Prison sentences will serve as deterrent to future would-be hooligans like Amarteyfio and Amedika who lead the crusade to abduct and kill judges, including Mrs. Justice Koranteng Addoo who was pregnant at the time. Jerry John Rawlings, Kojo Tsikata, and many of the so-called revolutionists were in support. I would like to remind Ghanaians that up to today, no one knows what Jerry John Rawlings told Armartefio at the shooting range. Posterity will judge all of them.

Four months in prison is enough but I would have asked for a year or more and be made to sign a bond of good behaviour after jail for 20 years. Yes, some NPP political gurus were able to go away with some idiotic statements that create tribal hatred. How long can we tolerate this? It is time to say it is enough. Judges need to be tougher on people who spew garbage on the airwaves. I am not calling for a police state in Ghana but people who for example insult the president or the former presidents and aspiring ones for no reason should be made to have a stay at the prison for at least a month. Those who call for tribal wars should be in prison for 3 years without the option of a fine. Then, they will learn sense.

We can grant him his right to offer opinions but we cannot allow him his own truths. The judicial realm is technical so his opinions must stay at the lay mans level and would be understood as such. You cannot critique a judgement you have not read.
His arguments in his latest write up on Lawyers and the law have analytical gaps regarding some of the examples he sites to support his position. Judges are not stone statutes . They are human so may I ask what were the political and power environment in which the Dred Scott, Baffour Akoto and 7 and the PNDC situations occurred? Does he understand the Preventive Detention Act drafted by Geoffrey Bing , a brilliant legal mind like Tstasu Tsikata. ? AK needs to read Tudor ( Henry Vlll) history. In periods of tyrannical power dictators ( mob or sovereign ) have used brilliant lawyers and the law to cow judges to rule to their wishes. Those situations occur due to the fraiility of the human spirit not that of lawyers or the supremacy of the rule of law. What we can say about Ghana's judiciary in our history, 59 years, is that when the situation is right they have stood up for the supremacy of the rule of law. They ruled against Nkrumah and CPP government in the case of Ako Adjei/Adamafio/Crabbe for which the Chief Justice and other judges were sacked. Then there was Abusia and PP " No Court" brouhaha decision. Under the PNDC three judges paid the untimate price for their decisions. In the MunieFM case if the Police and the Attorney General had executed the law they have sworn to uphold , the case might have been handled by a jury of ordinary citizens. This believe in a jury, didn't we have citizens courts under PNDC that resulted in the miscarriage of justice? The law cannot be separate from ordinary citizens. So his Title to criticism of his comments should have explored The Lawyers, ordinary citizens and the Law.
Mr Kwakye we are glad you count Ghana among the civilized countries. In all civilized countries threats to murder and rape any citizen is a crime not free speech. We must stop this blind hypocrisy and try and build a society where the rule of law is supreme and the law applies equally to all citizens whether they are with the ruling government or not.

The Tsikatas were never involved but only the Ashanti mindedness is what presented the Tsikatas as brain behind the killing timely killing of the 3 judges.

When the 3 judges found the striking GIHOC workers guilt of striking and were therefore sacked, who asked of how they managed to continue living when the decision of the then cour was partial against the striking workers at GIHOC of which Amartey Kwei was a victim.

Why would the Ashanti primitive and tribal sentiment influenced the NPP and tried to cause the public to see it like the Tsikatas were involved when they were aware of the anger of the striking workers and the reaction of Amartey Kwei to revenged against the 3judges and then head of the GIHOC major Acquah.

Arthur Kennedy could say things to win support from the public because he believed those 3 judges and major Acquah killed were considered clean while Amartey Kwei was seen the evil doer, but who had sincerely questioned what the 3 judges and major Acquah did that later led to their timely death.

Questions of this nature could help many Ghanaians to know how to exercise their powers given them when in higher poisitions without any bias in the area of judgement, for the evil that men do lives after them. For there are people who never allow any partiality exercised against them go unpunished. Period

When the court presided by those 3 judges supported the govt in that time to sack the striking workers of GIHOC of which Amartey Kwei and othes became a victim of joblessness and could never support their children's future while on the other hand the judges who partially supported the govt smartly in that case continue to receive salaries and were able to take good care of their children's education.

In reality nobody supports killing people but the evil that men do lives after them. Amartey Kwei intentionally and willingly retaliated against the evil work of the 3 judges and major Acquah, the then head of the GIHOC. Ghana needs to learn and know of the consequencies of the negative application of the law and positions in the system.

This runs through our history especially, the period, prior to the fight for Independence from colonial rule.
You claim, the three Appeals Court judges sat on cases related to the GIHOC crises. The records that I have furtively glanced, shows otherwise. Rightly, the three judges ruled in favour of court cases of private citizens, whose properties had been illegally confiscated by the AFRC junta. Persons who were the legal brains of the junta apparently, were not amused by the rulings of the three judges. So were those filled with anger and hatred. They arrogated to themselves, the right to take landed properties from some class of citizens by sheer force of brutality, clothed under the guise of a so-called revolution. Major Acquah was the Personnel Manager at GIHOC, who signed the dismissal letter of Amartey Kwei in labour agitation issue. So the fate of the four was sealed. Besides Amartey Kwei, who felt he lost a low paying job for a top government position by coincidence, did not factor his good fortune in the matter. But what could be said to be the interests of the four young soldiers, who carried out the abduction, killing and burning the bodies of the three Appeals Court judges?

Nobody can therefore begrudge him his place in asserting his opinion on any subject he chooses to comment upon, especially since he is also a true citizen of the country.
Those who try to stop him by flaunting their law degrees do not know that the law is about pure commonsense, logic and wisdom, attributes equally acquired through independent study, not necessarily through a structured course. And I can testify that Dr. Kennedy is very well read beyond the scope of his medical profession.

But whereas many of the accusations against lawyers are true, his swipe against defense attorneys is ill informed. This is because a defense attorney does not necessarily defend causes he believes in. In fact, the nature of the profession requires that every cause of action is well defended on each side in order to promote the course of justice.

Therefore for Dr. Kennedy to morph defense attorneys with rogue lawyers is both pedestrian and unfair.

What people don't realise is that the law is not made by or for lawyers only. Every citizen has a right therefore to proffer his/her opinion, and to chastise someone for expression an opinion - very well argued for that matter, is tantamount to disrespect for anyone other than lawyers. Who says only lawyers are wise or intelligent enough to understand our laws. There are many who are worth their salt, but there are equally many who just have the certificate but are useless and clueless about interpreting the simplest point of law. Ghanaians should stop worshiping lawyers as demigods. I have heard a lot of primary 1 legal arguments on Ghanaian TV and Radio by so called lawyers and often times wonder where those people got their certificates from - My mum's backyard I guess.
