SOURCE: myjoyonline.com------Executive Director of the National Anticorruption Action Plan (NACAP) says they would be compelled to go to court to demand accountability from government over its failure to retrieve monies wrongly paid to individuals in judgement debt.

Mrs. Linda Ofori Kwafo is baffled at government’s lackadaisical approach to pursuing beneficiaries of such monies.

The anticorruption campaigner was speaking on the Super Morning Show, Tuesday, December 9, 2014 in connection with the announcement by Deputy Attorney-General Dominic Ayine government that Gh?14.5million had been retrieved as part of the illegal money paid to contractors of the Ghana Youth Employment and Entrepreneurial Agency (GYEEDA).

President Mahama at a conference organized by NACAP on Monday, also disclosed that about 300 people have either been convicted or are facing trial for corruption-related offenses in Ghana since 2013.

“It is disheartening…We need a breakdown of the information they put across there,” Mrs. Ofori Kwafo retorted. According to her, “ the GYEEDA case is small”.

She recalled the “good cases” won in court by former Attorney-General Martin Amidu in which individuals and organisations that benefited from such wrongful payments were ordered by the Supreme Court to return the monies to the state.

The Supreme Court in June 14, 2013, ordered Waterville Holdings Ltd. to return to the state in excess of 21million Euros obtained illegally arising out of claims it brought against the state in 2009. A week after, the court again ordered businessman Alfred Woyome to refund a total of Gh?51.2 million judgement debt payment he received between 2009 and 2010.

The Court in another landmark judgment on July 29, 2014, ruled that Spanish-based Company, Isofoton pay back to the state a total of $325,472 and the interest accrued on the amount since 2011- the year in which the monies were paid.

“The amounts involved are huge…we need such monies to move our economies forward and government officials are silent on them,” the NACAP Executive Director questioned.

“Civil Society Organisations want to make the recovery of such monies…they should give us the detailed breakdown for us to know the progress that we are making.

“We cannot go and collect the monies; the state has a responsibility…we need the resources,” she demanded.

She hints the Civil Society Organisations will not hesitate to choose the option of “going to court and demanding for accountability so far us government’s responsibility in the fight against corruption is concerned”.

“We have also signed onto the United Nations Convention Against Corruption, which actually mandates us to be able to recover stolen assets that have been hidden outside this country. If within the borders of our own nation we cannot retrieve monies then how well would we able to retrieve [stolen state funds lodged] in Swiss banks and the rest?

“It’s no wonder, therefore, when citizens say that…they don’t actually have trust and confidence in government’s ability to fight corruption,” she told Kojo Yankson, host of the Show.

Anybody who had followed some of the matters in the Judgment debt commission's work keenly, would have without a doubt anticipated John Dramani Mahama's morbid fear of Nana Akufo Addo, the incoming President of Ghana, and the extent to which John Mahama and his NDC gov't would go, to conjure literally things from the upper reaches of the skies to dent Akufo Addo's avowed, stated and proven incorruptibility, within the Ghanaian political landscape.
But the reality is, no matter what John Dramani Mahama does, he just cannot catch Akufo Addo in any corrupt scandal.
Some have even said a total of six different investigations have been conducted against Nana Akufo Addo, and in all of them, John Dramani Mahama has not been able to catch the proverbial tidal wave which he so desperately seeks within the context of corruption with regards to Akufo Addo to nail him, and that is because Akufo Addo is not corrupt, has never been corrupt and will not be corrupt.
It must be noted that, in Ghana's current political dispensation, it takes a lot for a politician and a Flagbearer of a much vilified political party by the incumbent administration, to state verbatim, "I am not corrupt, I have never been corrupt, and I will not be corrupt" and such an individual would not be caught in more than six investigations by the incumbent administration with all the various apparatus of state at it's disposal. It is rare, very, very rare, indeed a rarity, and it is basically because it is just not possible, the man is not corrupt and everything John Dramani Mahama has thrown at the Flagbearer of the NPP in terms of corruption has not stuck and will not stick. It is very simple.
However in view of these things, one would have thought the sane thing John Dramani Mahama's gov't and John Mahama himself would have done, would be instead of seeking a co-equal in his great and irresponsible status of the embodiment of corruption in the whole of Africa, he would move away from it, but alas, John Mahama is so corrupt he is moving heaven and earth to get an equal in Nana Akufo Addo, much as it doesn't exist because John Mahama and corruption are Siamese twins and have embraced so tightly, absolutely nothing can dislodge John Mahama from his buddy corruption, nothing, nada.
This is clearly desperation of not a drowning man, but a drowned man under the excruciating weight of his unbridled and strong affinity and love for everything corrupt.
Would somebody just anybody tell John Mahama to shun corruption instead of finding a seeking a co-equal in the NPP flagbearer since there is nothing to be seen there, and to any sensible and competent mind, it is the right and proper thing to do and by far much easier???
Coming back to the issue of the judgment debt, much as one could have anticipated this onslaught on the stated and proven incorruptibility of Akufo Addo, what one could not have predicted was the circular firing squad happening in the NDC party and gov't initiated by John Dramani Mahama against his perceived enemies in the NDC party, the most notable being Dr. Kwabena Adjei alias Chairman Wayo, Wayoo the immediate past Chairman of the NDC party who recently lost his position to Kofi Portuphy, who it is alleged unleashed a barrage of corrupt acts under the supervison and support of John Dramani Mahama to win the Chairmanship position of the NDC party.
During the time the Delta Foods matter came up, he was at the Ministry of Agriculture? So the question is why is it that, indirectly, the specter of Kwabena Agyei aka Chairman Wayo Wayoo is looming large albeit behind the scenes in this matter?
