The professor is totally wrong in his assertion that article 72 was written for the president to correct some injustices by the courts. That is never the intention of the constitution. That article is purely for humanitarian grounds by the president. Only the judiciary can determine whether a person was properly convicted or not. The president has no legal or constitutional basis to challenge or overrule the decision of the Supreme Court. However, the president can enact article 72 on compassionate grounds to mitigate or pardon a criminal which doesn't mean a challenge to the conviction handed by the court.

The president has the right to pardon any one but the question has to do with the circumstance behind this pardon. You may have the right but when it is not well applied it becomes wrong. Let me use Obinim case for example. Those he punished were his adopted children and he has right to punish them when they go wrong. So why report him to police. simple because he applied it at the wrong time. As a learned man it would have been appropriate to educate our people as to what they should say and do in order to build a better Ghana.

Judges MUST shed of the NPP,NDC cloates some of them are wearing to protect Ghanaians and maintain the good image and integrity of judiciary in Ghana.Tsastu Tsikata's case comes to mind when the trial judge displayed her power of ajudicationy in a partisan manner with vested political interest(Tsikata's jailing was a miscarriage of judgement and if appealed and reviewed it will be a slurs in Ghana's judiciary) and it is a worrisome trend in our in the judiciary in Ghana and MUST BE STOPPED.

Perhaps, the professor's deep knowledge and understanding of the law and constitution, made it easier for him to get to his stated position on the issue. I am not that privileged. I see it as very dangerous, when some members of the community ( Montie 3 ) will broadcast threats to judges, who were sitting on a live case, with rape, abduction and murder. The Montie 3 had been angered by what they see as undue pressure being put on the Electoral Commissioner, by the Supreme Court. The Supreme Court was sitting to give directions in the Abu Ramadan suit against the EC. The Montie 3 would not have the case called against the EC, hence their threat to the judges. When we support persons with such dangerous ideas to our laws and constitution. Would we be said to be doing any good to ourselves?. I had thought history is the best teacher. Has the nation not learnt any lessons from the June 28th, 1982 experience?
