Right on point, Sister! Dr. Arthur Kennedy makes an intelligent analysis of what is going on with the Montie 3 pardon. And he must not be insulted for it. His arguments were non-partisan but very logical, prim and commonsensically legal.

I listened to Barbara Asamoah on Asempa FM with KABA yesterday and she did also make similar poignant points about the President's action, and also received as much negative and insulting responses from some of the listeners as Arthur K is receiving, now.

What I see about these negative reactions to the President's pardon of the Montie 3 is that folks seem to be processing the facts of the suggested heinous actions by the utterances of the 3 that led to their conviction but not the entire legal rights and limitations of the stakeholders in the case as provided by the Constitution.

The irony is that we all are fallible and when we get in trouble with the Law, would like to exploit any rights the Constitution offers us to mitigate our punishment.

Even as the Constitution allows the President to exercise the rights he invoked to pardon the Montie 3, folks do not think the punishment for the 3 culprits was enough for their crime. Don't we often think so about many other crimes?

Nevertheless, the reactions we observe among these pardon rejectionists could well be grounded in their partisan opposition to the Montie 3's perceived partisan affiliation rather than objective total consideration of the issue.

The Court itself decided to offer the trio a penalty well short of the maximum allowed under such crime as they were found guilty of. There might have, surely, been a conscientious deliberation by the Court to assess the penalty the culprits got within the confines of the Constitution. Yet, hardly could we claim their decision was not affected by their personal stake in the matter, however constrained.

The President also could have been driven by both partisan and precedence considerations to arrive at his invocation of the rights to offer the culprits the Pardon.

So, whether the folks want it or not, we have to live with the decisions of both the Judicial and Executive Powers, so long as the two do not counteract each other. The Judiciary duly exercised its Powers that went thus far to send the culprits into jail. The Executive took the case from that point on to exercise its Powers to grant them Pardon as the Constitution authorizes. We have to live with that. The fact of both Powers flapping their intimately held biases around the case cannot be denied. But if they both restrained themselves to act within the Constitution, we cannot ask for anymore or any less.

Looking at past cases, there might have been others who disagreed with any Pardon the previous Presidents ever gave but had to live with it. So, having kept the same Constitution intact, we must not wonder why the same Constitution has been employed by the President to pardon the Montie 3.

Unless, anyone could prove the President's action is illegal, he cannot be charged with lawlessness. And that is the poignant point Arthur K made which he does not deserve insults for. He was just telling the truth.

We must always keep our emotions in check if we want Justice to prevail, and the Constitution to remain sacrosanct.

I knew this Arthur Kennedy when he was a student at Osei Kyeretwie Secondary school in Kumasi. I saw him when he was a refugee in Canada after being hounded by Rawlings for his role as NUGS president. In all these instances, he always showed high levels of disrespect and assumed an aura of condescension towards people around him. He always felt he knew more than anyone else around him and never felt the need to see things through someone else's eyes. I thought he would change over the years but he seems to be the same vindictive arrogant individual he was, growing up.

Why are folks taunting the President for granting the Montie 3 Pardon but not the Council of State that recommended the Pardon to the President?

Have we given enough thought to the possible ramifications of the President rejecting the advice of the Council of State? And what would the Akufo-Addo's Mafia say had it been some of their cohorts that got in trouble and pleaded the Council to intervene on their behalf and the President refused to go along with the advice?

When we decide to protest an action, we better think beyond the immediate derived convenience to us, and consider its future reflection on our own fate.

We must always leave some room for mitigation, and the chance for us to duly take similar advantage that such little space could provide us, too, in the future, if we find ourselves in similar confinement.

Honestly, many believe there have been many illegal things within the NPP under the nose of Akufu-Addo that have gone unpunished. And folks have to live with that. A case in point is Kennedy Agyapong's instigation of Ashantis to massacre Gas and Ewes. What punishment did he get from the Court for that? Yet, we lived with it.

Yes, the president has the constitutional backing to pardon anyone he likes. In this particular case, Arthur Kennedy who led students to criticize and demonstrate against the J.J. Rawlings dictatorial style of leadership, now does not see the lack of wisdom in the president pardoning of the three reckless men. I am sure Arthur Kennedy remembers names like Amartey Quaye and Amedika. They brutalized and killed innocent judges for ostensibly being anti-revolutionary. Arthur Kennedy saw it fit to criticize the men who were involved in the killings and pointed to the involvement of J.J. Rawlings. If he could see through the senseless brutish murders then, why can he not see through the danger in statements the men uttered on television? Shame unto you Arthur Kennedy, I have lost my respect for you.

Don't you think those people who expressed an opinion about the subject matter also share in your opinion rather than merely criticizing the Government's Constitutional Right to exercise his Prerogative of Mercy?
If I am not mistaken, your point of view falls under the the Biblical saying in 1 Corinthians chapter 10:23; "All things are lawful for me, but all things are not expedient"...
