Daddy Lumba's first wife Akosua Serwaa heads to Court of Appeal

The legal battle involving the surviving wives of the late Ghanaian highlife musician, Charles Kwadwo Fosu, popularly known as Daddy Lumba, has taken another turn after the late singer’s first wife has filed fresh documents challenging a High Court ruling.

Earlier on November 28, 2025, a Kumasi High Court presided over by Justice Dorinda Smith-Arthur ruled that two women, Priscilla Ofori, popularly known as Odo Broni, and Akosua Serwaa, should both be recognised as surviving wives of the late musician.

The court held that both women were customarily married to Daddy Lumba and dismissed a purported German marriage certificate submitted by Akosua Serwaa to establish a civil marriage with the late singer.

During the ruling, Justice Smith-Arthur noted that the document presented was only an extract and not an original certificate, and therefore could not be accepted as valid proof of a civil marriage.

Following the ruling, Akosua Serwaa filed an appeal at the Court of Appeal in Kumasi.

In a recent development, fresh documents shared by Gossips24 Avenue and sighted on June 11, 2026, revealed additional filings made by lawyers representing Akosua Serwaa.

Speaking in an interview, counsel for Akosua Serwaa explained why the Court of Appeal granted them the opportunity to amend the appeal.

“There is a pending appeal against the ruling of the Kumasi High Court. The appeal challenges the validity of the marriage. We appeared today to amend the grounds of appeal so we can address and correct certain issues arising from the judgment,” he said.

According to the fresh filings, Akosua Serwaa argued in her grounds of appeal that Justice Dorinda Smith-Arthur made a mistake in her ruling when she noted that the plaintiff/appellant (Akosua Serwaa) failed to prove the existence of her monogamous civil marriage between the late Lumba.

Read some of the grounds of appeal and particulars of error below:

1. The learned trial judge erred in law by holding that the plaintiff/appellant failed to prove the existence of a valid monogamous civil marriage contracted in Germany between herself and the deceased, Charles Kwadwo Fosu alias Daddy Lumba.

2. The lawyers further argued that the court improperly conflated the legal requirements for proving foreign law with the validity of the ordinance marriage allegedly contracted in Germany.

3. The learned trial judge failed to adequately consider evidence presented by the plaintiff/appellant, including evidence of cohabitation, public representation by the deceased, eyewitness testimony, photographic evidence, children from the union, documentary evidence, and correspondence from the German Embassy in Ghana, which they claim substantially corroborated the existence of the alleged marriage.

4. The learned trial judge misdirected herself by treating alleged deficiencies in the authentication of the foreign marriage document as conclusive proof that the marriage did not exist.

5. The learned trial judge wrongly interpreted Section 161 of NRCD 323 as imposing a mandatory and exclusive condition precedent for the admissibility and probative value of foreign documents.

6. The learned trial judge erred by treating the absence of certification by the Ghana Embassy in Germany as conclusively fatal to the plaintiff/appellant’s case despite what they described as substantial corroborative evidence on record.
