Prof, I enjoyed reading your intellectual, academic and legal piece on the rot within the Ghanaian Judiciary. However, I disagree with you that prior to the Anas investigation, corruption within the judiciary was only perception. Unless Attorneys in Ghana were pretending to be blind because the evidence were in the perverse judicial decisions by judges in cases such as Woyomegate, the Yaa-Na, judgement debts and other civil cases. Whenever I read such rulings reported by the Ghanaian media, they never made sense and the only explanation was that money had changed hands.

Regarding the need for retrial, I agree with you and in fact, I have called for all the cases involving the bribe taking corrupt judges to be reviewed and the rulings set aside by the Attorney General as a matter of uregncy. This is because there were miscarriages of justice. For that reason the double jeopardy rule does not apply as well as the statute of limitation. The Attorney General must act fast before the criminals abscond.

It will shed light on Alfred Agbesi, KKD, TOBINCO, Cocaine turns into Konkote powder, Limping man etc.
This goes for court clerks and prosecutors implicated as well.

But let me make a few remarks:
Where was he and others, who have now joined the bandwagon, when the quartet of Atuguba, Amaliba, Acumey and Bimi, were being roasted? Even if none of the four could come up with the Anas-type evidence to support their claims, was it proper for the Bench and the legal establishment, to effectively deny the four lawyers the source of their livelihood?
And who told this old Prof that, the Anas expose, would pass the evidence muster? Is he attempting to prejudice the work of the CJ`s committee/panel?
But more importantly, why has our learned Prof. not seen fit to apply some of the common-sense perspectives he has taken in this piece, to the current raging matters of corruption within his party, the NPP? Why is he in support of the attempt to 'crucify' the party Chairman and Gen-Secretary over some phantom allegation - the preposterous Agenda_2020? As chair of the party`s legal and constitutional c`ttee, why has he not come out on the side of justice and fair play, when for instance, Paul Afoko, has been dragged before the party`s disciplinary c`ttee, for coming out boldly as not going to countenance corruption and financial malfeasance from any party member?
Btw, has he, by any chance, heard a sitting MP and a lawyer, Afenyo Markin, make disgusting boasts, regarding his willingness to shortchange this nation,[engage in "legal gymnastics" before the SC so as to enrich himself and a few of his cronies?
The last thing I would want to do is to hold brief for Judges who have taken bribes, and turned our judicial system on its head!
The reviews being talked about, should beyond the judges who have been implicated in the current scandal to encompass those cases in which individuals with 'dirty hands' were let off the hook and allowed to walk, for whatever reasons!

There is a comprehensive failure in our education system. What do you expect when Swahili is an overly subscribed course in the university of Ghana? In a country with so many brain damaged people, Bishop Obinim, TB Joshua and Kumchacha are either Kings, Prophets or Messiahs. We have failed a whole generation. Shame on you Rawlings and Mahama for taking the country back another 1 million years. Your children will surely ask you some serious questions oneday. How did you get it so wrong? Guess what? You will end up jailing the whole of Ghana. There are not enough prison places and it will not be value for money.
It cost not less than $200 a day to keep a person locked up for a day; Cost of policing, cost of the trial, cost of incarceration and the cost in feeding and lodging will make it uneconomical to lock them up.

Spend over $10,000 a year on an inmate who steals $1,000 for even a year is counter productive.

A practical way is to confiscate their assets and dismiss them.
Extract information and intelligence from them so you can stop future acts of corruption.
I look at our universities and there is no single institution offering graduate or postgraduate degrees in anti-corruption. It corruption not that important to deserve a program of its own in our universities?

Somehow we are obsessed with the rule of law. We think that problems of a criminal nature can only be fixed through the rule of law.

That is the mindset that needs to change. Until then, we will ever be dumbfounded as to why despite our numerous laws, we still continue to experience many issues in society.

Most of the issues are as much cultural and mindset problems as they are criminal.

When the government was unsuccessful in enforcing road safety legislations, such as getting drivers to wear seat belts, it still did not occur to them that most of the problems cannot be solved in the law courts.

Corruption is a cultural and mindset issue. without changing these, it will be virtually impossible to eliminate the cancer of corruption in the Ghanaian society.

Suspending and jailing our judges will do nothing to stem the tide of corruption sweeping our country. It is indeed pervasive and the acts by the judges does not even scratch the surface of corruption in Ghana.

