How on earth can you talk about filing an INJUNCTION after the performance of the act?. How did you obtain your Law Certificate?. Did you obtain it the same way as your uncle Nana Akufo Addo?. Do you understand in legal language the meaning of injunction?. You can file a WRIT of summons to declare the appointment Null and Void. What relevant provision in the 1992 Constitution will you quote to support your argument?. President Mahama's term of office started from 07 January 2013 and will end on 06 January 2017. According to the constitution, any thing done in his capacity of President of the Republic of Ghana is legitimate within this period. You have to go to court and prove that confirmation of Mr. Whittal's appointment as the CHRAJ boss is utra vires president Mahama's powers and unconstitutional and therefore void.Gabby Otchere Darko, please can you prove that?

According to Martin Amidu, CHRAJ was not the appropriate institution to exonerate Mahama from any wrong doing concerning the 'Ford Expedition Bribery Scandal', which meant that the acting CHRAJ boss was intimately in bed with the defeated president'.

Believe me; NDC will remain in opposition for 40 years since they are undemocratic and can not manage or grow the economy of this country. In fact,they are only stomach politicians and very, very corrupt and incompetent.

Everybody knows that until the midnight of 6th Jan 2017, Mahama has the full constitutional mandate to function as the president including hiring and firing BUT what do you understand by you own phrase "...to FACILITATE a SMOOTH handing over of the reigns of...". By his unguarded sinister appointments, is Mahama facilitating the smooth handing over of power or rather IMPEDING it? I'm afraid Kojo, this isn't about opinions neither has it anything to do with capitalisation, ITS ABOUT THE SPIRIT OF THE CONSTITUTION AND A SMOOTH, ORDERLY, TRANSPARENT, MORALLY CORRECT TRANSFER OF POWER to the next government.

Perhaps, if he had concentrated on not becoming Africa's second most corrupt president he wouldn't be making last minute appointments, with the understanding he would be saved from the throbbing whip of incorruptibility. This is how desperation looks like.

This is one of the constitutional and even 'common sense' issues in politics that need to be addressed.
As I reflect on the issues, what came to mind was what has happened in the United States: The Republicans refusing to even interview the judge President Obama had nominated because the nomination took place at 'ending days' of Obama's administration.
We have a parallel here in the appointment of CHRAJ's boss.
As I have always argued in Obama's case, if it is not unconstitutional, why must the president be faulted? Until the investiture of the president-elect, the incumbent must still do his work, which includes, making appointments.
However, in keeping with 'common sense' one would have expected restraints with regards to making key appointments (especially those that the in-coming government cannot easily replace). It's unfortunate, but I wonder if Gabby will have his way in a situation like this. Let's see what the courts say!
