DR BAWUMIA: _******____-----International rating agency Moody’s has not upgraded Ghana’s sovereign credit rating contrary to assertions by the Mahama administration to that effect, the vice-presidential nominee of the main opposition New Patriotic Party (NPP), Dr Mahamudu Bawumia, has said. Speaking at the launch of the NPP’s 2016 manifesto at the International Trade Fair Centre in Accra on Sunday, 9 October, Dr Bawumia said Ghana’s sovereign credit rating got downgraded to (B-) under President Mahama despite having oil revenue at its disposal, from (B ) positive (without oil under the NPP). Moody's Investors Service recently affirmed the Government of Ghana's issuer and senior unsecured rating at B3 and changed the outlook to stable from negative. Dr Bawumia, however, noted that nothing had changed except the revised outlook. He said, in fact, international rating agencies like Moody’s, Fitch and Standard & Poor’s now have basically the same credit rating for Ghana. “The recent revision of Ghana’s outlook from B- negative to B- stable; that is the equivalent of B3” with the revision of the outlook from negative to stable, “has resulted in a misinterpretation by this NDC government and President Mahama that Ghana’s credit rating has been upgraded.” “This is in fact not the case. Moody’s did not upgrade Ghana. Ghana’s rating under Moody’s is still B-. It is only the outlook that has been revised and that is not equivalent to a change in rating or a rating upgrade. “Sometimes one wonders whether they don’t read or they don’t understand. So, let me give Mr President a free piece of advice: ‘Mr President, please desist from embarrassing yourself by stating that Moody’s has upgraded Ghana.’ Your economic management team should explain that difference to you. “The Mo Ibrahim 2016 report on governance shows that on virtually all key development indicators such as safety, rule of law, human rights, economic opportunities, infrastructure, business environment, human development, health and public management, Ghana is worse off today than it was 10 years ago,” Dr Bawumia said.

The corrections should be made within opening and closing of submission of forms. Bogus lawyer consider this: If EC opens nominations on 11 October 2016 and forms are to be submitted on 30 October 2016 at 12 noon, one has a whole 19 days to complete filing of forms and submit them. If on the 21 October 2016, the EC detects an anomaly in your forms, it can draw your attention and you could rectify the anomaly and re- submit the form on say 20 October 2016 i.e before the closing date. If on the other hand you submit the forms on 30 October 2016 at 11.45 am, and there is an anomaly, how do you expect the EC to go through the form and invite you for corrections before the 12 noon. If you do that, the EC will automatically disqualify you.

No, your argument is weak. The time for correction should be after closing date. Unless specifically stated that applicants are to make submission earlier and allow some time for feedback before it closes finally.

Section 9(2)(a)(b) of the CI refer to mistakes and not acts that could be or are criminal. Would the EC not have condoned criminal acts by asking the political parties to remedy those criminal acts? Ghana should be serious as a country and as a people. This is about a future president of the country and if the aspirants cannot get this elementary state right as well as resorting to breaking the law, what do you expect from them when they become president? The EC is right and the laws of the land should be enforced to the letter.

I beg to disagree with Lawyer Osei on section 9(2) of CI 94 because last sentence of the above sections said........'within the stipulated nomination period'. Meaning if you submitted your forms late you will not be covered or insulated by the above section and thus no opportunity to make corrections detected.
Indeed the EC gave instances where some candidates were given that opportunity to correct some anomalies in their completed forms because they submitted aheard of the deadline.

Where was this illiterate lawyer trained? He should be told that the errors committed were not administrative errors, rather it was deliberate attempts to commit electoral fraud. If the affected parties were properly organised in every constituency as required by law, those criminals who perpetrated multiple endorsements won't have been able to do so. If they all had lawfully elected constituency executives, it could have been child's play to garner the necessary endorsements. This lawyer should be barred from practising.

How can the EC know whether these are sad mistakes or an attempt to forge ? If you make a false statement in court the judge has the right to pardon or punish you. They should take their case to court.
