It seems Nduom knows he can’t win on the plea that the EC did not follow the law in disqualifying him, so PPP is just following a script to set things up for a NATURAL JUSTICE plea by Nduom. Natural Justice simply implies bias and impartiality in rendering a decision. Simply, they are trying to accuse the EC of bias and impartiality in disqualifying Nduom.
There are three forms of bias in relation to natural justice:
1) ACTUAL BIALS allegation is uncommon because it’s near impossible to prove – will require Nduom to prove that EC was prejudiced in its decision to disqualify him.
2) IMPUTED BIAS will require Nduom to prove that EC or any of its members involved in the decision to disqualify him have pecuniary or proprietary interest in doing so -- another hard case to make.
3) APPARENT BIAS is the easiest, and Nduom is going for that one, trying to make a case that the conducts or behaviours of EC’s decision-making members give rise to a suspicion that the EC members were not impartial in disqualifying him. Well, PPP will have to provide hard evidence (e.g. tape recording) or witness evidence to substantiate the allegation that Nduom/PPP was actually threatened. Even if PPP can provide such evidence, they have another problem:
In order for a decision to be possibly biased, it must be ARBITRARY, DICRETIONARY and SUBJECTIVE. This is not the case with the decision to disqualify Nduom -- it was based on the law. If you clearly stole a goat and was arrested, the fact that you and the arresting police officer have been fighting over a woman doesn’t negate the hard fact that you did steal a goat and must face the consequences. Thus, this case goes back to whether or not the EC followed the law in disqualifying Nduom.
The other crucial thing Nduom’s legal team may be missing is that in Common Law jurisdictions, in the cases of administrative acts or decisions under judicial review, the court can only intervene on the grounds of ultra vires. What this means is that the EC ought to have overstepped its powers in order for the courts to intervene. It doesn’t look like the EC overstepped its powers; the EC is authorized to vet candidates such that those who meet the legal requirements STAND NOMIMATED and naturally those who don’t meet the requirements STAND UN-NOMINATED, i.e. disqualified. It looks like Nduom is fighting a lost battle.

In government it's called 'Ministerial Responsibility' - you take responsibility if you are not able to supervise your staff well enough and there was gross incompetency or scandal. Ministers resign (or are fired on grounds of Ministerial IR-responsibility. If he can't do it now, when? As President, would he just sign off documents submitted by his technocrats without looking them over? It's not as easy to become President -- the standards are high, and the nomination/vetting process is to make sure right caliber candidates are paraded.
