I am finding it difficulty to understand your accusation against the late President Mills that he usurped the role oo authority of the Attorney General either as Vice-President or President. I am confused because the Ministry of Justice and Attorney General's Department is part and parcel of the Executive arm of government. For the fact that Executive is headed by the President and the Vice and therefore are able to instruct all appointees of the ministry and the department including the minister and Attorney General. If that is the case and if my understanding is accurate, where does the then Vice-President or the late President instructing Attorneys and the Minister for Justice and Attorney General constitute usurpation?

Martin, some of us admire you for your anti-corruption crusade work in Ghana. However, you are beginning to lose track with some of your allegations against the defenceless such as the late President. Such allegations appear to be personal and vindictive. You stand to lose public support if you are not careful with such personal attacks.

You are aware that the Ministry of Justice and Attorney General's Department in Ghana is not an independent body but part of the Executive. How can you justify your allegations that instructions from the Vice-President or President to his appointees amounted to interference or usurpation. That is neither here nor there. This is something you should know as an Attorney. This allegation is either fabrication by you or your own imagination because it does not make sense.

The appointing authority is under no obligation to accept advice from his or or subordinates. Of course, if the appointing authority ignores good counsel, they do so at their own risk.

My problem with Martin Amidu's accusation is that he creates the impression that the late Vice-President/President had no authority to instruct the Attorney General or ignore advice from the Attorney General, when the Attorney General acts on the instructions of the appointing authority.

Not only is Mr Amidu interrogating the intentions of the President or Vice President in ignoring the AG's professional position on the cases; he's also highlighting the grave consequences for the national purse and for the fght against corruption of any such blatant dismissal of the AG's professional decisions by the President or Vice President! Amidu was then not only an AG; he was, and still is, a Ghanaian! And being a Ghanaian, he was living up to the dictates and expectations of the Constitution with regard to both probity and accountability and the functions and authority of the AG!

It's not enough that the President and Vice President wield some authority over the AG; it matters also that in exercising that authority and power, they do NOT abuse the values of probity and accountability and the fight against corruption, values that are highly esteemed in the Constitution! So, per the force of the Constitution, the AG can assert that neither the President nor the Vice President has any authority, legally or administratively, to order him (the AG) to violate the Constitution!

For you to learn: that is not the case and your understanding is not accurate!

The AG's Dept may be part and parcel of the Executive branch of govt, and the head of the Executive may be both the President and the Vice President! Still, it doesn't make the functions and authority of the AG a function of the whims and caprices - and seemingly corrupt intents - of the President and Vice President. As Amidu tries to point out in his submission, the authority and functions of the AG are ensrhined in the Constitution! And the Constitution, for your informtion, is greater than the office and authority of both the President and Vice President. Thus, it is neither senseless nor oxymoronic, legally or logically, to pronounce that a Vice President has "arrogat[ed] to himself the functions entrusted to the Attorney-General under Article 88 of the 1992 Constitution." The President and Vice President may be the immediate "employers" of the AG; but once the AG, after his appointment has passed through parliamentary vetting and approval, is employed as the AG, his authority acquires some measure of protection under the Constitution. Ultimately, he's accountable to the people of Ghana, not to the whims and caprices of the President or Vice President. Thus, in the foregoing sense, a case can be made, rightly, that a President is usurping the role and authority of a Minsiter.

However, what Amidu is trying to drive home is far, far beyond a mere usurpation of one's authority and functions! For example, in the EO Group's case, he's trying to demonstrate that the intervention of then Vice President Mahama and the Energy Minister Dr Oteng in the works of the Attorney General on the EO case smacks of complicity in crime. That is, against his (AG's) legal and professional position on the EO Group's criminal case, the then Vice President Mahama and the Energy Minister Dr Oteng attempted, through the AG's office, to offer the EO Group a protective cover of indemnity from criminal prosecution and a closure of the docket on the case. In other words, the acts of the then Vice President Mahama and then Energy Minister Oteng were either attempting to aid and abet criminality or were encouraging corruption. But he, the then AG (Amidu), living up to the 'compulsions' of his professionalism and integrity and the authority of his office, refused to do that 'illegal' bidding of the Vice President and the Energy Minster.

What this means is that if it is true that after Amidu left office, the EO Group has acquired imdenity from protection and the criminal docket on its case closed, then a case of accountability can be preferred against the then Vice President, who's now the President, to charge him to explain and justify EO Group's acquisition of indemnity and closure of the docket!

Both Mahama and Oteng are alive; they are free to respond to Aminu's claims and allegations!

It is already out that the NDC is corrupt and dishonest. Nothing New ! What bothers the sane mind is how it has managed to choke the good conscience of the nation into submission.
It is very surprising that the three organs of government have remained silent over an issue which has the most potential poignancy to turn this country into rubbles and chaos. We all belong to this dear nation and must put all political interests aside for the sake of our national safety . It would be hard for posterity to understand the logic behind our unwillingness to deal with this looming but preventable disaster. Our leaders lack senses of foreseability and actionable efforts to serve the nation. Why must we wait till we tear ourselves apart to realize the depth of our ineptitude or consequences of silence ? Are we not humans like other people around the globe who put exercise of common sense ahead of politics and self serving interests ? The safety of our nation must take precedence over NDC-NPP nonsense. Lets sit back introspectively to visualize many funeral weekends awaiting us all across the nation at the next election.
