"Busia had what it takes to be a leader for any country in this world". That's not mine; that was what the world said when he died prematurely, and the military authorities at the time even displayed crocodile tears at his funeral.

The man was a respectable, knowledgeable and God fearing leader that had a complete programme for all aspects of our national development. But the ignorant communist indoctrinated Young Pioneers implanted in our midst by Nkrumah did not allow Ghanaians to benefit from his knowledge and the good work he had started to do for Ghana. They hijacked the country and impeded our development until 2001.

Although Acheampong a stooge and the adventurist that carried out the dirty work of overthrowing Prof. Busia unjustifiably, and was supported by Nkrumah's communist relics that became the pillars of his so-called NRC regime, they later on disowned him when they realized that they had backed the wrong person in order to hide their involvement in the destruction of this country. Finally, he was killed by another communist dictator that also seized power and unleashed a Cuban-style communist dictatorship on Ghanaians for 20years.

Busia did not say that he was going to stay in power indefinitely as Nkrumah did, and he did not declare Ghana as a one-party state either. In fact, he was given a 5year mandate to deliver for Ghanaians to judge whether to extend his mandate or elect a different leader. But the communist relics who were still hiding in our midst got panicked and overthrew him prematurely for fear of his progressive achievements. Truly, the man knew exactly what he was coming to do to alleviate the suffering of his people through an alternative method of development different from that of his predecessor, and hit the ground running from the first day in office.

On the other hand, Nkrumah had been in power for sixteen years and turned himself into a president for life when he realized that his popularity had waned. And that is a good example of the quotation 'power corrupts and absolute power corrupts absolutely'. In the sixties after he had squandered the huge reserve, the country started to go down the drain and Ghanaians yearned for a change. But since Nkrumah shut all the doors that they could use to exercise their political will and change him democratically through the ballot box, they had no option other than to force him out through a military coup. Therefore, the coup that removed Kwame Nkrumah from office was the only legitimate coup in the history of Ghana.

If communism is the evil system you make it out to be then why would God-fearing nations trade and deal with them? Would the Christian God, Muslim Allah and the higher spirit of other religions advice their flock to play in the devils backyard?j Why do presumed Christian nations find communist nations as allied in war? Why do people from other systems attend schools and universities in communist nations? Why is state approved slavery under democracy morally preferred over state imposed slavery under communism? Was it Nkrumah's CPP that overthrew Busia or his incompetence in managing the affairs of the nation that did him in?

As I write, there are more Ghanaians who have migrated, legally and illegally, into nations far and wide under the delusional democratic Ghana ushered in at 1966 than any time before. Would you, Mahmoud, prefer a classroom where students oppose the teacher/instructor/professor for the sake of opposition to disrupt class or make it unbearable to teach or a teacher who is dictatorial but at the end of the day give most students what they came to learn even if under unfavorable conditions? It is the ignorance of Ghanaians in the opposition hell bent on sabotaging any and all things CPP that gave Nkrumah the need to become dictatorial. By the way, Mr. Mahmoud, did you accept the renditions and detention without trial that almost all democracies of the world has adopted since 9/11? Those civilized, industrialized democratic nations did not adopt these draconian policies for the heck of it but for the protection of their respective citizens; it came some 40+ years after Nkrumah used it to quash bomb throwers of the UP/UGCC/"matemeho" bunch. You, Mr. Mahmoud either harbor some self hatred or too ignorant to know that it is not only whites who have the corner market on foresight, ideas and ideal; Nkrumah had it. Busia was a classic Monday-morning quarterback who got a chance at governing and found out it was easier to criticize other administration than to govern.

Your heroes failed miserably and Ghana is paying for delusional democratic promised as justification for the 1966 coup. If you love the Ghana of now then enjoy and keep your mothers off the streets of Ghana parading naked in protests. Keep the daily ritual of demonstrations from happening because we live free in a democratic Ghana and our streets are flowing with milk and honey. Democracy is not going to save Ghana neither is communism or socialism; it’s hard work, intellectual honesty, principles, ideas, ideals and above all love of nation. You love of or for political party and or tribe is never going to cut it because no one went to the promised land riding on a political party train or bus, Mahmoud.

Judges have been killed before for staking out against illegality. Do we have judges now who have outgrown this trauma to contend with presidents for the welfare of the political process? I doubt it.
Moreover, all the high places are being given to women who, seriously speaking, cannot have the gut, like men do, to stand up against dictators, when it comes to the crunch.

In what part of the Constitution does it prohibit the President from appointing any of those position-holders to a higher or even lateral position? None of the sections of the Article you and this Paper referred to bans the President from taking the action he took. Period!

This is one of the areas in Law where the intent of act ought to be seriously considered. Meanwhile, had the lady appointee rejected the new appointment and the President acted to unduly impose on her, then would the President be acting unconstitutional.

You cannot always interpret the Law just by its strict wording without consideration to what might have been intended by those who put the Law together under the context they did.

The President's action did not injure the appointee or her previous Office. So, where is this needless charge of constitutional breach come from?

By the way, Kofi, the Article is poorly resourced and may be just coalescing the ideas you and like thinkers on this topic originally submitted. If the Daily Searchlight is not authentically identifying its legal source, it adds no more weight to the argument than you have already presented.

Does this not give a rogue president, who perceives an EC chair as a stumbling block to his ambitions, the opportunity to manipulate electoral structures in this manner?

There is no where in the Constitution ,is it stated the positions of EC and NCCE Complements each other. Therefore there is no contravention on the part of the President under Articles 234 ,235(1) and 127(2) of the 1992 Constitution as quoted by by Learned Lawyer . As a matter of fact ,the next Constitutional action that can be taken by the President is to exercise his Prerogative Powers under Article 70(2) to Appoint a new NCCE Boss .Constitutionally , it must be noted ,there is no Precedent for the EC to maintain the NCCE position at the same time just as there is no justification for an Appeals Court Judge to hold two hats when appointed to the Supreme Court . It is quite surprising the said Constitutional lawyer should argue the merits of his bogus contention without realizing that the EC by accepting her appointment and agreeing to be sworn in Constitutionally Relieves or absolves of her of position as NCCE Boss.

The stipulation of Tenure is fully entrenched and there is no nonsense about that . Though the President enjoys several Constitutional Powers ,paramount of which is granted under Article 31,and that is the Emergency Powers that cannot even be used to fire the EC without the concurrence of the Supreme Court in time of National Crisis.Functions of the EC are clearly stated under Article 45 . Whether we like it or not ! Please let there be no doubt that ,the EC is going to be her Own Boss with good conduct until she reaches the Mandatory Retirement age as Stipulated under Artcle 46 of the I992 Constitution.

This sounds like interpreting into absurdity.

1. There is no constitutional provision that bars the president from nominating a head of one state institution for the position of another.

2. The appointment must be as prescribed by the constitution, ie, In consultation with...........'

3. The nominee must consent. If the nominee refuses the nomination then (s)he cannot be forced to accept the nomination.

4. While nominated, the person remains the employee of the first institution. When appointed, then the person must resign the first position.
