A marriage remains legal even if the parties stay apart for decades, for only a dissolution of the marriage can end the legal rights enjoyed by the married couple. We may wonder why they stayed separate for so many years, but only those two know why, and one of them is no longer here to say why. Absent a court order dissolving the marriage, Serwaa still remained a legal spouse of Lumumba. Even if Serwaa had been married to Lumba in a traditional wedding and later entered into a civil marriage with Lumba in Germany, the court in Ghana has an obligation to recognize the civil marriage since that civil marriage has legal precedence over the traditional marriage. A traditional marriage no longer has any effect once the parties later enter into a civil marriage. Ghana recognizes marriages entered into in foreign jurisdictions, and the court in Ghana should have recognized Serwaa's foreign marriage. The court in Ghana could only recognize Serwaa's traditional marriage if it found that the civil marriage in Germany was never recognized by the courts in Germany. The court in Ghana clearly erred by refusing to recognize the parties later civil marriage in Germany. Without any evidence that the civil marriage in Germany is defective, the court in Ghana should have recognized that civil marriage and should not have relied on a prior traditional marriage to arrive at its decision.

Legally, the burden of proof should come from the oppose party but we have this local corrupt high court judge who could not see further than her nose and did not know what is Vienna Convention on Diplomatic Relations. Any official letter from the Diplomatic Missions must be recognised. Even Africans diplomatic Missions in the Western world official letters are recognised in every institution. It is a disgrace and a slap across the face of Ghanaians living abroad.