Frowning on corruption or acts that unwittingly promote corruption is one of the ways forward. That is why I support Anas' initiative of naming and shaming these judges. His videos must be aired publicly.

Prosecuting them will not be as effective as making Ghanaians understand that is it 'uncool' to be corrupt. It will also be a waste of tax payers money.

My suggestion is to reward those judges who have been found to be less prone to corruption and demote those who have been found to be complicit in the cancer.

Measures should include requiring them to refund all monies acquired illegitimately to the state.

They should also be required to attend training courses and be supervised over a period of time to make sure they are of good behaviour. To be corrupt is to be incompetent.

We create an enabling environment for corruption and then blame those who exploit it without even bothering to seal the loopholes.

We must consider serious structural reforms in the way our civil and public services are ran.
Information about services and what Ghanaians should expect should be freely available and accessible.

We can not say there are no answers. There are very effective and efficient public service systems that we can learn from. Systems that have undergone transformational changes following decades of similar corruption and bribery issues we are currently facing.

We must be tough on corruption and also on retrieving the proceeds of corruption.

Everyone has a part to play.
Government must run adverts and public education campaigns to highlight the hazards of corruption instead of simply paying lip service.

The movie industry must also use their ability to reach out to a wide audience to make movies that will educate the public on the hazards of corruption.

MyJoyOnline is playing a very important role indeed. That is why we must celebrate the likes of Manasseh Azure Awuni and Anas Aremeyaw Anas and others.

Parliament must also make itself relevant by expediting the promulgation of the freedom of information act and government must set aside the necessary funding to make sure it becomes reality.

What do you expect when Swahili is an overly subscribed course in the university of Ghana? In a country with so many brain damaged people, Bishop Obinim, TB Joshua and Kumchacha are either Kings, Prophets or Messiahs. We have failed a whole generation. Shame on Rawlings and Mahama for taking the country back another 1 million years. Your children will surely ask you some serious questions oneday. How did you get it so wrong? How did you turn Ghana into a dumping grounds for foreign waste? How did you manage to turn Ghana into the 7th dirtiest country in the world? How could Judges release armed robbers after taking goats as bribes? How can our presidential lounge become a cocaine trafficking hub? How can people who cause Great financial loss to the country (Woyome) be walking about as free men? the list goes on and on and on.....! We are so sick, I very much doubt if we can ever be healed. I also commend the Professor for shining that much light on this particular case and the legal ramifications thereof but share your bewilderment about why he and others of his caliber would keep mute over the all-pervasive canker unless they presume it is someone else on the opposite side of their Political divide that is more deserving to be called out for such a vice.

Meanwhile, the Judges have shown us that Corruption in Ghana is Color-blind, non-partisan, non-tribalistic. It is up to the likes of Professor Oquaye to show us how best to kill that bug, now that they all have realized that it exists in all levels of our Judiciary.

You had no balls to call out your fellow legal brats that we had so long pampered to lord over us, and milk us as well. You knew having chosen to dine and wine with them in your political circles, there wasn't much you could do to expose them without smearing yourself with their dirt.

Now that you realize the investigative methodologies of Anas' are indisputably legal and authentic source of prosecutable evidence, you feel compelled to exhibit your professorial prowess by which you could have long established, yourself, that what was going on among the Judiciary was not just 'perception'.

Nevertheless, I commend you for your elucidation, legally and commonsensically. I could even see a genuine thread of true patriotism in your piece, something that I have always doubted about you.

Maybe, this is the watershed for not only our general national redemption but also for your start to be more apolitical in tackling most of our national issues.

We should all be thankful to Anas, and more importantly, to God for giving us this opportunity to scour the bottom of our longest running iniquity that has been eating our Nation's soul inside out.

We must all boldly and finally admit to our individual complicity in perpetuating Corruption in Ghana, and for once and for all, push the Government for a thorough adjudication of this case to set a lasting deterrent to all.

In my humble opinion, the Prof. has come to the "party" a little too late for my liking. He can choose to come down heavy on the Judges implicated in the current scandal, but what was his own involvement in that botched importation of rice buffer stocks from India when Akwasi Agyei held the Foreign Ministry portfolio?
As head of his party`s legal and constitutional affairs, he should insist that right things are done; that party`s rules and regulations are applied evenly across board!
