The problems with the interpretations of some sections of the constitution are because the constitution was POORLY WRITTEN by some Nit-wit, egomaniac, selfish, bad haircut corrupt Nincompoops.

(A) On presidential appointments, the constitution says "THE PRESIDENT” shall in consultations with the Council of State, daadaadaaaa and not “PRESIDENT-ELECT." Do you understand that Ayenini & Co??? (B) So, until Nana is sworn in, he is NOT the president of Ghana, but Mahama. (C) The constitution further says “the President shall appoint members of the Council of State”, but Akufo-Addo is NOT yet the President and can't appoint those members. So, should Akufo-Addo seek the advice of President Mahama's Council of State or a Council he (Akuffo-Addo) will appoint, which he can't do now until he becomes president??

The same foolishness goes with the benefits paid to some Article 71 office holders. The constitution says, END OF SERVICE BENEFITS or GOING ON RETIREMENT: So, why pay MPs, who have been “RE-ELECTED” and never ended their services to the nation or not in retirement?? Again, people are MIS-Interpreting the damn constitution to suit their selfish ends, because the constitution was poorly written and, thus, leading to the massive robbing of the nation!!
Therefore, you could say some of the authors of the constitution are, indeed, KOOKOOASE lawyers—no ifs or buts!!

So, if Nana and the NPP are really serious, then “some constitutional amendments should be undertaken” to right the so many wrongs in the document.

Samson, you totally got it wrong this time around. The law says "the President" shall "appoint"....... in consultation with the council of state. Is Nana Addo the president as I write?? Nana Addo is currently the "president-elect" and not the "president". Any announcements he makes before he's sworn in are mere proposals or intent to appoint, and do not constitute appointments.

After Nana Addo is sworn in tomorrow, we can then question the legitimacy of those announcements, for instance, if Frema Opare can perform and the others can work legally in those capacities when the council of state had not been consulted.

I think we should rather focus on which council of state Nana Addo, or any new president, is going to consult, bearing the fact the the tenure of the current council of state ends tomorrow, 7th January. Is he going to consult the current council of state constituted during Mahama's time, which includes persons that were appointment by Mahama?

You should give the President elect credit for naming his staff to prepare prior to assumption of office so that he can hit the ground running. Have you seen the date of appointments for those that were outdoored? Besides, other superior legal minds have argued that what he has done does not violate any constitutional provision.
The president elect is a lawyer and he has Bediatuo Asante and Abu Jinapor. They would have advised him if what he was going to do were out of order. You know Bediatuo is are sharp cookie. ? Before you talk do better research.

First we need to look at the Council of State as a body in the governance affairs of this country. Is it truly a Council of State in the truest sense of the word or a partisan body of the gov't body in power?
Having addressed that, we have to look at what Akufo Addo meant when he said he would consult the NPP NEC concerning his appointments.
Then we finally have to look at these appointments within the context of the definition of SHALL as captured above, and the Act itself.
Does the Act specifically spell out who qualifies as Presidential Staff or it is silent.
Then after all that is considered we can safely arrive a conclusion as to whether any appointments have been made, or being suggested, or properly or improperly been made.
