This "too-known" NPP fool goes as "Kwaku Azar" on Ghanaweb's SIL. He is parading himself around as a lawyer when, indeed, all he has to his credit is an accountant. He had someone write his GMAT for him to enter the United States academy and study accounting. Along the line, he veered off to study courses in law as far as accounting is concerned. Then,boom!! He has become a lawyer of repute by Ghanaian standards!!!

It is interesting to note that he has been at GIMPA (sabbatical leave or some leave of absence) to teach courses for which he was paid huge sums for teaching nothing to improve the situation in Ghana. He is well known as an exploiter of opportunities. Why is it difficult for Ghanaians to call such Kwaku Ananse characters top book? The records at GIMPA will tell everybody how much he has been paid over the period for being recruited to teach there.l Abaaaaaaa!!

The Ruling was unanimous and would be entirely wrong and disingenuous for you to suggest that, the ruling was a sole one delivered by Justice Gbadegbe. There were 7 Justices of the Supreme Court including the Chief Justice herself Mrs. Theodora Wood. Justice Benin JSC, elaborated on the ruling and provided further explanation to buttress the points raised therein. There are some illiterates including people from your party NPP who would read your write-up and think Justice Gbadegbe was the sole judge who sat on the case!

See the conflicts going on with the recent registration could have been avoided completely eg with partys carting people from another country to register, minors being registered etc.
Why can't we make such processes smoother?

Do the courts have the power to try him for contempt and punish him as such? Characters like him should be dealt the blow that they are looking for. That is why I agree with you that On this narrower question, the Court could say the use of the NHIS card is not sufficient to establish citizenship but the registration should not be voided on equity grounds.

Why are you then quarreling with Justice Gbadegbe's brilliant exposition taking the law which says that any retrospective law is against equity because it is breach of the human right law.

The rule of equity always intervenes to remedy a bad law and any decision based on that law.That is why I applaud Justice Gbadegbe for taking both the law and equity into consideration before coming to his decision.Brilliant legal reasoning Justice Gbadegbe.

That is from U.S., but the fact is that Ghana is a Member of the United Nations and Article 11 of the Convention on Human Rights states contrary to what the law professor wrote. Article 11 of the U.N. Convention on Human Rights states: (1) Everyone charged with a panel offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence. (2) No one shall be held guilty of any offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.
So that is the position of the convention and the 1992 Constitution on the matter, that you can not punish a person for committing an offence when the time the offence was committed it was not a crime. Thus, to wit, no verdict shall be passed by a court, that will take retrospective effect, that when the offence was committed in law it was not a crime.
The right of Mr. Tsatsu Tsikata was infringed upon by the Supreme Court when it ruled that the offence for which Tsatsu Tsikata was charged should take retrospective effect.
So though it was the Supreme Court that ruled on that matter it was null and void and to no effect.
That reminds us of the fact that though the U.S. is a member of the U.N. and signatory to its conventions the courts in that country have made a number of rulings that are in contravention of the acts of the U.N.

To the best of my memory, the complainants went to court to challenge the nationality and credibility of the voters card of the those who registered with the NHIS card. The question is what did the persons do wrong for complying to a law that allow them to use the NHIS card to register? Are we saying that all those who use the NHIS card are not Ghanaian? What justice Gbedebge said is that you cannot punish a person for complying to a law you set for him when you later notice that you made a wrong law. If Kweku Azar soes not understand this simple logic then sorry.

Secondly, the SC did not say that Justice Gbedebge was wrong. What they said is that there is a possibility that some of the people who registered with NHIS card may not be Ghanaian, hence the need for the EC to clean the register. It is the responsibility of those who claim those register with NHIS are not Ghanaian to report to the EC during the voter register is exhibition.

To the extent that the SC did not declare the NHIS card invalid at that time means all those who use that card to register at that time did so legitimately

Our judiciary is in a real mess!! Maybe it is time to move the Law School away from Makola. Judgements from the judiciary is becoming too pedestrian, and one does not need a law degree to recognise that!

The law is not ass as the Accounting Professor wants to make us believe. If Accounting is an ass, Law is not an ass.

He was admitted to the school of administration at the UNIVERSITY OF GHANA and was a Vandal. He obtained a FIRST CLASS--ACCOUNTING MAJOR --at the final school of ADM NOW CALLED school of business exams. He proceeded to the USA WHERE he read a PHD in accounting and taught accounting at the univ of florida. YES He was a top professor and went back to school to read law. Yes law in the states is a post graduate degree and the undergraduate background does not matter so long as you you have the required subjects and pass the LSAT. .He is and continues to be smart and has an analytic mind .No wonder he did very well in the LSAT exams .Don't belittle this guy for he is well rounded .Being a top accounting Professor does not mean he could not change and go a law school.if you're ignorant about how things work here in the states please research before you give your comments.A healthy debate devoid of insults is always encouraged.He is well qualified to comment on matters related to LAW IN MY OPINION.He does not need to come live in Ghana to qualify him to be involved in such debates.Let's stop being myopic.
