  People are focused on trivial issues and shocking crimes that they are loosing sight of the broad picture of the tragedy that has befallen our people. sign contracts for someone else to supervise ,execute and pay for is absurd not to say out right criminal . Today we have a govt that embarked on a Saudi style Islamic govt whereby all the wealth and natural resources belong to the Saudi family and the nation is practically none existent. Today we see how the family Mahama now own all concessions for Bauxite , iron ore and other minerals contrary to the stipulations in the constitution and nobody is talking about that, the privatization and colonization of Akan lands by the wicked pepeni/ayigbe mafia oppressors.

  Sometimes I read from Ghanaians and ask myself, where were these countrymen before? The same NPP Govt under Ex Prez Kuffour did more than what is going on; who sacked the CHRAG Boss? Who created the NCCE vacancy? It was the NDC, and they have filled up the positions; not with aliens, but with Ghanaians who were already acting and were even working before the NDC came to power. What at all is wrong with this? Those positions are not ministerial for which the new NPP Govt may do whatever they want to do with them. It has happened before and it is not a taboo. NPP did it, you shut up; leave John Mahama alone.

  The legacy of Jerry John Rawlings, the former dictator of the Republic of Ghana. Mr. Rawlings had exercised dictatorial powers for 20 years, and he was supervising the writing on the 1992 constitution. The people writing the constitution had to yield to Rawlings' desires. Various revisions need to be made to the 1992 constitution to make it a more democratic document.

  While I agree with Dr. Osae that the President hasn't flouted any law, it would be insane to begin to apportion blame among the drafters of the Constitution.
  Constitutions drafted by humans, by the mere fact that humans are imperfect, are in of themselves bound to be imperfect. They represent the best attempt to capture all possible situations that may appertain to governance. Let's not forget that the oldest, written, constitution in the world is the over 200year old American Constitution, and it has had 27 amendments. It is hailed as a masterpiece, and its drafters and signers are equally hailed. So let's praise the drafters of our Constitution for giving It their best shot!

  DEAR NPP TRANSITION TEAM AND THE READING PUBLIC OF GHANAWEB.COM, IT IS A TRITE KNOWLEDGE THAT H.E.OUTGOING PRESIDENT OF GHANA JOHN DRAMANI MAHAMA HAS THE CONSTITUTIONAL POWER TO APPOINT THE COMMISSIONER OF CHRAJ UNDER ARTICLE 216 AND PURSUANT TO ARTICLE 70 IN CONSULTATION OF THE COUNCIL OF STATE. THAT ALSO THE OUTGOING PRESIDENT HAS THE CONSTITUTIONAL AUTHORITY PURSUANT TO ARTICLE 231 BY THE ADVISE OF THE COUNCIL OF STATE TO APPOINT THE COMMISSIONER OF NCCE. THAT THERE IS NO TIME FRAME PROVIDED UNDER THR CONSTITUTION FOR THE PRESIDENT TO MAKE SUCH APPOINTMENTS. THAT ARTICLE 57 CLAUSE 4 CLEARLY PROVIDED THAT ANY ACT DONE BY THE PRESIDENT IN HIS PUBLIC CAPACITY ARE NOT AMENABLE TO THR COURTS OF GHANA. THAT THE SUPREME COURT AUTHORITY ON THIS CASE LAW: NPP VRS. PRESIDENT RAWLINGS AND ATTORNEY GENERAL. IN THIS CASE WHEN PRESIDENT RAWLINGS APPOINTED THE DISTRICT CHIEF EXECUTIVES AND HE WAS CHALLENGED BY THE NPP OF HIS AUTHORITY FOR MAKING SUCH APPOINTMENTS. THAT IT WAS DURING THE ADJUDICATION OF THE MATTER THAT A PANEL MEMBER RAISED THE LEGAL ISSUE, WHETHER A SITTING PRESIDENT OF GHANA CAN BE SUED OR JOINED TO A LAWSUIT AS A DEFENDANT? THAT THE SUPREME COURT BY 3_2 MAJORITY RULED THAT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CANNOT BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT. THATTHE SUPREME COURT UNANIMOUSLY RULED THAT PRESIDENT RAWLINGS HAS THE CONSTITUTIONAL AUTHORITY TO APPOINT THE DISTRICT CHIEF EXECUTIVES.
  THEREFORE, WHETHER THE APPOINTMENTS OF BOTH COMMISSIONERS OF CHRAJ AND NCCE WERE MADE BY H.E.PRESIDENT JOHN DRAMANI MAHAMA IN GOOD FAITH OR BAD FAITH ?
  THAT AS LEGAL PRACTITIONER AND LEGAL/SCHOLAR/LEGAL CONSULTANT AND FOR THE SAKE OF ACADEMIC FREEDOM PROVIDED ALSO UNDER THE CONSTITUTION IN VIEW OF EXERCISING SUCH RIGHT AND FREEDOM THEN IT BEHOOVES ON ME TO RESPECTFULLY SUBMIT THAT THE APPOINTMENTS TO BE SEEN TO BE MADE IN GOOD FAITH SINCE THOSE INSTITUTIONS ARE PURELY INDEPENDENT THEN THEY NEED A FREE HANDS TO DO THEIR WORKS TO PROTECT THE BEST INTERESTS OF ALL PEOPLE LIVING IN GHANA DEVOID OF PARTISAN POLITICS OR ANY OTHER CONSIDERATIONS BE IT, NATIONAL ORIGIN, SEX, RELIGION AND OTHERS, THERETO.
  THIS IS BECAUSE THE INCOMING NPP GOVERNMENT GOING TO CONTROL BOTH THE FLAGSTAFF HOUSE AND PARLIAMENT OF GHANA AND THEREFORE, NEEDS THE INDEPENDENT INSTITUTIONS TO BE SEEN TO FUNCTION AS SUCH INCLUDING THE COURTS OF GHANA.
  THAT H.E. FORMER PRESIDENT OF GHANA JOHN AGYEKUM KUFUOR APPOINTED HER LADYSHIP CHIEF JUSTICE OF GHANA GEORGINA THEODORA WOOD BUT HER LADYSHIP AND H.E. PRESIDENT JOHN DRAMANI MAHAMA HAVE GOOD WORKING RELATIONS AND SHOULD BE COMMENDED.
  
