Whether the acceptance of the gift will influence the discharge of an official duty or the performance of an official function in favor of the donor;

Answer is Yes. He was awarded the construction of the wall and millions of dollars of road construction projects.

“Whether there is an implied obligation to return the favour in an official capacity in favour of the donor, the family of the donor or associates of the donor or the public officer’s family or associates;

The answer is Yes. The bribe giver is a contractor by profession and the favour was duly returned by the awarding him very exaggerated and expensive contracts. The gift preceded the award of contracts

According to Mr. Short, the main consideration in the matter is whether the gift was given in an attempt to influence the public officer’s discharge of his or her functions.

Readers would recall that Betty Mounds was the one who awarded SCHOOL building contracts at a triple price of the existing contract sum of some GH 80,000.00. And this happened at a time when they claim inflation was in the single digits. Could you imargin how foolish these criminal liars were. Kuffour built similar structures with 80,000 at a time when inflation was around 14.8% and under Mills it was 240,000 at a rate of 8.8%. And these buffoons turn around to blame the fall of the cedi on some mysterious dwarfs. Ghanaians, are there any brains in this country? I don’t mean the chiefs, kings and elders who are all in with this nasty son of a president to destroy this nation.

Ghana is in the pocket payroll of Mahama. He has bought the chiefs, kings, police and army and he believe he will buy his way into the next term for the presidency office. He doesn’t care or fear anyone; even JJ is on his payroll too. That’s why he is shameless and careless. He doesn’t give a damn about Ghana. This nation can be sold for $1, but Mahama will still cash in on billions. The NDC is only interested in kick-backs, fake projects, and the rest, evil against Ghana. If you actually defined what is a gift and what is bribe: Obama was in Ghana as a HEAD OF STATE/PRESIDENT on tour. He is not a businessman and did not want any contracts from Ghana. He took the gift actuall a TOKEN, which is done all the world, what a head of stae visit another country.

But as soon a gift is likeyl to influence a decison, especially when the give wants some business contract or previously had been awarded one then that is no longer a gift BUT bribe.

Meanwhile, if not because of GREED, why does Mahama need a SUV from another person? Is he simply not satisfied with the fleed of 8-cylinder SUVs parked at his residence?

I remember at a PTA meeting, a parent suggested that all parents pay some amount so we could buy a present for a female teacher who was going to have a birthday.

Her response was straight forward - 'that would be bribery and she is not required to do that'.

She suggested that it was enough for her, if the kids would sing 'Happy Birthday To You ..' 3 times.

So whoever you are, I tell you to drop you ignorance on gifts, bribery and corruption.

In Germany for instance, the teacher of your child will not even a HANDKERCHIEF as gift from you as a parent of that child, let alone a gift. And at most public offices, it is not permitted to do literal handshaking to greet. It is just OK to say 'Good Morning' etc.

Mahama's case is just a case of bribery and nothing describes the situation better.
