctors in that hospital capitulated and lost their leadership role as a result of a combination of fear,indiscipline,immorality,tribalism,nepotism,corruption,favoritism and discrimination.Nurses became so powerful,actually usurped the powers of doctors,implying they determine which doctors to work in Effia Nkwanta and which not.The bitter acrimony,antagonism and reckless show of power encouraged by Dr Ntodi created this mess.In a hospital where the doctors are usually under the mercy of senior nurses through a series of maneuvers including amorous relationship with senior management members(Dr Ntodi inclusive)Dr Sarah Baffoe often rose up as a mother figure to protect junior doctors giving true meaning to the Hippocratic Oath for the first time in our suffering and bitter experience in that hospital under an extremely callous,corrupt and self centered MD in the person of Dr Ntodi.Dr Sarah Baffoe nevertheless could not steer the ship as a lonely captain without the support of others particularly Dr Ntodi who careless when Sulley's problems was an open secret at least among doctors.The result is the wreckage call sodomy that forced him into this unfortunate prosecution and possible conviction.If Dr Ntodi had been responsible rather than play the ostrich by seeking help for him earlier Sulley would not have found himself in this situation.Dr Ntodi has once again showed his bad side of ruthless exploitation and destruction of colleague doctors who work under him.This is somebody who incredibly worked to falsely incriminate a junior doctor with a mental illness forcing his dismissal from the GHS,a doctor he so much used, over worked and ruthlessly exploited in Effia Nkwanta hospital.At the time other doctors who knew his callous and heartless nature often refused calls on duties because of unpaid allowances, it was this young doctor who he connived with corrupt elements at GHS to sack him with a false claim of a mental illness who was always working,often called to duties even when off duties.This is vintage,brutish Dr Ntodi,the blood sucking vampire whose diabolism and malice is clear on the wall,represented by the fact that virtually all doctors left Effia Nkwanta hospital bitter,not in talking terms with him because of heartless maltreatment.May Allah deliver Dr. Sulley Gabass from this unfortunate situation.

  Your hospital testimonial is most valuable evidence of the background to the doctor and his colleagues. It is clear that at least one colleague testifies to the good nature and much valued professional work of Dr Sulley Gabass who happens to be gay.
  
  The truth is that many good people in all walks of life in every country in the world have same gender attraction as their innate orientation. Most developed countries understand this truth and now allow same gender marriage.
  
  In Ghana, young gay men and women need positive role models like they have in many other countries. In Luxembourg, the Prime Minister recently married his gay partner. In Ghana the law on 'unnatural carnal knowledge' has only ever been used to persecute only gay men.
  
  The law is in contravention of Ghana's constitution and would likely be stuck down if challenged in the Supreme Court. Moreover the law contravenes the UN Charter on Human Rights to which Ghana is a signatory and therefore bound by the rights provisions and case law. It does not seem that the current case will address these issues which is a shame since it would be a landmark case.
  
  In conclusion, it appears that Dr Gabass is respected by his colleagues despite being perceived as a gay man.
  
  Many mature gay men feel a duty to counsel young gay men such as students who are trying to come to terms with their sexuality, family rejection and bullying at school. The support that they gives hope and helps reduces severe depression leading to suicide.
  
  Unfortunately there is a high risk that in providing advice on navigating lifes challenges and on occasions giving financial help to students, that they are vulnerable to being set up for extortion.
  
  Some Ghanaian police have a bad track record in threatening court action against a mature gay man who has young gay friends. It is so easy to manipulate a young gay man to make false charges of alleged anal sex acts against the target of an extortion attempt.
  
  If the false accusations are denied then the accused is charged, refused a reasonable bail, incarcerated pending a long drawn out trial. This case has elements of such a typical situation where extortion was resisted.
  
  Thanks to media coverage of this trial, Ghana's legal system itself ends up on trial to a national global audience with many people watching: some with extreme prejudice, others with concern and hope for the rule of law and justice.