  HENCE THE APPOINTMENTS OF BOTH COMMISSIONERS OF CHRAJ AND NCCE BY H.E.PRESIDENT JOHN DRAMANI MAHAMA TO BE SEEN IN GOOD FAITH.
  
  THAT SOME COMMENTATORS OF THE MEDIA WERE ALSO TRYING TO CITE H.E.PRESIDENT OF UNITED STATES OF AMERICA BARACK OBAMA NOMINATIONS OF A SUPREME COURT JUDGE WHO HAS NOT BEEN CONFIRMED YET BY THE SENATE OF THE UNITED STATES OF AMERICA AS A JUSTIFICATION THAT H.E.PRESIDENT OF GHANA JOHN DRAMANI MAHAMA APPOINTMENTS OF BOTH COMMISSIONERS OF CHRAJ AND NCCE NOT TO BE ACCEPTED.
  
  IN FACT, IT CLEARLY PORTRAYS OR SHOWS THAT THOSE COMMENTATORS EITHER DO NOT UNDERSTAND THE AMERICAN FEDERAL GOVERNMENT SYSTEM AND HOW IT OPERATES OR SHARE IGNORANCE, THERETO.
  
  THIS IS BECAUSE THE CONSTITUTION OF UNITED STATES OF AMERICA CLEARLY PROVIDES FOR THE VARIOUS CONSTITUTIONAL FUNCTIONS, IN THAT, ARTICLE 1 VESTED THE LEGISLATIVE POWERS IN CONGRESS AND THAT CONGRESS CONSISTS OF HOUSE OF REPRESENTATIVES AND THE SENATE.
  
  THAT ARTICLE II OF THE UNITED STATES OF AMERICA CONSTITUTION VESTED THE EXECUTIVE POWER IN THE PRESIDENT AND THE PRESIDENT MAKES NOMINATIONS FOR APPOINTMENTS AND THAT THE SENATE CONFIRMS THE NOMINATIONS.
  
  THAT ARTICLE III VESTED THE JUDICIAL POWER IN THE JUDICIARY OR THE SUPREME COURT OF UNITED STATES AND OTHER FEDERAL COURTS.
  
  THEREFORE, THERE IS A CLEAR SEPARATIONS OF POWERS OF THE THREE (3) ORGANS OF GOVERNMENT AND AT THE SAME TIME THEY ACT AS CHECK ON EACH OTHERS TO CHECK ABUSE AND EXCESSES OF POWERS PROVIDED UNDER THE THEORY OR DOCTRINE OF CHECKS AND BALANCES OF POWERS VESTED IN THE VARIOUS ORGANS OF GOVERNMENT.
  
  THEREFORE, IN THE SAME VEIN, THE INDEPENDENT INSTITUTIONS OF GHANA INCLUDING CHRAJ AND NCCE ARE EXPECTED BY THE CONSTITUTION OF GHANA TO ACT AS CHECKS AND BALANCES OF POWER VESTED IN CHRAJ AND NCCE TO UNDERTAKE MASS/PUBLIC EDUCATION OF CIVIL RIGHTS AND RESPONSIBILITIES OF THE PEOPLE OF GHANA.
  
  IN CONCLUSION, THEREFORE, H.E.PRESIDENT OF GHANA JOHN DRAMANI MAHAMA UNTIL JANUARY 7, 2017 IS THE SUBSTANTIVE PRESIDENT OF GHANA AND THE APPOINTMENTS OF BOTH COMMISSIONERS OF CHRAJ AND NCCE TO BE SEEN AS AN ACT OF GOOD FAITH.
