There is a tall order. In the absence of the president, the Veep acts. In this case, the vice is also sworn in on the same day that the president is sworn-in. In the absence of the two, the speaker acts after swearing the presidential oath. If the three are not present, the Chief Justice acts after swearing the presidential oath. The later two can only act after swearing the presidential oath. That aspect is non negotiable. Please note that, the two swearing ceremonies are not the same. This is cast and stone in the 1992 constitution and cannot change no matter the argument except where the speaker of parliament is sworn in as the second vice president on the day that the president takes his oath of office. This is my view.

The only time we should need someone to act as president is when the president is incapacitated and therefore unable to do his work, not when he travels.

When the president travels, he travels as the president and does not cease to be president. Therefore there is no need for someone to act in his place. When the president travels abroad and signs a treaty, etc. or is accorded the status of a president, in what capacity is he doing? Not as president? So if he is doing that abroad as president, then who is the fellow who got sworn-in in Accra?

The provision creates 2 presidents at a time under this circumstance, because the substantive president does not cease to be president. And that is a recipe for major trouble.

Imagine Adjaho being sworn-in as president and preventing the president and vice president to return to Ghana so that he can continue to be president! Or making some major decision in the president's absence that the substantive president disagrees with.

Let's fix this before we get ourselves in trouble!!

This is the 21st century. The president is capable of still assuming his responsibilities outside the shores of Ghana. Unless the president is incapacitated, it is unnecessary for anyone, including the vice president to act on his behalf whenever he is away. Equally silly is the clause in the constitution that stipulates that the person chosen to act on behalf of the president has to swear an oath whenever the president he is away. This constitutional provision as to be amended to remove that foolish clause.

THAT IN VIEW OF THE CONSEQUENCES OF THE SAID PROVISIONS OF GHANA 1992 CONSTITUTION AND PURSUANT TO THE SUPREME COURT HOLDING ON THE MATTER AND THE WAY FORWARD TO CLEAR SUCH AMBIGUITY CREATED BY ARTICLE 60 CLAUSE 12 OF GHANA 1992 CONSTITUTION AS SEEN BELOW THAT IT BEHOOVES ON ME AS GHANAIAN LAWYER, INTERNATIONAL LAWYER AND LEGAL CONSULTANT TO RENDER MY CANDID OPINION AND SUBMISSION ON THE MATTER AS FOLLOWS BY FIRST PROVIDING THE RELEVANT PROVISIONS OF GHANA 1992 CONSTITUTION :

"THE CONSTITUTION OF THE REBUPLIC OF GHANA 1992

THE EXECUTIVE
57
The President
(1) There shall be a President of the Republic of Ghana who shall be the Head of State and Head of Government and Commander-in Chief of the Armed Forces of Ghana.
Electoral Commission
(2) The President shall take precedence over all other persons in Ghana; and in descending order, the Vice-President, the Speaker of Parliament and the Chief Justice, shall take precedence over all other persons in Ghana.
(3) Before assuming office the President shall take and subscribe before Parliament the oath of allegiance and the presidential oath set out in the Second Schedule to this Constitution.
(4) Without prejudice to the provisions of article 2 of this Constitution, and subject to the operation of the prerogative writs, the President shall not, while in office, be liable to proceedings in any court for the performance of his functions, or for any act done or omitted to be done, or purported to be done, or purported to have been done or purporting to be done in the performance of his functions, under this Constitution or any other law.
(5) The President shall not, while in office as President, be personally liable to any civil or criminal proceedings in court.
(6) Civil or criminal proceedings may be instituted against a person within three years after his ceasing to be President, in respect of anything done or omitted to be done by him in his personal capacity before or during his term of office notwithstanding any period of limitation except where the proceedings had been legally barred before he assumed the office of President.

(1) The executive authority of Ghana shall vest in the President and shall be exercised in accordance with the provisions of this Constitution.
(2) The executive authority of Ghana shall extend to the execution and maintenance of this Constitution and all laws made under or continued in force by this Constitution.
(3) Subject to the provisions of this Constitution, the functions conferred on the President by clause (1) of this article may be exercised by him either directly or through officers subordinate to him.
(4) Except as otherwise provided in this Constitution or by a law not inconsistent with this Constitution, all executive acts of Government shall be expressed to be taken in the name of the President.
(5) A constitutional or statutory instrument or any other instrument made, issued or executed in the name of the President shall be authenticated by the signature of a Minister and the validity of nay such instrument so authenticated shall not be called in question on the ground that it is not made, issued or executed by the President.

