A then top NDC govt official, Nii Lantey Vanderpuije, said that Akans should not be allowed to vote in Odododiodio constituency because they were not native Gas and that the constituency belonged to Gas. This got Kennedy Agyepong mad who irrationally suggested that, since there are many Ewes, Gas and other tribal groupings residing in Ashanti Region which is one of NPP's strongholds, then they should also be eliminated from there. For those of you who don't know,the Supreme Court has no power to fine media houses when they violate media rules, we have Ghana Media Commisdion and National Communication Authority to deal with media regulations,asking media houses and their leaders to pay such a huge amount is outrageous and abuse of power,that court has no right to ask these people to pay a fine or go to jail for something they had no control over, even if the station breaks any rule or law its leaders don't face criminal charges,the media commission and communication authority are the right entitities to deal with media violations and issues.

2ndly in a contempt to court case u don't need a prosecutor , it's the criminality in the case which the AG should have filed charges n prosecute.

I've always defended Dr Kennedy but I think he got it wrong this time. Mugabe and the owners were found guilty because they never took action against the panelists and their statements. In fact they initially encouraged it but pretended or decided to take action when the SC decided to prosecute the matter. I think the SC has done well. Henceforth, people will be more measured in their comments on radio.

Finally, I humbly think it's absurd for Dr Kennedy to blame or condemn the SC for not taking action against those who alleged bribery allegations against them regarding the Election petition. Does he know anyone who made that stupid allegation? That mischief was perpetrated on the internet and spread through the social media. It was never a topic on our airwaves, and the SC is sensible enough not to embark on this wild goose chase. Dr Kennedy is wrong and should get his facts right if he wants to protect his credibility

I know no law but I'm just being curious. Even if the adjudication of such a case begins from the lowest court in Ghana it may eventually end up in that very Supreme Court upon appeals.

What Kennedy has done is insinuating a pretentious and equally presumptuous personal interpretation of technical issue for populous. approbation

Kennedy lacks a true understanding of the law and takes upon himself the onerous challenge to rough and tumble with the law lords.

For example his lack of understanding of the implications of vicarious liability exposes his ignorance about the law. Casting oneself is the common man's hero betrays ones intellectual hypocrisy

My candid advice to him as a fellow old school mate in Ghana is for him to stick to his family medicine at best and his somnambulist criticism of his estranged party NPP and the law to those who have spent years to have deeper and broader understanding of the majesty of the law.

What Kennedy fails to grasp is that the SC has the authority to make orders to preserve existing conditions and a wilful disregard of those orders constitutes contempt. The power and dignity of the SC is are paramount

When you employed somebody to work as a broadcaster he or she should signed broadcasting policy and educating him on ethics and the laws so after they have gone wayward immediately you jump in and applied the punishment of the policy, we saw what Songo did when he attacked the EC and what happened the media jumped in apologised and punished Songo we all saw it. You don't wait to go to Supreme court to apologise, in that case the owners deserved to be punished.

In any event, did the SC itself, not stymie the AG, by issuing that rather hasty show cause summons directed at the individuals, who have now been the convicted and sentenced?
Again, let's not forget that the proximate cause for the very unfortunate statements made by the misguided duo, was the equally unguarded and prejudicial statement, made by a panel member, adjudicating the matter, Justice Gbadegbe, to the effect that the EC, the respondent, in the case before the court, was intending to plunge the nation into chaos and turmoil!
Having said all this, I believe the AG ought to be more proactive in dealing in dealing with the 'tons' of mischievous and frivolous lawsuits that have been thrown at this particular administration. The tardiness of her outfit, in mounting a strong and vigorous defence in court actions, challenging the authority of the President, to conduct foreign policy[ as in the Gitmo 2 case],and thus curtail the powers of the Executive, is very troubling and worrisome.
This AG, appears to be oblivious to the fact that this administration, of which she is an integral part, is facing an unprecedented onslaught, by certain elements in society,[the GBA, LMVCA,AFAG, etc], who true to their word, have vowed to make the nation ungovernable!

The statement by the BNI declaring them as harmless a day before they appeared in court shows the power of partisan protection backing them. The very least the SC court had power to exercise under contempt law was the discretion to punish them to set an example that despite your might and power, order and sanity will be restored if you show contempt to the SC and threaten their lives in an ongoing case. This man calls himself a Doctor? Also, in a case of contempt of court, the judges of that particular court preside over the contempt proceedings. So why is he saying that they should not be trying the case? Those individual SC judges that were personally attacked by name, recused themselves from the case. What else does he want the court to do? What other court in the land is qualified to sit on the case?

As for the judges I think they have really disgraced themselves by the scandal they have caused.Throughout the political history of Ghana, various leaders - Nkrumah, Busia Kuffour have one some occasions refused to accept the judgement of the supreme court at various times and even gone ahead to appoint judges (partisan) to overturn judgements! Mahama must by all means avoid such line of action, but rather proper and good lawyers should be recruited to appeal the case for judgement to be reviewed! There is an element of trap looming just around the corner , Mahama should be careful not to fall into that trap!

