Hahahahaha! Anyway, Court throws out Abronye, Obiri-Boahen case against Kofi Adams.

An Accra High Court General Jurisdiction 5 has dismissed an application brought to it by Nana Obiri Boahen, Abronye and David Asante to dismiss a defamation suit brought before it by the National Organiser of the National Democratic Congress (NDC), Mr Kofi Adams.

The presiding judge dismissed their application and slapped them with a cost of GH¢3,000.00

The court said it was surprised that they couldn’t “notice” the clear and adequate particulars the plaintiff pleaded plus the reliefs sought before they filed the motion to ask the court to strike out the case for allegedly not disclosing a cause of action.

The court held that the plaintiff had made more than sufficient references to the specific allegations, the dates and times they were made and the specific radio/media platforms on which the allegations were made by defendants against plaintiff.

The second claim of non-payment of required fees is equally not sustainable and even if that were the case, the plaintiff would be made to pay a top-up.

In any case, the rules of court do not support the claims made by defendants, the court held, and consequently dismissed the application.

By the ruling, the defendants will now have to file their defence for the case to proceed.

He is not fit to practice as an Attorney as this appears like a personal vendetta against the EC Chairwoman. He should be compelled to provide the names of the petitioners, otherwise, he would be considered as the petitioner.

This attempt to impeach Charlotte Osei will backfire very badly. And people should hold accountable, not only the Petitioners, but, also, their Lawyer, Opoku Agyemang.

It is one thing counseling a Client, and another thing the Lawyer making the case so personal that it seems more like he himself is one of the Petitioners.

The pledge the Lawyer made that he would fight until the EC Chair is sacked, strongly suggests a very personal beef he has against the Chairperson. But one is thing is certain. And that is: if the Courts would be fair and just, and the President and the CJ not partisan, the Petition could only be won with provable facts. Opoku Agyemang cannot manufacture his own facts with which to convict the EC Chairperson.

So, he better be very careful, or he would lose his license to practice. Meanwhile, there is substantial credibility in the suggestion that the Petitioners are simply pursuing a partisan persecution of the EC Chairperson. Besides, the Petition also seems to have more to do with the case of missing funds from the EC for which the EC Chairperson suspended some suspects pending investigations.

Those likely culprits and their sympathizers are the ones behind this Petition, and they seem to have found an overzealous partner in Lawyer Opoku Agyemang, a deeply NPP-tainted partisan Attorney, in getting rid of Charlotte Osei to cover their corruption .

I think the President and the CJ ought to remove themselves from this Petition and let the Courts handle it fair and square. In fact, with this situation for a background, we should demand that the Power to appoint EC Chairpersons be removed from the Executive and given to the Parliament before our next Elections come due.

That is the only way we could have an EC Chairperson with no burden of proof of neutrality from any particular Party. Right now, the EC seems to be under siege by NPP operatives seeking partisan vengeance for her perceived sympathy for the NDC. That is a very dangerous path to tread for our future Elections and stability.

We do have intelligent people in Ghana but when it comes to muguyaro, mumu, akpala, mormorni, koby brain and the likes we do have in abundance. Chai chai. All those calling for the removal of the EC chairperson should consider their head empty. God gave you brain, and yet your allow politicians to gradually replace your brain with shit.