59The President shall not leave Ghana without prior notification in writing, signed by him and addressed to the Speaker of Parliament

(1) There shall be a Vice-President of Ghana who shall perform such functions as may be assigned to him by this Constitution or by the President.
(2) A candidate for the office of Vice-President shall be designated by the candidate for the office of President before the election of President.
(3) The provisions of article 62 of this Constitution apply to a candidate for election as Vice-President.
(4) A candidate shall be deemed to be duly elected as Vice-President if the candidate who designated him as candidate for election to the office of Vice-President has been duly elected as President in accordance with the provisions of article 63 of this Constitution.
(5) The Vice-President shall, before commencing to perform the functions of Vice-President, take and subscribe the oath of allegiance and the Vice-Presidential oath set out in the Second Schedule to this Constitution.
(6) Whenever the President dies, resigns or is removed from office, the Vice-President shall assume office as President for the unexpired term of office of the President with effect from the date of the death, resignation or removal of the President.
(7) Where the unexpired term served by the Vice-President under clause (6) of this article exceeds half the term of a President, the Vice-President is subsequently only eligible to serve one full term as President.
(8) Whenever the President is absent from Ghana or is for any other reason unable to perform the functions of his office, the Vice-President shall perform the function of the President until the President returns or is able to perform.
(9) The Vice-President shall, before commencing to perform the functions of the President under clause (6) of this article, take and subscribe the oath set out in the Second Schedule to this Constitution in relation to the office of President.
(10) The Vice-President shall, upon assuming office as President under clause (6) of this article, nominate a person to the office of Vice-President subject to approval by Parliament.

(11) Where the President and the Vice-President are both unable to perform the functions of the President, the Speaker of Parliament shall perfom those functions until the President or the Vice-President is able to perfom those fuctions or a new President assumes office, as the case may be.
(12) The Speaker shall, before commencing to perform the functions of the President under clause (11) of this article, take and subscribe the oath set out in relation to the office of President."

THAT IN ACCORDANCE WITH AND PURSUANT TO ARTICLE 60 CLAUSES 11 & 12 WHICH PROVIDE AS FOLLOWS:

"
(11) Where the President and the Vice-President are both unable to perform the functions of the President, the Speaker of Parliament shall perfom those functions until the President or the Vice-President is able to perfom those fuctions or a new President assumes office, as the case may be.
(12) The Speaker shall, before commencing to perform the functions of the President under clause (11) of this article, take and subscribe the oath set out in relation to the office of President."

THAT IT IS IN VIEW OF THE ABOVE THAT THE SUPREME COURT OF GHANA INTERPRETATION AND HOLDING BELOW IS/WAS THE POSITION OF THE CONSTITUTION AND THEREFORE THE SUPREME COURT OF GHANA HOLDING IS/WAS THE CORRECT POSITION OF THE PROVISIONS ABOVE AND FOR THAT MATTER THE SUPREME COURT ACTED PROPERLY AND APPROPRIATELY IN ITS HOLDING AS FOLLOWS:

Supreme Court orders Adjaho to swear Presidential Oath
Ghana’s Supreme Court has ordered the Speaker of Parliament to take the Oath of the President anytime he has to act in the president’s absence. The nine-member panel presided over by Justice Sophia Akuffo unanimous ruled that the speaker’s decision not to take the Oath of the President on 4th November 2014 was in contravention of the 1992 Constitution. According to Starr News' court correspondent, Wilberforce Asare, "the issue as to whether or not the Speaker committed a high crime by not taking the presidential oath was not properly before the court and as a result the apex court struck out that particular pleading of the applicant." Background The case involves the Chief Executive Officer of Citi FM, Samuel Atta-Mensah and the Speaker of Parliament, Edward Doe Adjaho. The boss of Citi FM prayed the Supreme court to declare as unconstitutional, the Speaker of Parliament’s decision not to be sworn in as President before acting in that position in the absence of the President and his Vice. The Speaker on two occasions, refused to take the mandatory oath of office, while the President, John Mahama and his Vice, Amissah-Arthur were on official assignments.Source: starrfmonline.com"

