The Member of Parliament (MP) for Afram Plains South, Joseph Appiah Boateng, has threatened to sue the Electoral Commission (EC) of Ghana if it does not come out to clear the controversy surrounding the filing of nomination of two NDC candidates for the area.

On the deadline of submission of nomination forms for parliamentary candidates, two stalwarts from the NDC filed to contest the Afram Plains South seat following the resignation of Mr. Boateng, to contest for a second time.

The two, Mark-Oliver Kevor, the Eastern Regional Secretary of the NDC and Eric Osei-Owusu are all said to have filed their nomination at the same time but the Returning Officer for the area announced the former as the candidate for the Akatamansonians after scrutinizing his forms.

Kevor, according to inside sources, was given the mandate to file on the ticket of the Akatamansonians by the National Chairman of the NDC, Kofi Portuphy.

However, Eric Osei-Owusu who contested the incumbent MP but lost, according to party officials, was also given the mandate to file by the party’s Chief Scribe, Johnson Asiedu Nketiah, popularly known as General Mosquito.

The two candidates have been campaigning simultaneously as the NDC parliamentary candidate for the area.

Party officials in the Afram Plains South have for the past three weeks, been putting pressure on the National Executives of the party to settle matter as soon as possible or risk losing the seat to the opposition New Patriotic Party (NPP).

The MP on Thursday, October 13, 2016 gave the EC a 48-hour ultimatum to publicly announce the candidate who filed to contest on the ticket of the NDC. Failure to do so, he added, will see the EC being dragged to court.

But Mr. Nketiah commenting on the issue in an interaction with sit-in host, Kwaku Owusu Agyei, on Anopa Kasapa on Kasapa 102.5 FM, Monday, said Eric Osei-Owusu is the candidate the party has sanctioned to represent the Afram Plains South.

“If you go to the records of the Electoral Commission (EC) of Ghana, the one who has filed in the name of the NDC and who has been given the power to represent the party is Eric Osei-Owusu,” he announced.

Asked whether he is aware that Mr. Portuphy has also sanctioned the candidacy of Mark-Oliver Kevor, he retorted “We don’t have such in the records of the NDC.”

Mr. Boateng reacting to the comments of his party’s Chief Scribe on the problem said the EC has more questions to answer regarding the eligibility of Eric Osei-Owusu to contest the Afram Plains South parliamentary seat.

He told Owusu Adjei that as at the time of close of nomination, the CEO of Ghana Buffer Stock had not filed his nomination and therefore wondered how Mr. Osei-Owusu got that opportunity to represent the party.

“As at the close of nomination on the deadline date, September 30, 2016, Osei-Owusu had not filed his nomination. The EC closed at 5:00pm. And at 5:30pm, the EC announced that three candidates including Mark-Oliver Kevor had filed their nominations. So, I am wondering how Osei-Owusu filed his nomination.”

“The EC must tell us the date it opened their offices for Osei-Owusu to file his nomination. Again, as at the close of nomination, Osei-Owusu had not transferred his vote to the constituency. So, the EC must tell us when it transferred the vote of Osei-Owusu to the constituency. I want the EC to come out to explain itself on the matter or face court action,” he noted.

In some jurisdictions not all, accepting such a pardon implicitly constitutes an admission of guilt (see Burdick v. United States in the United States), so in some cases the offer is refused as in this case.

Cases of wrongful conviction are nowadays more often dealt with by appeal than by pardon; however, a pardon is sometimes offered when innocence is undisputed.

Read the Ghanaian law by which the appeal was applied. Don't bring theories that are not part of the existing law in Ghana. If you don't like the decision, why not go to the Supreme Court for redress. A rolling cannon-lawyer ...

Mr Tsatsu REJECTED THE PARDON!!! A pupil in JSS form 1 will understand the word rejected and know that Tsatsu refused to accept the pardon and that's why he has gone to court.

Prof Asare, what at all is your problem? You are NOT and will NEVER be a fraction of Tsatsu's stature. Check his achievements and you will realise that you should have been begging him to teach you.

I want the Dean of the Law School to truly investigate his academic achievements. I will bet that he had stolen some one's cert or copied in his exams.

You are wrong! He left the prison because he was pardoned. If he had refused the pardon, he should have stayed in prison. Prisoners do not come of prison to lead their normal lives unless they serve their term or are granted ...

Maybe, some might argue that the former President could have ordered for his re-arrest when Tsatsu rejected the pardon. But it was not Tsatsu's responsibility to re-submit himself for incarceration that he had been fighting from the get-go.

I agree with Dr. SAS that what decides the legitimacy of Lawyer Asare's suggestion is whether or not Tsatsu really rejected the Pardon. Everything else is moot.

Granted that you took part-time coursework in law and obtained a law certificate, which is a commendable achievement. However, this hardly makes you a law professor. Your day job is teaching accounting. Be proud of your profession and correct the wrong impression you're sending to the Ghanaian public.
As an accounting professor, honesty, truth and integrity ought to be high on your radar. What you're doing is fraudulent, to put it mildly.

As regards his reference to Tsatsu's locus standi for appealing his original sentence, Lawyer Asare seemed to have missed the fact that Tsatsu wrote to the President to reject the Presidential Pardon.

Just as one could choose to reject a milder alternative penalty and request for a harsher one for a crime he/she is charged with, Tsatsu rejected the Presidential Pardon and demanded for a more proper adjudication, with the caveat of maintaining his innocence.

Tsatsu's appeal was proper in the view of the fact that the former President misused his Executive Power to demand his retrial with a packed Bench, when the former had been earlier on acquitted.

So, Lawyer Asare must more carefully review his opinion, and not second guess the Judge without the full consideration of the facts applicable to the case.

I would, at this point, suggest we all let the case end as the Court has ruled, unless someone wants it to go back to the Supreme Court.

It would be at the height of dishonesty for anyone to claim Tsatsu's case was not politically motivated. We only have to compare the case of Dr. Anane who was later readmitted into Kufuor's Cabinet to see if Tsatsu got any fair deal. It was not proven that Tsatsu ever personally gained from the economic faux pas he was charged with, directly or indirectly. So, are we supposed to try every Civil Servant who makes a wrong decision, especially when that decision culminates in the Nation losing money? Committing Economic crimes against the Nation, among which is the sub-crime of causing financial loss to the Nation as Tsatsu was charged with requires a certain deliberate act of causing that loss. It was not proven that Tsatsu was that deliberate. His intentions were purely to grow the assets of the GNPC by that action of his any without personal interest. So, even a dismissal from his job would have been appropriate to make room for another more competent Official, maybe. If all actions that our Officials take to cause us to lose money were to be prosecuted, half of our Civil Servants would be in jail before their retirement age.

I am not a political fan of NDC's but as a Ghanaian, we all must fight for our common security and Justice under the Constitution, regardless of whose case is on the table.

Prior to the coming into power by the NPP, Kwaku Asare ran a campaign of vilification against Tsatsu. He acted as the hitman for NPP.

Now that he has egg on his face, he has to say something in an attempt to hide his own shame. Has he forgotten that Tsatsu rejected the pardon? Having rejected the pardon, could he have kept himself in jail?

Please Sir, Tsatsu never accepted the Pardon. He was admitted to bail by the High Court presided over by Justice Asante. So he has been on bail while pursuing his appeal.
