There was near pandemonium and confusion at the Annual Global African Investment Forum held in Westminster, Central London after a heated exchange between Ghana’s President John Mahama and former Nigerian President Olusegun Obasanjo degenerated into open insults.This was due to General Obasanjo openly accusing the Ghanaian president and his government of blackmailing and collecting bribes from Nigerian businessmen in Ghana, buying numerous properties in Nigeria and South Africa and financially contributing 12 million dollars to Goodluck Jonathan’s campaign last year. This infuriated President Mahama who lost his temper and pointing his finger, called General Obasanjo an ” idiot” and a “silly buffoon”.It took other ministers present as well as Ugandan President Yoweri Museveni to calm tempers and usher President Mahama to a nearby room. The forum, which takes place from 1st to 3rd December is attended by African Heads of States, Ministers, Private equity firms and investors to discuss opportunities for investment and development in African Economies.

It is all about Shortlisting. I mean SHORTLISTING from one level to another. From the EC's level or point of view to the Electorate (voters) point of view. So what is the Court telling is today. They should not create chaos in the country.

Once you fail the first leg of exam or interview procedures you are not allowed to continue or no chance is given to you again.....The court is one of the many human institutions just like the Electoral Commission with their strength and weaknesses. So let's be warned, they are not always right.

We all saw how you went on your knees to beg he Supreme court to forgive Sir John and co. The judge was being pragmatic knowing that the PPP had threatened to drag the matter to the Supreme Court and their supporters were demonstrating in front of the court. The judge deserves praise but the EC was only upholding the law as it understood it. There is no need for show boating by Ayikoi Out. The EC is mindful of the short time left so would not appeal, hence no one should start bashing them. This decision is bound to come back and haunt us in the future. Otumfour told Charlotte Osei that the EC has been too magnanimous in allowing mushroom parties to register without fulfilling the requirements of the electoral regulations. And he was right. The EC should have insisted on this from the onset and avoided this situation altogether. When you close your eyes to minor infractions, you would not be able to take action against major ones. Let everyone including lawyer Ayikoi Out take note.

That is a different animal altogether which the EC is bound by it's own laws to enforce.
If the EC feels that is what needs to happen nothing prevents them from going ahead to enforce those statutes having been ceased with the facts and the evidence.
In the matter of the disqualification of the PPP, the brazen and outrageous nature of the disqualification smacked of the EC making it's own rules and laws as it went along and enforcing such laws on a whim.
The so-called independence, the EC is wont to throw out there anytime it messes up via commission or omission, wilfully, does not afford it to act in manner or fashion inconsistent or incongruous with the laws or absence of the laws or the Constitution.
As one of the Greatest leaders to emerge out of Ghana Ex President Kufuor said, "the EC is not a power unto itself".
The EC's so-called independence is inherently subject to the Constitution and the laws of this country, indeed, it is a product of the Constitution ab initio and for as long as it exists would be subject to the Constitution and the laws of this country ad infinitum.
CI 94 just as CI 91 are beginning to look like flawed instruments guiding the 2016 elections and one begins to wonder, what is going on at the EC.

This decision is one of convenience rather than legality. It opens a whole can of worms for the upcoming elections. There is no time for appeal and lawyer Out is already boasting and advising the EC to allow all disqualified candidates to come and correct their errors as if all were disqualified on the same grounds. I don't want to believe our System encourage forgery and mistakes. I think Ayikoi Otoo rather lacks the administrative experience,in my personal opinion. The public read on this forum that time was given those aspirants to correct their mistakes. Having said that,I will personally not Vote for an aspiring presidential Candidate who could not fill his/her nomination Form correctly.Such aspirant may sign Bad Agreement to the detriment of the nation.That is one reason why with all our natural resources the Citizens live in poverty.The presidency should not be entrusted to mistakes prone Candidates (error and correction Candidate).Charlotte Osei needed no consultation in performance of simple administrative duties in which She acted well.The correct clause in the Constitution is Needless, in my personal opinion.Anyway.

What was wrong with EC's decision to disqualify those didn't do the right things? The EC was only performing her duty as people were asking. Let's compare EC's task with the judge who threw away NDP's case? That judge was also equally doing his work. Not because it's election issue so if NDP err in filing their case the judge should close her eye over it! So far as they failed in filling the forms , & this is the primary test they should be disqualified. The judge saw that the was an error so he gave PPP the chance to go and rectify the error. It is only the court that has that prerogative to restore that order if not it is the same Ghanaians who would be saying some people didn't meet the criteria but EC rig for them. So to me I believe the EC did a good job. And the judge also gave a good verdict. This rather showed EC is up to the task. The parties should blame themselves because some of them have seasoned lawyers who could have helped in filling out the forms and not wait for problems to come before inviting the lawyers. CHarlotte is not a victim of gross inexperienced. Our presidential candidates took the filing to be cheap thing and they didn't see it serious to invite lawyers to help. How can people like Akua Donkor etc be assessed by the EC; and the EC can't stop her from standing because she has the right , if she is able to meet criteria ok if not you are disqualified and this is good for democracy. Do they think to stand for presidency is a joke? But however PPP I congratulate you for being strong. Our lawyers should stand firm and stop those lawyers who have been influencing them with money and akrantie.

Sorry, there are rules that the EC must also follow. Being the EC doesn't give you the right to do what you want even if it has no legal backing. Did the EC read and understand the whole CI 94?

A court decision can go either way. The fact that this decision went his way does not necessarily reflect his personal "experience". A court decision is never perfect, which is why everyday judgements get overturned on appeal.

It must be repeated: Yes errors must be given the chance to be corrected, but INTENTIONAL VIOLATIONS OF CRIMINAL NATURE are not honest and inadvertent errors. A PREMEDITATED ACT OF FORGERY AND DECEPTION is not an error that must be availed the opportunity for correction. What is the message of the court? That the EC can NEVER DISQUALIFY a candidate at all times and under any circumstances? Of course the (letter of the) law is an ass, but even then it can never and is not meant to cover every possible and specific situation. .. which is why very often and in cases like this we have to defer to the intent and spirit of law as well as the bigger public good.