1. The fact that hosts and panelists make irresponsible comments whilst issuing death threats to members of the judiciary directly does not absolve owners and directors of the FM station in this case Montie FM, from liability. It is actually the onerous ethical, moral and corporate responsibility of the directors and owners of the FM station to ensure employees of the company and panelists they entertain in their company, ensure the highest standards as required of their company which would come from their values, beliefs and character within the framework of codified standards of conduct. It's absence or otherwise is no excuse and in that regard, the Supreme court exercised the right and proper jurisdiction in terms of reach and dealing with the contemptible, reckless, dangerous and murderous statements of the contemnors because it is deemed to have been made by the directors and owners of the station. The Court's request to the directors and owners to furnish it with steps it has or would be taking to prevent a reoccurence of such irresponsibility answers directly to the liability of the owners and directors of the station.
2. The inability of the AG to act on the criminality inherent in the statements made, in and of itself, does not mean those criminal statements were not made and the perpetrators should not be held liable. Maybe, the most important question from that scenario has to be, why did the AG not pursue prosecutarial action against owners, directors and the hosts and panelists of Montie FM? That would make for proper and intelligent debate instead of seeking to question the jurisdiction, legality and right to address the issue, when a clear case of criminality exists and founded on the basis of the facts. We do not believe it is the position of Arthur K that when clear contempt has been established against the Court, same cannot take measures to address it, when the legal precedence exists.
3. Arthur K questions the impartiality of the Court and seeks to suggest the Court acted in a capricious and whimsical manner by referencing statements made by some individuals including MP's, political party's and even President's and cites the example of a statement made by an individual that called on some tribes to kill other tribes in the face of evidence that some members of these tribe were being severely assaulted. What Arthur K does not say is whether that statement was in contempt of the Court or it fell within a specific provision of the penal code for which it was sent to court. It can be debated, but we dare say, Arthur K is comparing grapes to water melons here and completely unnecessary, needless and unsubstantiated.
4. The Anas exposè puts paid to compromised members of the judiciary and in the specific instance of allegations of bribery against members of the judiciary in the election petition, the individual who raised that issue and happened to be a Dep. Min of Information at the time, was summarily dismissed in the infamous "Vicki leaks" scandal. Arthur K may want to refresh his memory of that incident if he would want to use that to undergird his hollow argument.
5. For Arthur K to even think to suggest the contemnors were in some way handicapped by the knowledge and resources sufficient to execute their threat of murdering the Judges is by far, the most stupid argument to make, when the contemnors were emphatic they knew the residence of the Judges. If that was not sufficient knowledge and grounds to weaken any advocacy of counsel as to how those irresponsible threats were going to be carried out, and against the backdrop of statements made by leading members of the NDC party that " there are so many ways of killing a cat" one cannot intelligently comprehend what Arthur K is going on about.
Finally, just to get off this shallow and hollow piece by Arthur K, Ghana is not going to sit down for criminal elements and their sponsors to usurp the authority, independence and functions of the judiciary and co-opt the judiciary into their unholy schemes through threats, intimidation, fear and the promise of death which saw to the dismissal of he Arthur K, when he protested about 3 decades ago. That would be abrogating and shirking our shared and collective responsibility to participatory democracy, good and accountable governance, the fundamental and constitutional human right to universal adult suffrage and the freedoms afforded and accorded each and every Ghanaian in our democracy and under our Constitution. It is a work in progress but by jove, it will not be undermined and held hostage by the minority few with a predisposition for impunity, wantonness, arbitrariness, dictatorship and gross disregard and disrespect for human decency and values.

The criminal aspect on threat comes under section 75 of the criminal code and should be pursued separately by th AG.

In the matters of contempt the courts can take action without AG. I don't have problem with the view that the Supreme Court is taking the prosecutor's role because Arthur Kenedy is not a lawyer. So he is pardoned for that.

I have three points to make on this issue.

1. The holy book says every careless word will be accounted for. Again it says, life and death is in the power of the tongue. Therefore people must be made to account for their careless words.

2. Secondly if this will serve to curb the rot on our airways then thank God. Election is just by the corner and the actors must be made to tone down their language. The Muntie 3 should accept their ordeal as the sacrifice for peaceful up coming election. They should thank God that they have been found worthy to pay such a price for mother Ghana.

3. My prayer is that the Apex court will do the same to every recalcitrant speaker on radio or television and even the news paper. As it stands now it seems as if when one group of people commit worse crime they go scort free but when others say less harmless things they are made to suffer for it.

Why charge the owners too. Is it a case of targeting the owners or what. Can the CJ be blamed for wrong of the Anas judges?

My final comment is how can a judge sit on his or her own case and ever be fair. Listening to lawyers debate cases I have come to the conclusion that as we are all fallible humans no man can get true justice in a country like ours more so if some of our judges will be taking bribes to pervert justice, like the Anas judges.

The justices should not have prosecuted this case themselves because they are the victims of the threat. If they are not satisfied with the judgement by the attorney general they have the right to ask that the case be referred to the Supreme Court because their role is to review cases that are brought before them for the interpretation of the law as it applies to cases . However it is time to bring sanity to the way and manner people speak these days in this political atmosphere. People should be held accountable for what they say . The fact that we have freedom of speech does not mean that any body could say anything and get away with it . So for those who are making so much noise over the decision taken by the justices , they should chill because it is time we stop the nonsense of people just saying anything they want

Free speech doesn't mean people should be maligned, threatened, intimidated or bullied. Ghana is not progressing because the courts are not independent. Politicians and party bigwigs are stealing left right and centre and they know no one can touch them. All we hear is they are first time offenders, please have mercy on them etc. One should know the consequences of their actions and be prepared to bear them. Dr Kennedy can you talk like that in America? We should learn to be responsible in all we do. Carpenters trotro drivers teachers etc are all telling the lawyers and the judges how to do their work. For me Arthur Kennedy is one of the rarest honest people in Ghana. He is absolutely right. Why didn't the Supreme Court invite the owners of the fm station on which Sir John insulted Atuguba (JSC). This has rather brought disrepute to the highest court.
