The owner can be prosecuted if he/she doesn't have the display warning of WILD DOGS ON THE PREMISES.

There was no 'beware of the dogs'warning notice on the gate of the house, the poor kid jumped in to retrieve his shoe, not a ball which a friend threw into the house,owner should definitely face the law.
Owner is absolved of any liability .its called Castle Law.you can't enter any private premises without invitation which the kid violated unfortunately.The dog was protecting its Masters property.
