I listened to her interview last Friday on GTV. As a Kayayei she was called by an unknown person to load his goods from the border side of Togo to Aflao, payment was to be made upon delivery. immediately she crossed the border, she was arrested at the checkpoint for carrying cloths packed together with wee. since as a kayayei she has no right to open the clients goods, she had no idea what she was transporting . Even though she told the police to allow her answer the incoming calls of the owner of the goods who kept calling, they refused and rather took the phone from her and switched it off and remanded her. At the court she had no lawyer and was given 10 years after the hearing.

If the judge had discretion in sentencing and if the suspect had assistance of counsel, she would not be in this situation. Let's have a re-hearing and revoke the sentence. You need mens rea (criminal motive) and actus reus (physical element) acting in concurrence for a crime to occur. We have the physical element (carrying the marijuana) but there is no criminal motive. Free her immediately.

B'cos,I don't think illiteracy or lack of knowledge is considered/acceptable in the Court but being a Kayayei or head porter who could easily be deceived.Moreover,the country is not developed enough for kayayei to make enquires about the content in a bag. They struggle to be the first to be considered to have the load,in the first place.Again, if She was not represented in Court by a lawyer, it's likely She did not get a fair Trial.The State was supposed to ensure She was duly represented in Court. Not charging is deceptive to win sympathy but rather throws more light on the operations.That,is a blatant lie,in my personal opinion. She get paid if mission is accomplished. Again, a travelers Bag is zipped and padlocked.And not Sealed or left opened. A sealed Bag raised the suspicion that it needed to be thoroughly checked, which the Custom officers did to reaveled the contents.The only problem is that, She was not well represented in Court. Therefore,this case should go to retrial,in my personal opinion.Anyway.

This matter should be looked at and if she is just carrying a load then the load owner should be prosecuted.In situations like this the police will follow the parcel and arrest the owner,but in Ghana that is too much work.