HOWEVER, THE SAID PROVISIONS OF ARTICLE 60 CLAUSE 12 CREATED AN AMBIGUITY AND WHICH THE SUPREME COURT CANNOT AND COULD NOT PURPORT TO CURE SINCE THERE IS A CLEAR PROVISION OF SEPARATION OF POWERS AND THAT PARLIAMENT OF GHANA HAS THE CONSTITUTIONAL AUTHORITY AND POWERS TO MAKE OR ENACT LAWS. THEREFORE, IF THE PROVISION WHICH IS THE LAW CREATED AN AMBIGUITY THEN IT IS THE PROVISION THAT SHOULD BE SEEN TO BE AMENDED.
THAT GHANA 1992 CONSTITUTION CLEARLY PROVIDES FOR "THE AMENDMENTS PROCEDURES OF THE ANY PROVISIONS OF THE CONSTITUTION" AND IT IS MY RESPECTFUL AND CANDID SUBMISSION AND OPINION THAT TO BE SEEN TO CURE SUCH AMBIGUITY THEN THE CONSTITUTIONAL AMENDMENTS PROCEDURES TO BE SEEN TO COMMENCE, THERETO.
THIS IS BECAUSE IN SUCH SCENARIO SITUATION IT IS CLEARLY SEEN AND ALSO DEEM TO CREATE A SITUATION WHERE TWO (2) GHANA PRESIDENTS WILL BE PERFORMING THE SAME FUNCTIONS AT THE SAME WHILE THE DEEM SWORN IN SPEAKER ACTING AS PRESIDENT OF GHANA PERFORMING SAME SUCH FUNCTIONS WITHIN GHANA THAT GHANA SUBSTANTIVE SITTING PRESIDENT WHO AND HIS VICE-PRESIDENT TRAVELLED OUTSIDE GHANA THAT THE PRESIDENT WILL BE DEEM PERFORMING SAME FUNCTIONS OUTSIDE GHANA.
THAT IN SUCH SCENARIO SITUATION WHAT HAPPENS TO THE SUBSTANTIVE PRESIDENT OUTSIDE GHANA?
WHETHER OR NOT THE SWORN IN SPEAKER OF PARLIAMENT OF GHANA ACTING AS THE PRESIDENT OF GHANA CAN OR COULD TAKE ANY DECISIONS WITHOUT CONSENT AND CONCURRENCE OF THE SUBSTANTIVE PRESIDENT OF GHANA OUTSIDE GHANA?
WHETHER OR NOT THE SUBSTANTIVE PRESIDENT OF GHANA WHO TRAVELLED OUTSIDE GHANA IS/WAS ON THE "FROLIC OF HIS OWN OR REPRESENTING GHANA AND GHANA INTERESTS OUTSIDE GHANA?
THAT REASONABLE, PRUDENT, LOGICAL AND SEASONED ANSWERS TO ADDRESS THE ABOVE RELATED RHETORIC QUESTIONS RAISED WILL HELP PROVIDE THE WAY FORWARD TO CLEAR THE ABSURDITY CREATED BY ARTICLE 60 CLAUSE 12 WILL BE CURED, THERETO.
THAT THE SAME UNCLEAR SITUATION CREATED IN THE CASE OF THE INTERPRETATION OF ARTICLE 57 CLAUSES 4,5,& 6 VIS-A-VIS ARTICLE 64 OF GHANA 1992 CONSTITUTION WHICH WERE SOME OF THE "BONE OF CONTENTION" THAT I RESPECTFULLY RAISED DURING THE RECENT GHANA PRESIDENTIAL ELECTIONS PETITION AT THE SUPREME COURT OF GHANA SUCH A BRIEF I DULY HELD AND WAS DISMISSED BY THE SUPREME COURT ON ONE OF THE GROUNDS THAT "I HAD NO LOCUS STANDI" IN THE CASE "THE AMICUS CURIAE BRIEFS".
IT IS AT THESE RELATED BACKDROPS THAT I RESPECTFULLY AND DULY GAVE "THE 30 DAYS NOTICE TO HON.ATTORNEY GENERAL OF GHANA" TO CONTEST THE CASE AS REQUIRED BY LAW PURSUANT TO ACT 555, THERETO.
BUT UPTIL NOW NO ACTIONS HAS BEEN TAKEN BY THE HON.ATTORNEY GENERAL OF GHANA THAT STILL CREATED THE AMBIGUITY "WHETHER A SITTING PRESIDENT OF GHANA CAN BE SUED AS DEFENDANT BOTH IN CIVIL AND CRIMINAL ACTIONS IN THE COURTS OF LAW IN GHANA".
IT IS THEREFORE MY RESPECTFUL SUBMISSION TO HON.ATTORNEY GENERAL OF GHANA AND GHANA BAR ASSOCIATION TO CONSIDER TO INITIATE APPROPRIATE ACTIONS, THERETO, TO CLEAR ALL DOUBTS AND AMBIGUITY DEEM CREATED.
THAT IT IS A TRITE LAW THAT THE "LAW TO BE SEEN AS THE LAW SAYS IT IS AND NOT WHAT PERSONS SAY WHAT THE LAW IS OR OUGHT TO BE BUT WHAT THE LAW SAYS IT IS THE LAW".
